Commencement The Planning and Strategic Initiatives Committee held an electronic meeting this date, commencing at 7:39 p.m. 2. Consent Items 1 2.1 Climate Change and Environment Committee Updated Terms of Reference (Policy GOV-BOV-100), DSD-2022-367 The Committee considered Development Services Department report DSD-2022- 367 dated July 11, 2022, recommending the name of the Environmental Committee be changed to 'Climate Change and Environment Committee'. On motion by Councillor K. Galloway-Sealock it was resolved: "That the name of the Environmental Committee be changed to Climate Change and Environment Committee; and, That Climate Change and Environment Committee - Terms of Reference (Policy GOV-BOV-100) attached to report DSD-2002-367 be approved." Carried 3. Discussion Items 3.1 None. 4. Public Hearing Matters under the Planning Act 4.1 Official Plan Amendment OP18/005/B/GS - Zoning By-law Amendment ZBA18/006/B/GS - Draft Plan of Subdivision 30T-18201 - 1801-1873 Bleams Road - Kitchener Green Development Inc., DSD-2022-366 Councillor K. Galloway-Sealock declared a conflict on this item. (declared a conflict with regards to the report DSD-2022-366, dated July 6, 2022 related to the property municipally addressed as 1801-1873 Bleams Road, due to close proximity of the property to personal residential address.) The Committee considered Development Services Department report DSD-2022- 366, dated July 6, 2022, recommending draft approval to Plan of Subdivision Application 30T-18201; adoption of Official Plan Amendment Application OP18/005/B/GS; and, approval of Zoning By-law Amendment Application ZBA18/006/B/GS, for Kitchener Green 2 Developments Inc., Kitchener Green Development Inc., 2079546 Ontario Limited, and Kitchener Green 3 Developments Inc., for the property municipally addressed 1801-1873 Bleams Road. The Committee was in receipt of a written submission from P. Britton, MHBC Planning. G. Stevenson provided a brief presentation and responded to questions from the Committee. 2 P. Lowes, Mattamy Homes and the Kitchener Green Development Group of Properties, addressed the Committee in support of the Staff report DSD-2022- 366. On motion by Mayor B. Vrbanovic it was resolved: "That the City of Kitchener, pursuant to Section 51 (31) of the Planning Act R.S.O. 1990, Chapter P 13 as amended, and delegation by-law 2002- 64, grant draft approval to Plan of Subdivision Application 30T-18201 in the City of Kitchener, for Kitchener Green 2 Developments Inc., Kitchener Green Development Inc., 2079546 Ontario Limited, & Kitchener Green 3 Developments Inc., subject to the conditions attached to Report DSD- 2022- That Official Plan Amendment Application OP18/005/B/GS for Kitchener Green 2 Developments Inc., Kitchener Green Development Inc., 2079546 Ontario Limited, & Kitchener Green 3 Developments Inc., for the property municipally addressed as 1801-1873 Bleams Road, requesting a change to the Land Use Designation on the parcels of land specified and Plan Amendment attached to Report DSD-2022- accordingly forwarded to the Region of Waterloo for approval; and, That Zoning By-law Amendment Application ZBA18/006/B/GS to amend Zoning By-laws 85-1 and 2019-051 for Kitchener Green 2 Developments Inc., Kitchener Green Development Inc., 2079546 Ontario Limited, & Kitchener Green 3 Developments Inc. be approved in the form shown in th--2022-366 That in accordance with Planning Act Regulation 45 (1.3 & 1.4) that applications for minor variances shall be permitted for lands subject to this Zoning By-law Amendment ZBA18/006/B/GS." Carried 4.2 Official Plan Amendment OPA21/013/C/KA - Zoning By-law Amendment ZBA21/022/C/KA - 95-101 Cedar Street South - St. Pola Group Inc., DSD- 2022-356 The Committee considered Development Services Department report DSD-2022- 356 dated July 15, 2022, recommending adoption of Official Plan Amendment 3 Application OPA21/013/C/KA; approval of Zoning By-law Amendment Application ZBA21/022/C/KA; and the approval of applications for minor variances for lands subject to Zoning By-law Amendment Application ZBA21/022/C/KA, for St. Pola Group Inc, for the property municipally addressed 96-101 Cedar Street South. K. Anderl, Senior Planner addressed the Committee recommending that the Official Plan be adopted and the Zoning By-Law amendment be approved, and was available to answer questions. G. Stevenson, Manager of Development Review was also in attendance to respond to questions from the Committee. K. Wills and T. Hawkins, MHBC Planning addressed the Committee in support of the Staff report DSD-2022-356 and responded to questions from the Committee. On motion by Councillor M. Johnston it was resolved: "That Official Plan Amendment Application OPA21/013/C/KA for St. Pola Group Inc., for the property municipally addressed as 96-101 Cedar Street South, requesting a change to the Land Use Designation on the parcel of shown in the Official Plan Amendment attached to Report DSD-2022-356 approval; and, That Zoning By-law Amendment Application ZBA21/022/C/KA for St. Pola -and -2022- further, That in accordance with Planning Act Regulation 45 (1.3 & 1.4) that applications for minor variances shall be permitted for lands subject to this Zoning By-law Amendment Application ZBA21/022/C/KA." Carried 4.3 Zoning By-law Amendment ZBA20/017/W/ES - 42 Windom Road - Windom KW Inc. DSD-2022-348 The Committee considered Development Services Department report DSD-2022- 348, dated July 6, 2022, recommending approval of Zoning By-law Amendment Application ZBA20/017/W/ES, for Windom KW Inc., for the property municipally addressed 42 Windom Road. 4 E. Schneider, Senior Planner provided a brief presentation recommending the Committee approve the Zoning By-Law Amendment Application outlined. E. Schneider was available for questions from the Committee. D. Galbraith, IBI Group addressed council in support of the Staff report DSD- 2022-348 and recommendations provided, stating that the Zoning By-Law Application conforms to the Growth Plan, Regional Official Plan and City of Kitchener Official Plan. D. Galbraith was available to respond to questions from the Committee. S. Jakobsen, Riverside Millwork Group, addressed the Committee on the behalf of the neighboring property municipally addressed 48 Windom Road expressing support for the proposed development, but requested Council consider refusing the requested parking ratio reduction. In response to questions from the Committee, S. Jakobsen stated their concern with the current parking conditions on this road, and noted their previous conversations with Planning Staff regarding the insufficient parking, stating the proposed parking reduction could create further parking congestion. On motion by Councillor P. Singh it was resolved: "That Zoning By-law Amendment Application ZBA20/017/W/ES requesting to amend Zoning By-law 85-1, for Windom KW Inc. for the property municipally addressed 42 Windom Road, be approved in the form shown - DSD-2022- That Zoning By-law Amendment Application ZBA20/017/W/ES requesting to amend Zoning By-law 2019-051, for Windom KW Inc be approved in - attached to Report DSD-2022- That the Proposed By-law to amend Zoning By-law 2019-051, as amended shall have no force and effect against the subject lands until the date that all appeals relating to By-law 2022-040 (Comprehensive Review of the Zoning By-law (CRoZBy) Stage 2b Applying New Residential Zones on Properties) in relation to the subject lands have been withdrawn or decided and any applicable appeal periods have expired; and further, That in accordance with Planning Act Section 45 (1.3 & 1.4), applications for minor variances shall be permitted for lands subject to Zoning By-law Amendment Application ZBA20/017/W/ES." 5 Carried 5.
