HERITAGE KITCHENER MINUTES
(LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE MINUTES)
OCTOBER 3, 1997
CITY OF KITCHENER
Heritage Kitchener (L.A.C.A.C.) met this date, under the Chairmanship of Councillor M. Wagner,
commencing at 12:05 p.m., with the following members present: Councillor J. Smola, Councillor B.
Vrbanovic, Councillor T. Galloway, Ms. S. Campbell, Ms. P. Costigan, Ms. J. Haalboom, Ms. E. Heinrichs,
Ms. C. Martindale, Ms. P. Wagner and Messrs. M. Badran, E. Bow, P. Bufe, E. Lucy and D. Pullen.

CHAIRMAN'S REMARKS
Councillor M. Wagner thanked Ms. S. Campbell for chairing the September meeting and
introduced Mr. Grimes, who is interested in being a member of Heritage Kitchener.
Mr. D. Pullen advised that the marketing plan for the Sandhills Christian Community has been
developed and the first flyer contains a write-up on the historic elements of the project.
2. MINUTES
On motion by Ms. P. Wagner,
it was resolved:
"That the minutes of the regular meeting of Heritage Kitchener, of September 5, 1997, as
mailed to the members, be accepted."
DELEGATION - PIONEER TOWER WEST TRAIL
Mr. L. Bensason introduced this matter, advising that, as a condition of subdivision approval, the
owner must dedicate part of Pioneer Tower Road and Lookout Lane as a Community Trail. The
sub-committee has presented a design and they are looking for Heritage Kitchener's endorsement.
Ms. J. Given, Senior Planner, advised that what will be presented today are not the final details
but the recommendation which will go to the consultant, who will then prepare the detail.
Mr. P. Brittan had displayed a landscaping plan for the closed portions of Lookout Lane and
Pioneer Tower Road. He advised that they started with the basic principles and are now
canvassing this Committee and the neighbourhood groups. They will then design the landscaping
plan, in concert with staff and come back to this Committee with a design and work out the finer
details. Mr. Brittan then referred to the plan and indicated which portions of these streets will be
converted to the Community Trail. He noted that this will continue to be a trail for the community,
an amenity for the adjacent subdivisions and a route for children to walk to school. He advised
that vehicular traffic will be diverted off Pioneer Tower Road, through the existing community, to
Deer Ridge Drive.
Mr. Brittan then displayed the concept plans for discussion, noting that there were four options for
design. He spoke of the ideas generated at the first meeting with respect to road/trail
intersections. He advised that they came up with a family of fence treatments for lots abutting the
trail and trail entrance featured gates. A drawing show the different fence styles was displayed.
Mr. Brittan stated that the meandering design for the proposed trail alignment provides
opportunities for enhanced landscape treatment. Mr. Brittan again stated that he is here to date to
present the main principles, in terms of concept. Ms. J. Given then explained various aspects of
the concept. She also advised that they want to name the trail and questioned whether this
Committee wanted to put forward a name.
Ms. S. Campbell questioned who will own the trail and Mr. Brittan advised that it would be owned
by the City. She then questioned who will install and maintain the trail. Mr. Brittan advised that
special arrangements have been made so that the developer will pay for the trail up-front in lieu of
development charges. The developer will front the entire cost of the trail

development for an off-set on the development charges. The City will maintain the trail, which will
affect the types of plantings. The landscaping chosen will be less formal so as to require less
maintenance.
Ms. Campbell then questioned the fences and Mr. Brittan advised that there will be an obligation
on the individual property owners, through the subdivision agreement and restrictive covenants.
Councillor T. Galloway questioned the trail surface and Ms. J. Given responded that they talked
about tar and chip. Councillor Galloway then questioned whether they considered a particular
fence style. Ms. J. Given responded that they did but felt they could get a better buy-in if people
were given a choice. Mr. Brittan noted that they have looked at other developments and some
diversity in fencing styles adds diversity and interest to the development; however, they do want
consistency in height and paint colour, being white.
Mr. M. Badran questioned the length of the trail, 1-1/2 kilometres long, then questioned safety on
the trail. Mr. Brittan advised that they did consider the safety. They did consider whether the trail
should be fenced. With the fence height, people can still see the trail and there will be gates in the
fencing. With respect to lighting, Mr. Brittan advised that there are pros and cons, it may be safer
but there would be increased maintenance costs. Ms. J. Given advised that the consultant has
been provided with the requirements of the Safe City Committee.
Councillor Jake Smola advised that he had concerns about painting the fences and that they may
not look good over time. He suggested that a cedar or pressure treated fence may be better. A
lengthy discussion then took place over the proposed fences, including style, colour, material,
height and whether to have fences at all.
Ms. J. Haalboom then questioned the alignment of the trail and whether it is the historic alignment.
Mr. L. Bensason advised that there is evidence available that states that the existing alignment is
consistent with the Huron Road.
Councillor M. Wagner then questioned whether the Committee wanted to suggest a name for the
trail. Ms. P. Costigan suggested naming it after one of the original landowners. Mr. P. Bufe
suggested calling it the Huron Trail.
APPLICATION FOR PRIVATE LEGISLATION - DEMOLITION CONTROL FOR HERITAGE
PROPERTIES
Mr. L. Bensason reminded the Committee of the process followed so far in applying to the
Province for private legislation to control demolition of heritage properties.
Ms. D. Arnold, Assistant City Solicitor, advised that there has been a modification to the definition
of what is designated, to include properties for which a Notice of Intention has been published, as
well as those designated by by-law. The application also deals with portions of the building as well
as the whole building.
Ms. P. Wagner questioned how the bill will be publicized and Ms. Arnold explain the requirements
of the Province to make this application.
Councillor M. Wagner thanked Ms. Arnold for all her work on preparing the application for this
private legislation.
On motion by Ms. S. Campbell,
it was resolved:
"That the Legal Department be directed to proceed with the application to the province for
private legislation authorizing the City of Kitchener to impose certain demolition controls on
properties designated under the Ontario Heritaqe Act."
5. HERITAGE CONSERVATION DISTRICT PLAN AND CAPITAL FORECAST

The Committee was in receipt of a copy of Planning and Development staff report PD 97~98, dated
October 2, 1997, recommending the establishment of a Capital Fund to assist with the
implementation of approved Heritage Conservation District Plans. The Committee was also in
receipt of a draft copy of the Department of Planning and Development, Administration Division,
1998-2007 Capital Forecast.
Mr. L. Bensason explained the Capital Forecast. He advised that, currently, there is no allocation
of monies to implement the policies in the Heritage Conservation District Plans, such as lighting,
interpretive centres, etc. Mr. Bensason then explained the 10 year Capital Forecast and the need
for money, every two years and what the funds are intended for.
On motion by Mr. P. Bufe,
it was resolved:
"That Heritage Kitchener recommends the approval of the heritage aspects of the
Department of Planning & Development draft capital forecast as presented to the
Committee on October 3, 1997."
On a motion by Ms. J. Haalboom,
it was resolved:
"That Heritage Kitchener recommends the approval, in principle, of establishing a bi-annual
capital fund, in the amount of $25,000.00, for the provision of thematic signage, lighting,
interpretive areas and other features as recommended in approved Heritage Conservation
District Plans; and further
That this request be referred for consideration as part of the 1998 Capital Budget."
6. 1997 CHO CONFERENCE
Ms. J. Haalboom gave a brief verbal report on the 1997 CHO Conference held in Midland, Ontario.
Ms. Haalboom advised that the conference had been hosted by three L.A.C.A.C.s: Victoria
Harbour, Midland and Penetang and the theme was change. She, Ms. P. Wagner and Ms. L.
Heinrichs advised of difference aspects and workshops at the conference.
7. UPDATES
Mr. L. Bensason distributed a drawing show the damage which had taken place to the foundation
at 257 Frederick Street. He advised that it is not going to survive the winter and the Chief Building
Official will order it to be demolished because it is in an unsafe condition.
Mr. L. Bensason distributed a short report on the property at 144-150 King Street West. He
advised that this building is uniquely constructed of a pre-fabricated concrete. Mr. Bensason
described the proposed exterior renovations and advised that he wanted the Committee to be
aware of what was happening.
Mr. Bensason advised that the former St. Jerome's High School is proposed to be severed into
four lots, with each of the designated structures to be located on separate lots. Mr. Bensason has
been advised by Ms. D. Arnold that the owners should contact the City with respect to the
designating by-law.
Concerning the elm tree which has been discussed at previous meetings, Mr. Bensason advised
that the property owner will dedicate land, one meter beyond the drip line of the canopy of the tree,
to the City. He advised that the City's Supervisor of Forestry has assessed the value of the tree at
$11,800. The tree is under a little bit of stress but it will survive. The tree is 125 years old.

Mr. Bensason then questioned whether any of the members had looked at the replacement
luminaries on Doon Village Road. Ms. J. Haalboom and Mr. E. Lucy both advised that they were
an improvement.
On a motion by Mr. E. Lucy,
it was resolved:
"That Heritage Kitchener has no concerns with the replacement luminaries on Doon Village
Road."
BUILDING EVALUATION
Ms. S. Barber, Heritage Kitchener's volunteer, reviewed the buildings contained in the Civic Centre
Property Evaluation Package D plus a few properties in Bridgeport. Ms. Barber displayed slides of
each property, which she had taken.
Each property was voted on and it was decided that the following properties be added to the
inventory:
