1. Commencement
The Community and Infrastructure Services Committee held an electronic
meeting this date, commencing at 3:04 p.m.
2. Consent Items
Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought
forward by Councillor J. Gazzola to discuss Consent item 2.2, 2.4 and 2.5 listed
on the agenda, which was voted on and was Carried.
2.1 Parking Prohibition on Chapel Street between Lydia Street and Merner
Avenue, DSD-2022-326
The Committee considered Development Services Department report DSD-2022-
326, dated July 15, 2022 recommending approval of an on-street parking
prohibition on the west side of Chapel Street from Lydia Street to Merner
Avenue.
On motion by Councillor D. Schnider
it was resolved:
"That the Uniform Traffic and Parking By-law be amended for an on-street
parking prohibition on the west (even-numbered) side of Chapel Street
from Lydia Street to Merner Avenue, as outlined in Development Services
Department report DSD-2022-326."

2.2 Proposed All-Way Stop Control - Mill Street at Spadina Road East, DSD-
2022-359
The Committee considered Development Services Department report DSD-2022-
359, dated July 14, 2022 recommending approval of the installation of an all-way
stop control at the intersection of Mill Street and Spadina Road East. B. Cronkite,
Director, Transportation Services, was in attendance to respond to questions
from the Committee.
On motion by Councillor D. Schnider
it was resolved:
"That Uniform Traffic By-Law 2019-113 be amended for the installation of
an All-Way Stop control at the intersection of Mill Street and Spadina

Road East, as outlined in Development Services Department report DSD-
2022-359."

2.3 Guelph Street - Parking Prohibitions, DSD-2022-369
The Committee considered Development Services Department report DSD-2022-
369, dated July 14, 2022 recommending approval of parking prohibitions on
Guelph Street.
On motion by Councillor D. Schnider
it was resolved:
"That on-street parking be prohibited on the north (even-numbered) side
of Guelph Street from Birch Avenue to a point 33 metres east thereof;
and,
That on-street parking be prohibited on the south (odd-numbered) side of
Guelph Street from Birch Avenue to a point 40 metres east thereof, as
outlined in Development Services Department report DSD-2022-369; and
further,
That the Uniform Traffic By-law be amended accordingly."

2.4 Private Street Naming - 630 and 690 Benninger Drive - Activa Holding Inc.,
DSD-2022-347
The Committee considered Development Services Department report DSD-2022-
347, dated July 6, 2022 regarding the naming of private streets within the
residential development located at 630 and 690 Benninger Drive. G. Stevenson,
Manager, Development, was in attendance to respond to questions from the
Committee.
On motion by Councillor D. Schnider
it was resolved:
"That the City of Kitchener acknowledge that Activa Holding Inc. intends to
name private streets: 'Urbane Boulevard', 'Avid Drive', 'Ardor Avenue',
'Serene Way', 'Reverie Way', 'Musing Street', 'Moxie Lane', and 'Mettle
Way' within a multiple residential development located at 630 and 690

Benninger Drive, as outlined in Development Services Department report
DSD-2022-347; and further,
required advertising, preparation, and registration of the necessary By-law
for the naming of 'Urbane Boulevard', 'Avid Drive', 'Ardor Avenue', 'Serene
Way', 'Reverie Way', 'Musing Street', 'Moxie Lane', and 'Mettle Way'."

2.5 1388 Highland Road West - Lifting of Holding Provisions, DSD-2022-360
The Committee considered Development Services Department DSD-2022-360,
dated July 20, 2022 recommending approval of Zoning By-law Application
ZBA/014/H/NG lifting of holding provisions.
N. Goss, Manager, Policy and Research, Planning, was in attendance to respond
to questions from the Committee.
On motion by Councillor D. Schnider
it was resolved:
"That Zoning By-law Amendment application ZBA22/014/H/NG (1388
Highland Road West) by the Regional Municipality of Waterloo requesting
to amend Zoning By-law 85-1 to remove Holding Provision 7HSR be
approved in the form shown in the Proposed By-law and Map No. 1
attached to Development Services Department report DSD-2022-360 as
Attachment A; and,
That Zoning By-law Amendment ZBA22/014/H/NG (1388 Highland Road
West) by the Regional Municipality of Waterloo requesting to amend
Zoning By-law 2019-051 to remove Holding Provision 27H be approved in
the form shown in the Proposed By-law, and Map No. 1 attached to
Report DSD-2022-360 as Attachment B; and,
That the Proposed By-law to amend Zoning By-law 2019-051, as
amended shall have no force and effect against the subject lands until the
date that all appeals relating to By-law 2022-040 (Comprehensive Review
of the Zoning By-law (CRoZBy) Stage 2b Applying New Residential
Zones on Properties) in relation to the subject lands have been withdrawn
or decided and any applicable appeal periods have expired; and further,

That in accordance with Planning Act Section 45 (1.3 and 1.4) that
applications for minor variances shall be permitted for lands subject to
Zoning By-law Amendment application ZBA22/014/H/NG."

2.6 607-641 King Street West, Station Park Phase II - Lifting of Holding
Provision 82H Centre Ice LP, DSD-2022-363
The Committee considered Development Services Department report DSD-2022-
363, dated July 18, 2022 recommending approval of Zone Change Application
ZBA22/013/K/BB for lands located at 607-641 King Street West, for the purpose
of removing Holding Provision 82H Centre Ice LP.
On motion by Councillor D. Schnider
it was resolved:
"That Zoning By-law Amendment Application ZBA22/013/K/BB for Centre
Ice LP for the purpose of removing Holding Provision 82H from the lands
specified in the attached Map No.1, in the form shown in the 'Proposed
By-law' attached to the Development Services Department report DSD-
2022-363 as Appendix A, be approved; and further,
That in accordance with Planning Act Section 45 (1.3 and 1.4) that
applications for minor variances shall be permitted for lands subject to
Zoning By-law Amendment application ZBA22/013/K/BB."

2.7 Noise Exemption - Yeti Music Event - 14 Eby Street North, CSD-2022-361
The Committee considered Community Services Department report CSD-2022-
361, dated July 15, 2022 recommending approval of a noise exemption for a live
concert being held at The Yeti Coffee Shop on August 13, 2022.
It was that any recommendation arising from this matter would be considered at
a Special Council meeting later this date.
On motion by Councillor D. Schnider
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener
Municipal Code be granted to The Yeti Coffee Shop for a live concert

event being held at 14 Eby St. N. on August 13, 2022, as outlined in
Community Services Department report CSD-2022-361."

2.8 Noise Exemption - K-W Oktoberfest Inc - Various Locations - September 23
through October 15, 2022, CSD-2022-364
The Committee considered Community Services Department report CSD-2022-
364, dated July 19, 2022 recommending approval of a noise exemption for K-W
Oktoberfest being held at various locations from September 23rd through
October 15, 2022.
On motion by Councillor D. Schnider
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener
Municipal Code be granted to K-W Oktoberfest Inc. for a series of events
being held at various clubs between September 23 through October 15,
2022, as outlined in the letter from K-W Oktoberfest Inc., dated June 16,
2022, attached to Community Services Department report CSD-2022-
364."

2.9 Noise Exemption - Holy Trinity Serbian Church - 700 Fischer Hallman Road
- September 4, 2022, CSD-2022-388
The Committee considered Community Services Department report CSD-2022-
388, dated July 22, 2022 recommending approval of a noise exemption to Holy
Trinity Serbian Church located at 700 Fischer Hallman Road to be held on
September 4, 2022 between the hours of 11 a.m. and 10 p.m.
On motion by Councillor D. Schnider
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener
Municipal Code be granted to the Holy Trinity Serbian Orthodox Church at
700 Fischer Hallman Road, for their annual Bull Roast and BBQ to be held
on Sept 4, 2022, between the hours of 11 a.m. and 10 p.m., as outlined in
Community Services Department report CSD-2022-388."

2.10 Noise Exemption - KWFamous - Art and Music Festival - 20 Hurst Avenue -
September 3, 2022, CSD-2022-389
The Committee considered Community Services Department report CSD-2022-
389, dated July 28, 2022 recommending approval of a noise exemption to
KWFamous for an Art and Music Festival being held at 20 Hurst Avenue on
September 3, 2022 between the hours of 6 p.m. and 10:30 p.m.
On motion by Councillor D. Schnider
it was resolved:
"That an exemption to Chapter 450 (Noise) of the City of Kitchener
Municipal Code be granted to KWFamous for an Art and Music Festival
being held at 20 Hurst on September 3, 2022, between the hours of 6 p.m.
and 10:30 p.m., as outlined in Community Services Department report
CSD-2022-389."

3. Discussion Items
3.1 Class Environmental Assessment (EA) for Existing Otterbein Sanitary
Sewer Pumping Station, DSD-2022-358
The Committee considered Development Services Department report DSD-2022-
358, dated July 14, 2022 regarding receipt of the Otterbein Sanitary Sewer
Pumping Station Environmental Study Report (ESR) and filing of the report with
the Ministry of the Environment for the mandatory thirty day review period. T.
Jacobs, Project Manager, Engineering, was in attendance to respond to
questions from the Committee.
C. Gouett, AECOM Canada Limited presented an overview of the Environmental
Assessment indicating that upgrades and expansion to the Otterbein Sanitary
Sewer Pumping Station are required to address the age and expected lifespan of
the Station as well as to meet current standards. In response to questions from
the Committee, Gouett noted that some parcels of land adjacent to the pumping
station are not suitable for the station expansion due to insufficient capacity or
pre-existing allocation for future developments.
Councillor M. Johnston entered the meeting at this time.

On motion by Councillor P. Singh
it was resolved:
"That the Otterbein Sanitary Sewer Pumping Station Environmental Study
Report (ESR) prepared by AECOM Canada Ltd., dated July 2022, which
recommends Option 2 as the preferred solution, be received, as outlined
in Development Services Department report DSD-2022-358; and further,
That Otterbein Sanitary Sewer Pumping Station Environmental Study
Report (ESR) be filed with the Ministry of the Environment for the
mandatory thirty (30) days review period as required by the Environmental
Assessment (EA) Act."

4. Waive Notice
On motion by Councillor K. Galloway-Sealock
it was resolved:

5. Parking Prohibition - Plains Road
Councillor K. Galloway-Sealock brought forward a motion to approve a parking
prohibition on Plains Road noting that the matter addresses road safety concerns
raised by the religious institution.
B. Cronkite was in attendance to respond to questions from the Committee,
advising staff have no concerns with the motion as proposed.
On motion by Councillor K. Galloway-Sealock
it was resolved:
"That on-street parking be prohibited on the west (even-numbered) side of
Plains Road from Fischer-Hallman Road to a point about 180 metres east
thereof."
