BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." A recorded vote was taken in respect to the by-law to amend Chapter 504 of the City of Kitchener Municipal Code regarding Adult Entertainment Parlours. Aldermen B. Stortz, M. Wagner, M. Yantzi, G. Leadston, C. Zehr, J. Ziegler, B.M. Hiscott and G. Lorentz voted in favour, while Mayor D.V. Cardillo and Alderman J. Smola were opposed. B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1 Banner Request It was resolved: "That in conjunction with the designation of January as 'Crimestoppers Month' in the City of Kitchener, we grant permission to Waterloo Regional Crimestoppers to erect a banner on King Street at Frederick/Benton Streets from Monday, January 13, 1992 to Friday, January 31, 1992, inclusive. Further, that this organization make the necessary arrangements with the City's contractor for erection and removal of the banner and the payment of any costs associated therewith. And further, that the Chief Administrative Officer be authorized to schedule the erection and removal of this banner on an annual basis as requested." 2. Certification of Title Application - Chicopee Ward It was resolved: "That the Mayor and Clerk be authorized to execute a Consent and Waiver of Notice and draft reference plan to expedite a Certificate of Titles Act Application by Mackenzie M.E.F. Management Inc., with respect to lands described as Part Lot 7, Municipal Compiled Plan 987 and Part Lot 44, Municipal Compiled Plan 986, designated as Part 1 on Plan 58R-6932, in the City of Kitchener, Regional Municipality of Waterloo." 3. Encroachment Aqreement - BRIDGEPORT NORTH WARD It was resolved: "That the Mayor and Clerk be authorized to execute an Encroachment Agreement with the registered owners of Part Lot 141, municipally known as 38 Waterloo Street, to legalize several existing encroachments onto a public laneway and the road allowance known as Waterloo Street, namely: 1. the house as it extends 1.5 feet, more or less, onto the public laneway; the house as it extends 1.3 feet, more or less, onto the road allowance known as Waterloo Street; the landing as it extends 7.3 feet, more or less, onto the road allowance known as Waterloo Street; and COMMITTEE OF THE WHOLE MINUTES NOVEMBER 18, 1991 B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (CONT'D) the steps as they extend 10.1 feet, more or less, onto the road allowance known as Waterloo Street, subject to the removal of the existing shrub and tree at the front of the property and the removal of the shrubbery and chain link fence along the northerly side of the property." Licences It was resolved: "That the Knights of Columbus Father Funcken Council No. 1504 be granted permission to sell Raffle Lottery tickets in the City of Kitchener under City of Toronto licence #P91378, for a draw to be held in the City of Toronto on May 16, 1992." - and - "That the City of Kitchener has no objection to a Provincial Monte Carlo Licence being issued to Ontario Track 3 Ski Association for the Disabled, for a Monte Carlo event to be held on December 31, 1991 at Chicopee Ski Club, Kitchener." Africa 2000: The Municipal Response It was resolved: "That the letter from the Federation of Canadian Municipalities dated October 29, 1991, outlining the continuation of the Kitchener/Windhoek technical exchange under the Africa 2000 Program be received for information." Variances to Municipal Code, Chapter 630 (Fences) - FOREST WARD It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of October 29, 1991, recommending approval of Submission No. F 9/91 - Robert & Kim Mercer & Submission No. F 11/91 - Mike & Cindy Young - Be Ratified and Confirmed." Variances to Municipal Code, Chapter 680 (Siqn) - VICTORIA PARK WARD It was resolved: "That the decision of the Committee of Adjustment sitting as a Standing Committee of City Council, of October 29, 1991, recommending approval of Submission No. S. 8/91 - Truscan Realty Limited - Be Ratified and Confirmed." Minutes of Settlement - VICTORIA PARK WARD It was resolved: "That the Mayor and Clerk be authorized to execute the minutes of settlement between Epton Industries Inc. and the Regional Assessment Commissioner, Region 21, as they relate to the assessment appeals by Epton Industries Inc. for the years 1985 to 1991 inclusive." New Binqo Hall It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to COMMITTEE OF THE WHOLE MINUTES NOVEMBER 18, 1991 REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (CONT'D) Fathers for Justice, P.O. Box 3034, Kitchener, to conduct bingos at 329 King Street East, Kitchener, provided that Council's approval is subject to the following: 1. That the applicant limit its bingo activities to the City of Kitchener. 2. That the applicant meet all terms and conditions of Kitchener's Consolidated Bingo Regulations as passed by City Council. 3. That the applicant meet with the Manager of Licensing to review the above regulations prior to any licence being issued. 4. That for record purposes, copies of all bingo reports for licences issued be forwarded to the municipality. 5. That all Provincial Bingo Lottery requirements are met." 10. Tenders It was resolved: "That tender T91-82, Domestic Gas Meters, be awarded to Canadian Mete Company Inc., Milton at their tendered unit price for rebuilt domestic gas meters." - and - "That tender T91-94, Park Planting and HEPC Corridor Planting, be awarded to Ebert's Tree Farms Limited, Thamesford at their tendered price of $64,217.60."
