BY-LAWS AS LISTED ON THE AGENDA - 2ND READING It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." REPORT OF THE CHIEF ADMINISTRATIVE OFFICER 1. Industrial Land Consent - SOUTH WARD It was resolved: "That the City consent to a mortgage from Anna Kecman to Angela Arndt and Anna Schwab for the property described as Unit 14, Level 1, W.N.C.C. Plan #150 and municipally known as Unit 14 -49 Mclntyre Place, Kitchener." 2. Deleqation of Siqninq Authority - Reqistration of Conditional Sales Contracts It was resolved: "That the City delegate to Henry Binnema, Rosemary Upfold and Joyce Schmitt of the Accounting Department the authority to sign documentation pertaining to the registration of security interests taken by the City in furnaces and related equipment sold through the Kitchener Utilities program where there has been a partial or full default in payment of an instalment by the purchaser or where for humanitarian reasons credit is being extended despite the poor credit rating of the purchaser." Ministry of Transportation - Request for Exemption - Municipal Code, Chapter 450 (Noise) Alderman J. Ziegler questioned if there was a time limit being considered in respect to the noise exemption request for highway improvements. Mr. D. Snow advised that the improvements related to a 1993 project and tender documents were yet to be prepared which would outline the extent of improvement work; however, he noted that it was intended that the exemption apply from a point after the evening rush hour to the early morning hours. He noted that primarily the work represented resurfacing of existing lanes. It was resolved: "That the Ministry of Transportation be granted an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code to accommodate improvements scheduled for a portion of Highway #8 from the K-W Expressway to South of the Grand River in 1993." 4. Applied Learninq Contract It was resolved: "That the Mayor and Clerk be authorized to execute an access agreement with Applied Learning (Canada) for a 2 year period to cover in-house educational programs." 5. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER (CONT'D) "That the Mayor and Clerk be authorized to execute a grant of easement in favour of Bell Canada over lands designated as Part of Block "B", Registered Plan 1170." 5. Bell Canada Easements (Cont'd) - and - "That the Mayor and Clerk be authorized to execute a grant of easement in favour of Bell Canada over lands designated as Part of Block 153, Registered Plan 1688." 6. Deed - STANLEY PARK WARD It was resolved: "That the City accept and register a Deed from the Grand River Conservation Authority for Part of Lot 120, German Company Tract, designated as Part 1, Plan 58R-6042 for the realignment of Ebydale Drive." 7. Tenders It was resolved: "That proposal P91-108, Consultant's Services - Continuous Improvement Program, be awarded to Ernst & Young Management Consultants, Kitchener to assist in the development and implementation of a Continuous Improvement Program involving City Council and staff, subject to a satisfactory agreement being negotiated and an upset fee established." - and - "That tender T92-14, Radio Maintenance, be awarded to Runke Radio Inc., Kitchener at their tendered price of $53,568." - and - "That tender T92-16, Reconstruction of Ontario Street (from King Street to Charles Street), be awarded to Omega Contractors, Westminster, Ontario at their tendered price of $436,144. (plus G.S.T.)." 8. Kitchener Downtown Business Association Alderman C. Zehr questioned why the levy of the Downtown Business Association had been reduced. Mr. J. Gazzola advised that it appeared that a transfer from reserve funds had allowed for reduction of the levy. It was resolved: "That the 1992 Operating Budget of the Kitchener Downtown Business Association as presented by their Board of Management in the amount of $342,421.68 be ratified and levied pursuant to Chapter 70 (Downtown Improvement Area, Board of Management) of the City's Municipal Code." 9. Conveyance - SOUTH WARD It was resolved: "That, when Pieter Vos Limited and Magdalene Stumpf, adjacent owners to Doon Valley Drive (closed) abandon their rights thereto, the City convey to Freure Doon Settlement Limited Parts 2 to 5 inclusive on Reference Plan 58R-7422 for $40,700.00 according to the terms of sale of By-law 92-34 along with a one foot reserve (Part 1 on the Plan) for nominal consideration." Mayors' Committee on Race Relation The Committee was in receipt of a letter dated March 5, 1992 from Mayor D.V. Cardillo advising that the Mayors of each of the seven municipalities within the Region, along with the Regional Chairman, have undertaken to support the establishment of a Race Relations Committee. The Committee is comprised of a variety of community representatives and Alderman T. Galloway will be serving as a member from Kitchener City Council. The Committee was asked to support recommendations and a Statement of Intent attached to Mayor Cardillo's letter. In response to Alderman J. Ziegler, Mr. R. Freeborn advised that there was no special funding available from the Province to support cross cultural awareness training and Mr. T. McKay advised that the costs were coming out of the City's Training Budget. In regard to the secretariat function, the Committee was advised by Mayor Cardillo that one of the Employment Officers would handle the secretariat function. On motion by Mayor D.V. Cardillo - it was resolved: "That the Council of the Corporation of the City of Kitchener approves the following recommendations and Statement of Intent in respect to the Mayor's Race Relations Committee: A. RECOMMENDATIONS: That a formal Statement of Intent be endorsed by the members of the Mayor's Committee on Race Relations. 2. That each respective council adopt this Statement of Intent. That the Race Relations Statement of Intent be publicly signed and introduced to the public by the Mayors' Committee on Race Relations during the week surrounding the International Day for the Elimination of Racial Discrimination (April 2, 1992). That all municipalities will continue to develop and deliver cross-cultural awareness training sessions for all staff. Concurrently, a series of consultations will be held to discuss the delivery of municipal services and programs and to solicit feedback from the participant minority groups. That a contact person be appointed by each municipality to address cultural issues as they arise. These individuals will act as liaisons between the Mayors' Committee, member municipalities and the public. That the secretariat be responsible for liaising with the Race Relations Committees within the Region. That is, school boards, universities, police, private and community organizations. B. STATEMENT OFINTENT We, the Cities of Cambridge, Kitchener, Waterloo, the Regional Municipality of Waterloo and the Townships of North Dumfries, Wellesley, Wilmot and Woolwich, recognize the growing multi-cultural diversity which is taking shape within our boundaries. Such diversity enriches our communities. We encourage participation from all facets of our populations in the co-operative development and functioning of our communities. In the interests of fairness and equality, measures will continue to be taken to ensure that all have equal access to municipal job opportunities and services regardless of race, religion or ethno-cultural background. (cont'd) We are committed to the prevention of any form of racial, ethnic or religious discrimination or harassment as defined in Federal and Provincial Human Rights legislation, to the best of our ability. We require that all of our employees and members of Council perform their duties in accordance with this statement and assist in promoting this philosophy among the members of our municipalities."
