Commencement The Heritage Kitchener Committee held an electronic meeting this date commencing at 4:02 p.m. 2. Discussion Items 2.1 Heritage Permit Application HPA-2022-V-015 - 22 Weber Street West - Construction of a New 19-Storey Residential Building, DSD-2022-321 and Addendum Report DSD-2022-379 The Committee considered Development Services Department report DSD-2022- 321, dated June 29, 2022, recommending refusal of Heritage Permit Application (HPA) HPA-2022-V-015 to construct a new 19-storey residential building on the 1 property municipally addressed as 22 Weber Street West located within the Civic Centre Neighbourhood Heritage Conservation District (CCNHCD) and designated under Part V of the Ontario Heritage Act. The Committee was also in receipt of an addendum report, Development Services Department report DSD- 2022-379, dated July 21, 2022 related to the subject HPA. In addition, the Committee was in receipt of written submissions from R. Cameron, N. Baarda, and M. Rowell, Architectural Conservancy Ontario North Waterloo Region. It was noted that the property is subject to a Planning Application currently under appeal at the Ontario Land Tribunal (OLT). The Committee was advised staff can only comment on details of the Staff Report as it is anticipated that staff due to the appeal at the OLT will provide evidence at that hearing. J. Meader and D. Currie were in attendance in opposition of the staff recommendation and to respond to questions from the Committee. In response to questions, D. Currie noted that the Heritage Impact Assessment (HIA) had not been amended to date as the planning application is under appeal. It was noted one of the reasons for recommending refusal of the Heritage Permit Application, was due to a formal site plan application not yet being received. Additionally, staff is of the opinion that the proposed development does not comply with the Heritage District Plan. It was noted any recommendation arising from this matter would be considered at Council on August 22, 2022. On motion by Councillor J. Gazzola it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2022-V-015 be refused to construct a new 19-storey residential building on the property municipally addressed as 22 Weber Street West, in accordance with the supporting information submitted with the application, as outlined in Development Services Department report DSD-2022-321, and Addendum Report DSD-2022-379." Carried M. Asling left the meeting at this time. 2.2 Heritage Permit Application HPA-2022-IV-016 - 73 Queen Street North - Ground Floor Front and Side Porch Repairs, DSD-2022-322 The Committee considered Development Services Department report DSD-2022- 322, dated June 29, 2022, recommending approval of Heritage Permit 2 Application (HPA) HPA-2022-IV-016 to permit repairs to the ground-level porch on the property municipally addressed as 73 Queen Street North also known as the Governor's House, designated under Part IV of the Ontario Heritage Act by way of designating by-law 81-105, subject to conditions. D. Choudhry and G. Stevenson were in attendance to respond to questions from the Committee. D. Westman was in attendance in support of the staff recommendation and to respond to questions from the Committee. In response to questions, D. Westman spoke about the use of wood fir to complete the repairs noting it is the most reliable and readily available material. On motion by Councillor J. Gazzola it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2022-IV-016 be approved, as outlined in Development Services Department report DSD-2022-322, to permit repairs to the ground-level porch on the property municipally addressed as 73 Queen Street North, in accordance with the supporting information submitted with the application subject to the following conditions: 1. That the applicant provides a sample of the mortar to be used for the repointing the brick skirt under the front porch for related heritage clearance to Heritage Planning staff prior to its application; and, 2. That the applicant provides a sample of the paint colour to be applied on the front porch vents, wooden deck boards, and the front porch columns for related heritage clearance to Heritage Planning staff prior to its application." Carried unanimously 2.3 Heritage Permit Application HPA-2022-IV-017 - 38 Shirk Place - Construction of a New Detached Garage, DSD-2022-332 The Committee considered Development Services Department report DSD-2022- 332, dated July 12, 2022, recommending approval of Heritage Permit Application (HPA) HPA-2022-IV-017 to permit the construction of a new detached garage in the rear yard of the property municipally addressed as 38 Shirk Place, subject to 3 one condition. The building has been designated under Part IV of the Ontario Heritage Act through designating By-law No. 84-28. J. Vieira and G. Stevenson were in attendance to respond to questions from the Committee. E. Schuurmans was in attendance to respond to questions from the Committee. In response to questions, E. Schuurmans noted that the proposed detached garage would not have a similar stone foundation as the main property due to the costs of material and labour. On motion by P. Ciuciura it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2022-IV-017 to permit the construction of a new detached garage in the rear yard of the property municipally addressed as 38 Shirk Place, be approved, as outlined in Development Services Department report DSD-2022-332, in accordance with the supplementary information submitted with the application and subject to the following condition: 1. That final building permit drawings be reviewed, and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit." Carried unanimously 2.4 Heritage Permit Application HPA-2022-V-019 - 49 Heins Avenue - Construction of Rear Yard Addition, DSD-2022-333 The Committee considered Development Services Department report DSD-2022- 333, dated July 12, 2022, recommending approval of Heritage Permit Application (HPA) HPA-2022-V-019 to construct a rear yard addition on the property municipally addressed as 49 Heins Avenue located within the Victoria Park Area Heritage Conservation District (VPAHCD) and designated under Part V of the Ontario Heritage Act. J. Vieira and G. Stevenson were in attendance to respond to questions from the Committee. In response to questions from the Committee, J. Vieira noted that the proposed rear yard addition does not deter from the existing character of the property or street as it is a one-storey addition with a visible fence. 4 P. Meier was in attendance in support of the staff recommendation and to respond to questions from the Committee. On motion by Councillor D. Chapman it was resolved: "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2022-V-019 to permit: 1. The demolition of an existing rear yard addition not original to the house; 2. The construction of a rear one-storey addition; and, 3. The replacement of windows and doors with new windows on the rear of the existing dwelling on the property municipally addressed as 49 Heins Avenue, be approved, as outlined in Development Services Department report DSD- 2022-333, in accordance with the supplementary information submitted with the application and subject to the following condition: i. That final building permit drawings be reviewed, and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit." Carried unanimously 2.5 Heritage Permit Application HPA-2022-IV-018, 137-147 King Street East - Repair and Restoration to Cornice and Brick Parapet, DSD-2022-334 The Committee considered Development Services Department report DSD-2022- 334, dated July 12, 2022, recommending approval of Heritage Permit Application (HPA) HPA-2022-IV-018 to permit the repair and restoration of the cornice and brick parapet of the property municipally addressed as 137-147 King Street East, subject to one condition. The building has been designated under Part IV of the Ontario Heritage Act through designating By-law No. 2012-025. J. Vieira and G. Stevenson were in attendance to respond to questions from the Committee. M. Shantz was in attendance in support of the staff recommendation and to respond to questions from the Committee. In response to questions, M. Shantz 5 noted that scuppers will be reinstated along with a fiber glass replication of metals on the roof as fiber glass is more durable and lighter in weight. In response to further questions, M. Shantz explained that due to cost and availability of craftsmanship, the use of metal is prohibitive. On motion by I. Bodendorfer it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2022-IV-018 to permit the repair and restoration of the cornice and brick parapet of the property municipally addressed as 137- 147 King Street East, be approved, as outlined in Development Services Department report DSD-2022-334, in accordance with the supplementary information submitted with the application and subject to the following condition: 1. That final building permit drawings be reviewed, and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit." Carried unanimously 2.6 Sub-Committee Updates The Chair invited the Heritage Kitchener Sub-Committees to provide updates on their recent meetings and efforts. Decolonizing the Heritage Process Members: R. Schwarz, V. Mance, M. Asling The Committee heard an update from the Decolonizing the Heritage Process Sub-committee, noting that a meeting was held in June with the City's Equity lead along with Heritage planners. It was noted that discussions centered on the appointment of more diverse representatives on the Heritage Kitchener Committee. Designation and the Municipal Heritage Register Members: P. Ciuciura, D. Vongphakdy, M. Asling, S. Hossack, Councillor Chapman The Committee heard an update from the Designation and the Municipal Heritage Register Sub-committee, noting that a meeting was held in June where the Committee proceeded with the review of buildings on the Heritage List that 6 are non-designated properties. It was noted that about twenty percent of the buildings on the list have been reviewed to date. The Effects of Heritage Designation on Affordability Members: M. Asling There were no updates as the Committee members were absent. Promoting Cultural Heritage Members: J. Haalboom, I. Bodendorfer, S. Hossack, Councillor Michaud The Committee heard an update from the Promoting Cultural Heritage Sub- committee, noting that a garden tour was held on July 12, 2022. Visitors from Garden Kitchener were invited to tour and learn about the Governor's House and GAOL, Queen Street North. It was noted that a key discussion centered on the maintenance of green space for the conservation of the environment. Lastly, it was noted that a Walking Tour of Lower and Upper Doon is taking place in September. 2.7 Status Updates - Heritage Best Practices Update and 2022 Priorities, Heritage Impact Assessment Follow-ups Staff confirmed there were no status updates. 3.
