BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Sale of Permanent Easement - WEST WARD It was resolved: "That the City of Kitchener agrees to sell to the Regional Municipality of Waterloo for 2 · the sum of one dollar, a permanent easement of 13.5m located on the North s~de of Westmount Road West at Henry Sturm Greenway, and further, That the purchaser obtains and registers a survey describing the easement at no cost to the City, and further, That the Mayor and Clerk be authorized to complete the necessary documentation as required by the City Solicitor." 2. Licenses It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to the St. John's-Kilmarnock School to conduct a Raffle Lottery in conjunction with their Sixth Annual Ball to be held at the Valhalla Inn, Kitchener, on April 25, 1992." - and - "That the Ontario Federation of Anglers & Hunters be granted permission to sell raffle lottery tickets in the City of Kitchener under Provincial Licence #848957 for a draw to be held on May 31, 1992." 3. 1995 Plowinq Match It was resolved: "That the City of Kitchener supports in principle, the submission of a bid to the Ontario Plowmen's Association to host the 1995 Plowing Match and Farm Machinery Show in the Waterloo Region." 4. Consent - FAIRVIEW WARD It was resolved: "That the purchase by the Corporation of the City of Kitchener from Arlin Snider of the lands described in Instrument No. 270596 is hereby ratified and confirmed, and further, That the City confirms that on December 16, 1991 the property municipally known as 135 Otonabee Drive complied with the restrictive covenants set out in Instrument Nos. 387900, 424925 and 765511 ." REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (CONT'D) Variance of Municipal Code, Chapter 680 (Siqn) - BRIDGEPORT NORTH WARD It was resolved: "That the decision of the Committee of Adjustment siting as a Standing Committee of City Council, of November 26, 1991, recommending approval of Submission No. S 9/91 - Eldorado Plywood Specialties - Be Ratified and Confirmed." Zone Chanqe Application 91/01/H/PMc - WEST WARD It was resolved: "1. That City Council's June 24, 1991 approval of Zone Change Application 91/1/H/PMc (Kitchener Silo Co. Ltd.) be amended as follows: a) That the revised Proposed By-law attached dated, November 6, 1991, replace the April 30, 1991 By-law previously approved. b) That Condition two be revised to read as follows: 'That the owner convey to the City Parts 3 and 4 of Plan 58R-7814, at no cost and free of encumbrance, prior to the passing of the zoning by-law by City Council.' That City Council consider the change to the By-law as minor in nature and not require any further notification prior to its passing." Storm Drain - SOUTH WARD It was resolved: "That the City of Kitchener accepts the offer from Mr. and Mrs. A.K. Croal to sell to the City of $2,500.00, an easement in perpetuity for a storm drain under part of their property known as 52 Edgehill Drive, Kitchener, legally described as Part Lot 8, Plan B.B.F.C. and designated as Parts 7 and 9 on Reference Plan 58R-7393, and further, That the City of Kitchener accepts the offer from 421304 Ontario Ltd. to sell to the City for $7,200.00 an easement in perpetuity for a storm drain on part of the property known as the Embassy Motel, 4521 King Street East, Kitchener, legally described as Part Lot 8, B.B.F.C. and Part Lot 23, B.B.F.C. and designated as Parts 8, 10, and 11 on Reference Plan 58R-7393, and further, That the City of Kitchener accepts the offer from J. Schmiedendorf to sell to the City of Kitchener for $5,650.00 an easement in perpetuity under part of the property known as 69 Edgehill Drive, Kitchener legally described as Part Lot 9, Plan 689 and designated as Part 4 on Reference Plan 58R-7393, and further, That the Mayor and Clerk be authorized to complete the necessary documentation as required by the City Solicitor." New Binqo Hall The Committee considered a memorandum from the Manager of Licensing pertaining to an application from Cameron Heights Collegiate Institute to conduct bingos in Kitchener at 329 King Street East. Alderman M. Wagner noted that from the information provided it would appear that the school has given its permission to the Collegiate conducting bingo games but noted that the correspondence did not state that the School Board has approved of the application for a Provincial licence. Mr. R.W. Pritchard advised that senior staff of the Waterloo County Board of Education were supportive of the application but suggested it should receive the approval of Board representatives. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (CONT'D) Mr. Paul Schweitzer, a teacher from Cameron Heights Collegiate, appeared as a delegation and advised that the purpose of the application was to assist the Student Council in raising funds to support various student undertakings as the school had a Iow participation rate with respect to revenues derived from the sale of Student Activity Cards. A motion by Alderman M. Wagner that we approve of the staff recommendation in respect to this matter provided the undertaking receives approval of the Waterloo County Board of Education was voted on and LOST. It was resolved: "That the City of Kitchener has no objection to a Provincial Licence being issued to Cameron Heights Collegiate Institute, 301 Charles Street East, Kitchener, to conduct bingos at 329 King Street East, Kitchener, provided that Council's approval is subject to the following: 1. That the applicant limit its bingo activities to the City of Kitchener. That the applicant meet all terms and conditions of Kitchener's Consolidated Bingo Regulations as passed by City Council. That the applicant meet with the Manager of Licensing to review the above regulations prior to any licence being issued. That for record purposes, copies of all bingo reports for licences issued be forwarded to the municipality. 5. That all Provincial Bingo Lottery requirements are met." Tender It was resolved: "That tender T91-102, Printing of Parks and Recreation Leisure Magazine, be awarded to NCC Publishing Limited, Tillsonburg, Ontario at their tendered price of $52,297.51 ." 10. Consent - Twinqate Construction Ltd. It was resolved: "That the City consent to the transfer from Twingate Construction Ltd. to Anna Richter of condominium units #2 and #4 at the property described as Part 3 on Reference Plan 58R-5840, now described as Waterloo North Condominium Corporation No. 170 and municipally known as 62 McBrine Place, Kitchener." 11. Offer to Purchase - A.C.I. Adjusters Canada Incorporated, In Trust 12. It was resolved: "That the Mayor and Clerk are hereby authorized to execute an Offer to Purchase submitted by A.C.I. Adjusters Canada Incorporated, In Trust, for a corporation to be incorporated, for Part 8 on Reference Plan 58R-7231 in Phase I of the Lancaster Corporate Centre for the sum of $311,360.00, and further, That the Mayor and Clerk are hereby authorized to execute any documentation necessary to effectuate the sale." Alderman J. Ziegler disclosed a conflict of interest and abstained from all discussion and voting as some of the applications involve former clients of his. Alderman C.
