HERITAGE KITCHENER MINUTES
AUGUST 187 2000
CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Ms. P. Wagner, commencing at 12:00 noon with the
following members present: Ms. G. Engel, Ms. C. Martindale and Messrs. P. Bufe, J. Countryman, E.
Lucy and S. Sikes. Messrs. B. Scott and W. Stauch were in attendance for part of the meeting.
Officials Present: Councillor M. Yantzi, Ms. M. Dobbie, Mr. L. Bensason and Ms. D. Gilchrist.
1. ST. MARY'S AREA HERITAGE CONSERATION DISTRICT STUDY
Mr. David Cuming, Archaeological Services Inc. and Ms. Wendy Shearer, Wendy Shearer
Landscape Architec Ltd. present the St. Mary's Heritage Conservation District Study, Heritage
Assessment Report, dated Draft, March, 2000. The Committee members had been provided with
copies of this draft report.
Mr. Cuming advised that preparation for a heritage conservation district involves two stages; the
first being the preparation of a study and the second stage being the preparation of guidelines. He
displayed a map of the original study area noting that 340 properties are located within the
boundary. Mr. Cuming advised that the City's Municipal Plan provisions contained four criteria for
Heritage Conservation Districts. The study contains four sections addressing these criteria;
Historical Development, Landscape Attributes; Planning, Conservation, Community and
Development; and Heritage Conservation District Boundary Delineation. With the aid of
photographs and maps, Mr. Cuming presented three of the four sections of the plan and Ms.
Shearer presented the 'Landscape Attributes' of the study area.
Mr. B. Scott entered the meeting during the presentation.
With respect to the planning policies that affect the area, Mr. Cuming noting that the zoning is R-4
and R-5 which permit a maximum building height of 10.5 metres. He advised that they may be
requesting a reduction in the permitted height to maintain the character of the neighbourhood.
They may also be requesting a change in the properties zoned R-5 to R-4, as the R-5 zone is
more permissive.
Mr. Cuming then addressed the official plan policies noting that the proposed district satisfies three
of the four criteria. This area has a very compact development history and he recommended that
the district boundary be altered to include only the two original plans of subdivision developed by
Housing Enterprises of Canada and Wartime Housing Ltd., and not include the post 1948
development. Mr. Cuming stated that this area is at the forefront of wartime housing in Canada
and will probably be the first district of its kind in Canada. He asked the Committee for its
endorcement of the revised boundary for the plan.
Mr. L. Bensason advised that a public meeting will be held on Thursday September 7, 2000. at
7:00 p.m. in St. Stephen Lutheran Church. The purpose of the meeting is to determine whether
there is enough community support for the revised boundary and support to proceed with the plan.
He advised that he is looking for this Committee's endorcement of the study and the revised
boundary and direction to proceed with the plan.
Mr. Bufe questioned whether there were distinctive characteristics in housing styles at the
proposed boundary. Mr. Cuming stated that in terms of history there is a sound basis to change
the boundary and an exact location for the boundary. Ms. Wagner commented that the matter was
discussed at length at the steering committee meeting and some of the residents will want to know
why they are not going to be included.
Mr. Bufe then questioned the zoning of properties located outside the new boundary and Mr.
Cuming advised that they will still be able to recommend re-zoning for those properties proposed
to be excluded from the district.
Ms. Wagner then suggested that the Committee change the name of the district to draw attention
to the veteran's housing.
On motion by Mr. P. Bufe -
it was resolved:

'That Heritage Kitchener agrees in principle, with the recommendation contained in the St.
Mary's Heritage Conservation District Study - draft report - March, 2000.
It was agreed that further consideration of this matter would take place after the results of
the neighbourhood public meeting were know.'

Ms. Wendy Shearer and Messrs. K. Noonan, B. Bechtel, Y. Cyr and C. Tacker were in attendance
to represent the application of the Region, dated August 9, 2000, to alter the Waterloo County
Governor's House & Gaol. Attached to the application was Appendix 'A', listing the scope of work
to be undertake through this application. The Committee members had also been provided with
drawing prepared by The Venton Group Ltd., Architects, dated August 1,2000.
Mr. B. Bechtel displayed the submitted drawings with the aid of an overhead projector and
provided a detailed explanation of the work to be undertaken in this application. Mr. C. Tacker
gave a detailed explanation of the portion of the alterations necessary to accommodate handicap
access to the buildings.
The Committee then discussed aspects of the proposed alterations for which they required more
detail. Ms. P. Wagner suggested that the application could be approved in principle with a sub-
committee being established to work with the owner on specific details. The sub-committee could
then report back to Heritage Kitchener.
A discussion then took place concerning the removal of the bars from the gaol windows; as the
delegation advised that it had been requested by the judiciary to have the bars removed.
Councillor M. Yantzi stated that the bars in the windows are evidence that this was a gaol. Mr. B.
Scott agreed that the bars should be retained. It was also noted that the Committee was generally
in agreement with removing the mesh from the windows to allow for more light.
Mr. W. Stauch entered the meeting during the consideration of this application.
Ms. P. Wagner then asked for the Committee's position with respect to each of the 12 items on
Appendix 'A' to the application and each was considered individually.
On motion by Mr. B. Scott-
it was resolved:
"That, pursuant to Section 33 of the Ontario Heritage Act, Council approve part of the
application of the owners to alter the designated property municipal known as 73
Queen Street North (Waterloo County Governor's House and Gaol) shown as items 2,
3, 4, 6, 8, 10 and 11 on Appendix 'A' to their alteration application dated August 9,
2000; and further,
That the owner meet with a Sub-committee of Heritage Kitchener to review items 1, 5,
7, 9, 12 and the specific design for the doors in relation to item 8, in Appendix 'A' to the
alteration application, and the Sub-committee be requested to prepare final
recommendation for consideration by Heritage Kitchener at it September 8, 2000
meeting."
STAFF REPORT NO. BPS-00-100 - ADDITION OF LOWER DOON TO HERITAGE CONSERVAITON DISTRICT
- IDENTIFICATION OF AREA OF INTEREST
The Committee was in receipt of staff report BPS-00-100, dated 2000-08-02, recommending that
Lower Doon be added to the Heritage Conservation District Program and that a specified area,
shown on Appendix 'A' to the staff report, be identified as the area of interest for the potential
Heritage Conservation District.
Mr. Bensason introduced the report and provided some background noting the request for a
Heritage Conservation District in Lower Doon had been received by the Committee in March. A
sub-committee was established to determine whether the request had merit and whether there was

neighbourhood support. Subsequently, in July, a neighbourhood meeting was held to determine
the level of neighbourhood support. Mr. Bensason then displayed a map of the area indicating the
area of interest, and reviewed those properties located inside and outside the proposed area of
interest. He noted that the residents have asked staff to consider extending the boundary. Mr.
Bensason advised that there is a lot of neighbourhood support for a Heritage Conservation
District. He also advised that there is $25,000. in the budget for 2001 to initiate the next district
study and this Committee will have to determine which district should be commenced next year.
Several delegations appeared before the Committee, the first being the owner of 1824 Old Mill
Road, who gave a presentation in support of a Heritage Conservation District in Lower Doon. She
advised of her concerns over student housing in the area and the associated traffic problems. She
stated that the quality of life in the area is disappearing and that the R-3 zoning is not adequate
protection for the area. She asked Heritage Kitchener for its help to protect Lower Doon.
Jennifer and Ben McCann of 1747 Old Mill Road appeared as a delegation offering their support
for a Heritage Conservation District in Lower Doon, stating that a Heritage Conservation District is
the only way to safe guard the beauty of the area.
Ms. Pat Nippel of 560 Mill Park Drive provided copies of her presentation to the Committee, and
advised that she is in support of a Heritage Conservation District in Lower Doon. She requested
that the area of interest be expanded to include Mill Park Drive, noting that the area is
approximately 20 years old. Ms. Nippel then reviewed briefly her request, in 1994, for special
policies in the official plan for the Lower Doon area.
Concerning Ms. Nippel's request to expand the area of interest, Ms. Martindale suggested making
the area larger, and after studying the area, the consultants could always recommend reducing the
area. Mr. Bensason stated that everyone should be aware of exactly what a Heritage
Conservation District can achieve. He gave an example from the Upper Doon Heritage
Conservation District Plan where there are 'A' and 'B' listed properties. The plan does not have as
much strength when dealing with alterations to non-historic buildings.
Ms. Nippel again asked that her area be included in the district , noting the support from
neighbours on the street and their strong association with the historic Village of Lower Doon.
Ms. Louisa Stephenson of 2013 Old Mill Road appeared as a delegation in support of a Heritage
Conservation District in Lower Doon. She submitted a petition which was circulated to the
Committee.
Ms. Stephenson asked that Lower Doon be placed on the top of the list of proposed Heritage
Conservation Districts, stating that the area is in imminent danger of being distroyed. Ms.
Stephenson spoke of the significance of the Homer Watson House and advised that the residents
of Mill Park Drive contributed greatly to the purchase of the property beside the Homer Watson
House, which was donated to the City. She spoke passionately about the community and the
village and asked the Committee to place Lower Doon as the first priority for a Heritage
Conservation District.
In reviewing the area of interest, Ms. C. Martindale suggested that the two properties at the end of
Pinnacle Drive, owned by Vos and Freure, be included in the area of interest. Mr. Bensason
agreed that an argument could be made for including them in the district. He referred to the
policies in the official plan and asked the Committee to consider whether the area ultimately
agreed to meets the official plan policies. Mr. B. Scott and Mr. P. Bufe agreed with Ms. Martindale
that the Vos and Freure properties should be included in the area of interest.
Referring again to the policies in the official plan, and Ms. Nippel's request to have Mill Park Drive
included in the area of interest, Mr. Bensason suggested that the inclusion of Mill Park Drive in the
area of interest does not meet the official plan criteria.
The Committee then discussed adding this area to the list of potential Heritage Conservation
Districts, the proposed boundaries and priorities.
On motion by Mr. E. Lucy-
it was resolved:

"That Lower Doon be added to the list of potential Heritage Conservation Districts in
the City of Kitchener."
A sub-committee consisting of Councillor J. Haalboom, Ms. G. Engle, Ms. C. Martindale, Mr.
W. Stauch and Mr. E. Lucy was formed to review and report on the boundary for the area of
interest. It was agreed that a decision on the area of interest and the priority would be made
at a future meeting.
UP-DATES - HERITAGE CONSERVATION DISTRICT SIGNAGE FOR UPPER DOON
Mr. E. Lucy reported that a draft of the entrance signage for Upper Doon has been prepared. The
sign will be located on Doon Village Road; with the remainder of the signs being located on the
poles with the street signs.
5 MAURICE STREET - SHANTZ TERRACE - APPLICATION FOR REPAIR/MAINTENANCE
The Committee was in receipt of an alteration application, dated July 18, 2000, from Kitchener
Housing to repair the designated house at 5 Maurice Street (Shantz Terrace). Attached to the
application was an extract from a report from Peto MacCallum Ltd. giving their conclusions with
respect to damage to the building and the necessary repairs.
Mr. Bensason advised that he had attended at the property along with Messrs. Scott and Bufe, a
representative from Peto MacCallum and Ms. K. Kwiatkowski, General Manager of Kitchener
Housing.
The Committee briefly discussed the application and raised questioned concerning the proposed
ventilation.
On motion by Mr. B. Scott-
it was resolved:
"That, pursuant to Section 33 of the Ontario Heritage Act, Council approve the
application of the owner to alter the designated property municipally know as 5 Maurice
Street (Shantz Terrace) as outlined in their alteration application dated July 18, 2000,
subject to the owner supplying Heritage Kitchener with details on the ventilation."
175 DAVID STREET- VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT -APPLICATION TO DEMOLISH REAR ADDITION
Mr. L. Bensason distributed copies of an alteration application for 175 David Street, located in the
Victoria Park Area Conservation District. Slides of the subject property were shown and the
application was discussed. Mr. Bensason noted that the addition was delapatated and has
significant water damage. The owner wishes to demolish the addition and construct a deck on the
footings.
On motion by Mr. B. Scott-
it was resolved:
"That, pursuant to Section 43 of the Ontario Heritage Act, Council approve the application
of the owner to demolish the rear addition of the property municipally know as 175 David
Street (Victoria Park Area Heritage Conservation District) and replace it with a new deck, as
outlined in their alteration application dated August 11,2000."
HERITAGE SUMMER STUDENT - FINAL WORK REPORT
Ms. Michelle Dobbie, the Committee Heritage Summer Student, presented her work term summary
to the Committee. She advised of the work she had completed in the following areas;
a) Pioneer Tower West Heritage Conservation District Study and Plan
b) Lower Doon

8. UPPER DOON INTERPRETIVE CENTRE
Mr. Bensason displayed slides of the area of the old mill in Upper Doon, along with a concept plan
of the exposed foundation, community trail and use of red stone to show the outline of the old mill.
He noted that the area will also contain a wildflower garden and interpretative signage. There will
also be a bridge over the stream, which is required by the Community Services Department.
9. UP-DATES - HURON ROAD STAGE 3 & 4 ARCHAEOLOGICAL ASSESSMENT

Mr. Bensason noted that Huron Road is to be widened west of Strasburg Road. An archaeological
assessment was required to determine the significance under the right-of-way and portions of
stone foundations were uncovered. The City will now proceed to a Stage 3 & 4 archaeological
assessment, and Archaeologics Inc. has been awarded the tender. There is a possibility that the
discovered stone foundations are from the Village of New Aberdeen. Mr. Bensason expressed
concern over the impact the road widening may have on 571 Huron Road, which is the last
remaining house from New Aberdeen.
INFORMATION ITEMS
The Committee acknowledged receipt of the information items attached to the agenda. Ms. P.
Wagner asked that the information on the Heritage Sales Tax Rebate be included in the next
newsletter.
Ms. Wagner then commented on the Laurentian West district and that Heritage Kitchener is not
being included in the process of choosing street names.
