The Heritage Kitchener Committee met this date, commencing at 4:04 p.m.

DTS-04-148 - HERITAGE PERMIT APPLICATION HPA 2004-V-009
- 55 SCHNEIDER AVENUE
- NEW DETACHED GARAGE
The Committee was in receipt of Heritage Permit Application HPA 2004-V-009, dated
September 21,2004, requesting approval to build a one bay detached garage in the rear of 55
Schneider Avenue, in the Victoria Park Heritage Conservation District. Mr. Chris Lewis, a
contractor representing the owners advised that the new garage is being built to replace the
previous one which burned down. The new garage will be in the same style as the old, except
the new one will be green and white, and have vinyl siding rather than aluminum. Mr. Lewis
stated due to fiscal constraints applied by the owner's insurance company, it became
necessary to go with the lower costing vinyl siding.
On motion by Mr. Z. Janecki-
it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2204-V-009 (55 Schneider Avenue) be approved, to permit construction of a
detached one bay garage in the rear yard, as shown on the plans submitted with the
application."
Ms. D. Kuehl entered the meeting.

DTS-04-146 - HERITAGE PERMIT APPLICATION HPA 2004-V-007

PROPOSED 2 BAY DETACHED GARAGE
The Committee was in receipt of Heritage Permit Application HPA 2004-V-007, dated
September 21,2004 requesting approval to build a two bay detached garage in the rear yard of
52 Lorne Crescent, located within the St. Mary's Heritage Conservation District. Mr. Lance
Pascmore, owner, advised that the rear yard garage will front onto Delaware Avenue. His home
is on a double lot located at the corner of Lorne and Delaware; Delaware is a short street. The
garage will be set back 20 feet from the property line and hidden from view by his house and a
large hedge. The existing driveway will be reduced in length and the new driveway, from
Delaware Avenue, will be a single car driveway. Further, when he applied for the building
permit for his garage he was told a corner lot is permitted two driveways under the City's Zoning
By-law.
Members voiced concerns that approving this application could set a precedence for allowing
double bay garages in St. Mary's Heritage Conservation District, where one bay garages are
preferable. Staff advised that the size of the lot and its location on a short street (Delaware)
makes this a unique case. Mr. K. Kirby advised he spoke with the four neighbors surrounding
52 Lorne Crescent and all stated that they had no objection to a double bay garage being built
at this property.

On motion by Mr. K. Kirby -
it was resolved:
"That pursuant to the Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2004-V-007 (52 Lorne Crescent) be approved, to permit the construction of a
detached, 2 bay garage in the rear yard, as shown on the plans submitted with this
application."
DTS-04-147 - HERITAGE PERMIT APPLICATION HPA 2004-V-008
- 169 JOSEPH STREET
NEW VERANDA AND BALCONY
The Committee was in receipt of Heritage Permit Application HPA 2004-V-008, dated
September 14, 2004, requesting approval to build a new veranda and balcony at 169 Joseph
Street, located within the Victoria Park Heritage Conservation District. Mr. Andrew Karger,
owner, advised he is replacing the existing veranda and balcony, because they are over 30
years old. He displayed pictures of what is currently there and pictures of the spindles and
columns he plans to use. He advised he had previously received approval to build an addition
to the rear of his home. Responding to questions Mr. Karger informed, that the steps of the new
veranda will be wood, and he will use lattice and flower beds to conceal the sauna tubes and
concrete.
On motion by Ms. J. Armstrong -
it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2004-V-008 (169 Joseph Street) be approved, to permit the construction of a new
veranda with balcony, as shown on the plans submitted with the application."
Ms. D. Kuehl questioned the construction of the widow's peak as displayed in photographs
attached to Mr. Karger's Heritage Permit Application. Staff was directed to investigate whether
the construction of the widow's peak was included in Mr. Karger's previous Heritage Permit
Application, which approved the rear addition to 169 Joseph Street. Further, if it was not
included in his previous HPA staff is directed to find out who authorized its construction.
437 PIONEER TOWER ROAD - OWNERS' VISION FOR THE PROPERTY
Mr. Z. Janecki declared a pecuniary interest in this matter as he is employed by the current
owner of this property, and did not participate in discussion or voting with respect to this matter.
The Committee was provided with a written submission by John and Victoria Ariens, dated
October 5, 2004, regarding their vision for 437 Pioneer Tower Road. Mr. Ariens advised that at
a previous Heritage Kitchener meeting a draft Heritage Easement Agreement for this property
was approved in principle. Mr. and Mrs. Ariens presented their proposal to restore 437 Pioneer
Tower Road, once they become the owners of the property, as outlined in their written
submission, which consists of the following 6 components:
1. Security: construction of a five-foot high traditional farmer's fence on the property's
boundary line.
2. Privacy: planting shrubs and trees on the east and west sides of their property, where public
trails abut the property line.
3. Repair the Drive Shed.
4. Repair the house as per the existing Heritage Permit Application, and construction of a one-
story addition to the rear of the building.
5. Landscaping and grading project, to smooth the grading of the ridge at the south side of the
property.
6. Building an accessory building, such as a chicken coup.

Ms. A. Moore entered the meeting.
Mr. M. Stranz left the meeting.
Discussion ensued as to the appropriateness of the ideas. Concerns were raised regarding the
construction of the farmer's fence, planting of shrubs and trees and their effect on the scenic
view; which are parts of the property's heritage designation. Mr. Ariens advised that trees and
shrubs will be planted on the east and west sides of the property and would not obstruct the
southern scenic view, which is the protected view. Further, the farmer's fence will be see-
through, which would not obstruct the scenic view. The Committee directed Mr. and Mrs.
Ariens, that prior to the construction of the one story rear addition, they need to investigate as
to why the field stone foundation is part of the property's original heritage designation, and
ensure their plans for the foundation do not infringe upon the heritage designation. Mr. and Mrs.
Ariens invited the members of the Committee to participate in a future site visit.
5. DESIGNATED HERITAGE PROPERTY GRANT PROGRAM
The Committee was in receipt of a copy of a PowerPoint presentation drafted by Mr. L.
Bensason proposing revisions to the guidelines for the Designated Heritage Property Grant
Program. Mr. J. Bannon advised that guidance was needed with regard to the management of
applications and distribution of monies. The members were asked to review the presentation
and provide ideas and comments.
Ms. D. Kuehl suggested a minimum grant limit of $500 be set per grant submission to
encourage applicants to pursue their projects.
On motion by Ms. D. Kuehl-
it was resolved:
"That grant funds first be distributed to first priority applications on the basis of 50% of
eligible cost to a maximum of $3,000, and remaining funds to be distributed to second
priority applications on an equal percentage basis, save that no grant shall be less $500."
Ms. J. Armstrong proposed that any second priority applicants who receive a grant less than
50% of eligible expenses be allowed to defer their applications to the following year in hopes of
being awarded a greater sum. She suggested that by allowing this, applicants would be more
likely to eventually pursue their projects.
On motion by Ms. J. Armstrong -
it was resolved:
"That if the applicant of a second priority application is to receive a grant less than 50%
of eligible expenses to a maximum of $3,000, they will be given the option to have their
applications considered the following year."
Mr. K. Kirby put forward that the replacement of items having a limited life span, such as
asphalt shingles and driveways, not be eligible to receive this grant. Further, that the up-keep of
these items are part of the general maintenance of person's property.
On motion by Mr. K. Kirby -
it was resolved:
"That the following be added to "Maintenance" under the guidelines of the
Designated Heritage Property Grant Program: that replacement or repair of parts of
the properties that have a limited life span, such as asphalt shingles and driveways,
is not eligible under this Program."
Mr. Z. Janecki commented that with promotion of the Program there is potential for an increase
in the number of applications and suggested that the grant funding be increased from $15,000
to $20,000 to provide opportunity to fund as many projects as possible.

On motion by Mr. Z. Janecki -
it was resolved:
"That when discussing the 2005 Budget, Council give consideration to increasing the
funding for the Designated Heritage Property Grant Program from $15,000 per year to
$20,000 per year."
2005 MIKE WAGNER HERITAGE AWARDS
The Committee was in receipt of a memorandum from Mr. L. Bensason, dated September 23,
2004, and attached material relating to the 2005 Mike Wagner Heritage Awards. It is noted in
the memorandum that the supporting material is the same as what was produced for the 2004
awards, except the dates have been updated. Further, Staff is proposing November 26, 2004
as the deadline for nominations. The City's Marketing and Communications Division may still be
able to accommodate minor changes and modifications to the materials prior to printing and
distribution.
Councillor M. Galloway advised of the City's intent to alternate celebrating the Mike Wagner
Heritage Awards with the Urban Design Awards, such that the Heritage Awards would be
presented on odd numbered years and the Urban Designs Awards on even numbered years.
Members were asked to provide comments about this proposed change.
Discussion ensued as to the appropriateness of the proposed change to the awards schedule.
Members agreed that the change would allow for a more detailed search and selection of
candidates for both awards. Staff was directed to write a letter on behalf of the Committee to
Ms. Wagner to inform her of the change to the award schedule.
COMMITTEE APPOINTMENTS - 2005/2006
The Committee was in receipt this date of application forms for appointments to the City's
Advisory Committees and Boards for 2005/2006. Members were advised that the appointment
length is now 2 years and the deadline for submitting applications is Friday, October 22, 2004.
DOORS OPEN WATERLOO REGION
Mr. J. Bannon requested a volunteer from the Committee to attend the next Doors Open
Waterloo Region meeting and Ms. J. Armstrong volunteered to attend. Members discussed the
success of the Doors Open Waterloo Region Program; however, concerns were raised over
availability of parking at some of the sites, and the diligence of the City's By-law Enforcement
Officers in issuing tickets.
