A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING
It was resolved:
"That the by-laws considered by this Committee be taken as read a second time and be
recommended for enactment."
B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER
1 .Licences
It was resolved:
"That the Woodstock District Community Complex Campaign Office be granted
permission to sell Raffle Lottery tickets at Fairview Park Mall in Kitchener under
Provincial Licence #P14191 on April 9, 10, 11, 1992."
- and -
"That the City of Kitchener has no objection to a Provincial Licence being issued to
the Downtown Bingo Association to sell Break-Open tickets in conjunction with their
bingo events at The Downtown Club, 329 King Street East, Kitchener."
- and -
"That the City of Kitchener has no objection to a Provincial Lottery Licence being
issued to K-W Oktoberfest Inc. to conduct a Raffle Lottery at the Valhalla Inn,
Kitchener on November 26, 1992."
- and -
"That the City of Kitchener has no objection to a Provincial Licence being issued to
the Juvenile Diabetes Foundation Canada to conduct a Monte Carlo event on May 2,
1992 at Marshall Hall, Bingeman Park Farms, Kitchener."
- and -
"That the City of Kitchener has no objection to a Provincial Licence being issued to
the Kitchener-Waterloo Symphony Orchestra Association to conduct a Raffle Lottery
at the Centre In The Square, Kitchener, with a series of draws commencing April 26,
1992 and ending August 2, 1992."
2. Quit Claim Deeds
It was resolved:
"That a Reference Plan be obtained at the cost of the City to enable a Quit Claim
Deed to be prepared in favour of Helen Kukulki with respect to an encroachment and
right-of-way and to enable the provision of a storm sewer easement to the City. The
Quit Claim Deed to be prepared in a form satisfactory to the City Solicitor and that the
Mayor and Clerk are hereby authorized to execute same."

"That the Mayor and Clerk execute a transfer of Part Lot Q, Plan 670 shown as Part 1
on a draft reference plan dated October 9, 1991 to the abutting property owner and
further, execute quit claim deeds to abutting property owners for Part Lots 31 and 32,
Plan 670 shown as Parts 2, 3 and 5 on the said reference plan."

3. Public Library Board -Appointments
It was resolved:
"That we endorse the appointment by the Waterloo County Board of Education of Eric
C. Bow and Susan D. Maine as the Board's representatives on the Kitchener Public
Library Board for the period December 1, 1991 to November 30, 1994."
4. Request to Use "Kitchener"
It was resolved:
"That City Council has no objection to the 'Kitchener Industrial Coalition' using the
name 'Kitchener' within its organization's name and hereby approve such use."
5. Bell Canada Easements
It was resolved:
"That the Mayor and Clerk be authorized to execute a grant of easement in favour of
Bell Canada over lands designated as Part Block 'D', Registered Plan 1257."
- and -
"That the Mayor and Clerk be authorized to execute a grant of easement in favour of
Bell Canada over lands designated as Part of Part 8, 58R-7008."
6. Execution - Master Proof of Loss
It was resolved:
"That the Mayor and Clerk be authorized to execute a Master Proof of Loss in the
amount of $10,193.99 pertaining to water damage from a ruptured water pipe at the
Utilities Centre on or about December 28, 1990."
7. Doon Heritaqe Crossroads - Mobile Food Waqon
It was resolved:
"That Doon Heritage Crossroads be granted permission to operate a mobile food
wagon at their Town & Country Antique Car Meet to be held on June 21, 1992 at their
premises on Huron Road, Kitchener."
8. Subsidy Request
It was resolved:
"That the Mayor and Clerk be authorized to execute Request No. 1 pursuant to The
Public Transportation and Highway Improvement Act for the allocation of Provincial
subsidy funds for the year 1992 in the amounts of $14,000. Capital and $642,353.
Operating to assist in providing public transportation service for physically disabled
persons."

"That the Mayor and Clerk be authorized to execute Request No. 1 pursuant to The
Public Transportation and Highway Improvement Act for the allocation of subsidy
funds for public transportation for the year 1992 in the amounts of $3,723,020 for the
Capital Assistance Programme and $3,060,548. for the Transit Operating Assistance
Programme."

9. Annual Air Cadet Taq Day
It was resolved:
"That the City of Kitchener approves of No. 80 K-W Squadron, No. 822 Squadron and
No. 530 Waterloo Squadron Royal Canadian Air Cadets conducting a joint Tag Day in
Kitchener on May 8th and 9th, 1992."
10. Appointment - Ontario Traffic Conference
It was resolved:
"That Don Snow, Director of Traffic & Parking, be appointed as the City of Kitchener's
delegate to the 42nd Ontario Traffic Conference Annual Convention to be held in
Pembrooke, Ontario, May 31 to June 3, 1992."
11. Committee of Adjustment - Memberships, Subscriptions & Conference
It was resolved:
"That Messrs. B. Lackenbauer, P. Kruse, K. Gore, D. Jamieson and F.W. Lehman be
permitted to become active members of the Ontario Association of Committee of
Adjustment and Consent Authorities for 1992, with the total cost of these
memberships being $275.
That Messrs. B. Lackenbauer, P. Kruse, K. Gore, D. Jamieson and F.W. Lehman be
permitted to attend the Conference of the Committee of Adjustment and Consent
Authorities to be held in Windsor, Ontario from May 31, 1992 - June 3, 1992 with the
City of Kitchener to pay the normal expenses incurred.
That Messrs. B. Lackenbauer, P. Kruse, K. Gore, D. Jamieson and f.W. Lehman be
permitted subscriptions to Municipal World with the total cost of these subscriptions
being $180."
12. Various Tenders
Alderman G. Lorentz questioned the tender for Proposal P91-106 respecting the supply of
photocopiers and Mr. F. Clement advised that the contract involved 53 photocopiers,
including the Kitchener Public Library and that such tender was called by the City every 3
years.
In reference to the tender for Proposal P91-107 respecting the operation of a restaurant at
the Victoria Park Boathouse, Alderman G. Lorentz commented that he felt acceptance
should be conditional on a suitable negotiated settlement.
It was resolved:
"That proposal P91-106, Photocopiers, be awarded to Bradcor Systems Limited,
Kitchener at their proposed price of $162,219.75."
- and -
"That proposal P91-107, Operation of a Restaurant - Victoria Park Boathouse, be
awarded to S.M. Biers Holdings of Kitchener."
13. Tax Adjustments - Applications for Cancellation, Refund, Reduction or Levy of
Taxes - February 10, 1992 Hearinq
The Committee considered a letter dated February 5, 1992 from Mr. R.W. Pritchard,
Commissioner of General Services & City Clerk, relative to cancellation, refund, reduction
or levy of taxes.

It was resolved:
"That the applications attached hereto and forming part of these minutes relative to
cancellation, reduction, refund or levy of taxes be disposed of as recommended
therein."
14. Storm Drain Easements - Edqehill Drive
The Committee was in receipt of a memo dated February 10, 1992 to Mr. T. McKay from
Mr. G. Andersen recommending acceptance of offers to sell easements in perpetuity for a
storm drain through property on Edgehill Drive. It was noted in the report that storm water
from the area near King Street East drains towards the river and is piped under Edgehill
Drive, where the outflow causes erosion and interference with wells on private property.
The improvements will increase the capacity of the drainage system and pipe the water to
the river without erosion.
It was resolved:
"That the City of Kitchener accepts the offer from Mr. and Mrs. J.S. Banks to sell to
the City for $10,000.00, an easement in perpetuity for a storm drain under part of their
property known as 65 Edgehill Drive, Kitchener, legally described as Part Lot 9, Plan
689 and designated as Parts 1 and 2 on Reference Plan 58R-7393 and Part 3 on Plan
58R-6096; also included is a temporary construction easement over Part 3, Plan 58R-
7393; and further,
That the City of Kitchener accepts the offer from John Gikopoulos, Mbamby Govanis
and Mary Govanis to sell to the City for $1,000.00 an easement in perpetuity for a
storm drain on part of the property known as vacant land next to 4521 King Street
East, Kitchener, legally described as Part Lot 8, B.B.F.C. and designated as Part 11
on Reference Plan 58R-7393; and further,
That the Mayor and Clerk be authorized to complete the necessary documentation as
required by the City Solicitor."
