1. COMMENCEMENT

2. MINUTES FOR APPROVAL
On motion by Councillor P. Singh the minutes of the regular meeting held June
20, 2022 and special meetings held May 30, June 8, 13, 20, July 18 and August
8, 2022 as mailed to the Mayor and Councillors, were accepted.

6.1 Giant Hogweed Mitigation Project
6.1.a John Kemp
John Kemp provided a delegation to Council outlining the impacts of Giant
Hogweed, confirmed reports in the City and surrounding areas, and how to
implement an Integrated Pest Management Plan (IPM) to raise awareness of the
plant, and how to mitigate by removal of the plant where it's present. J. Kemp
noted deterrents and impediments to removal and eradication of the plant
including staff resources, expertise, budget, and liability concerns. The
presentation requested leadership and immediate action.
Councillor P. Singh left the meeting.

In response to questions, Denise McGoldrick, General Manager, Infrastructure
Services advised staff do remove giant hogweed when it is reported, noting the
coordinated efforts to would be required by neighbouring municipalities to further
address the issue. D. McGoldrick further advised staff have noted the comments
related to education related to the species and would review them further.
6.2 Heritage Permit Application HPA-2022-V-015 - 22 Weber Street West -

Weber Street West
Council considered Heritage Permit Application HPA-2022-V-015 - 22 Weber
Street West - Construction of a New 19 -Storey Residential Building, DSD -2022-
321 and Addendum Report DSD -2022-379, listed on the as item 7.2.a. of the
agenda this date. In addition Council was in receipt of written submissions from
Roy Cameron, Architectural Conservancy of Ontario, North Waterloo Region
Branch, Sue Savor, Gwen Wheeler, Kathryn Forler, Neil Baarda, Sally Gunz,
Peter Elgin, Neill Jensen, John Ryrie, Hal Jeager (Petition), Michael Barton,
Aaron Scriver and Yvonne Fernandes. G. Steven, Interim Director, Planning, was
in attendance to respond to questions from Council.
Gail Pool, Architectural Conservancy of Ontario, North Waterloo Region Branch,
Hal Jeager, Robert Martindale, Martindale Planning Services, Michael Barton,
Roy Cameron, Neil Baarda, Kae Elgie, Yvonne Fernandes and John Ryrie
addressed Council in support of the staff to refuse the application as its
incompatible with planning legislation.
Councilor J. Gazzola brought forward a motion to approve the recommendation
outlined in Development Services Department report DSD -2022-321 to refuse
Heritage Permit Application HPA-2022-V-015, which was seconded by Councillor
D. Chapman.
An amendment to the motion was moved by Councillor D. Chapman, seconded
by Councillor J. Gazzola to include an additional clause in the recommendation
to further clarify Council's opinion that the heritage permit application does not
meet the intent of the Civic Centre Conservation District Plan, which was voted
on and LOST on a tie vote, with Councillors J. Gazzola, D. Chapman, S. Marsh,
K. Galloway-Sealock and C. Michaud voting in favour; and, Councillors P. Singh,
B. loannidis, M. Johnston, D. Schnider and S. Davey voting in opposition.

Application HPA-2022-V-015 be refused to construct a new 19 -storey

DSD -2022-321, and Addendum Report DSD -2022-379."

6.3.a Various Delegations - Places and Spaces - Park Strategic Plan and Park
Dedication Update
Council considered Infrastructure Services Department report INS -2022-373,
which was a follow up report to Infrastructure Services Department Report INS -
2022 -224 related to the Places and Spaces - Park Strategic Plan and Park

Dedication Update, which was initially considered by Council on June 20, 2022
and deferred to this date. In addition Council was in receipt of written
submissions from Gwen Wheeler, Carol Burrows, Hal Jaeger, Dawn Parker,
Shirley Irish, Peggy Nickels, Chris Gosselin, Sheldon Atos, Sally Gunz, Femmy
Birks, Jacqueline Brook, Dawn Parker and Duncan Nicholls.
Niall Lobley, Director, Parks and Cemeteries provided a presentation outlining
the engagement undertaken on the places and spaces project, and highlighted
key changes to the report since the June 2022 consideration at Committee
including lengthening the transition window, increasing the formula for POPs
policy and increasing range of proposals eligible for exemption under Non -Profit
and Affordable Housing definitions. N. Lobley addressed the impact of density,
park provision outcomes on park dedication limits, and increase in the amount of
cash that can be collected with the proposed by-law.
Sheldon Atos provided a presentation to Council advocating for the need for
equitable, affordable parkland. S. Atos noted that impact of climate change on
communities and the relationships between parks, heat and equity deserving
groups were noted and the benefits of community parks were highlighted. S. Atos
then responded to questions from Council.
Councillor M. Johnston and Councillor P. Singh left the meeting.
Councillor M. Johnston returned to the meeting.
Troy Glover expressed support with amended recommendation outlined in
Report INS -2022-373 and the increased credit of 100% for developers for the
implementation of Privately Owned Public Spaces (POPS), noting the difference
between publicly accessible spaces in comparison to a POPS. In response to
questions, T. Glover stressed the need that the public spaces should be as
accessible as possible.
Councillor P. Singh returned to the meeting.
Gail Pool, addressed Council in opposition to the recommendation outlined in
INS -2022-373, expressing concerns about the health of people living in Kitchener
and impact of good parks practices on global warming noting the heatwaves and
access to air conditioner and park spaces on mortality. G. Pool indicated there
are several new developments in the Downtown that are currently exempt from
parkland, leaving many residents of those dwellings with insufficient greenspace,
resulting in overcrowding of existing park spaces in the area such as Victoria
Park.
Steve Burrows addressed Council regarding the need for parks for children to
play, as it boosts their mental health and expressed concern with the reduction of
parkland requirements within MTSAs and responded to questions from Council.
Acting Mayor S. Davey left the meeting at this time, Councillor P. Singh assumed
the Chair.
Members of Council asked questions regarding affordable housing rental
arrangements as per CMHC definitions for 10-15 years.
Acting Mayor S. Davey reentered the meeting at this time and assumed the
Chair.
In response to questions, N. Lobley advised that if Council does not approve a
new Parkland Dedication By-law this evening, then the City will not be able to
collect Parkland Dedication fees beyond September 1, 2022. It was noted
pending Council's decision this evening that the Parkland Dedication By-law be
given all required necessary approvals this date to ensure there is a Parkland
Dedication By-law in force and effect for September 1, 2022.
Councillor S. Marsh brought forward a motion to approve the recommendation as
outlined in report INS -2022-224, which was initially considered at Community and
Infrastructure Services Committee on June 13, 2022, including three additionally
clauses that staff be directed to remove the downtown exemptions for parkland
dedication requirements such that all development within the downtown will be
subject to parkland dedication requirements; that no parkland dedication be
required for all Supportive Housing Initiatives being defined as Non Profit
Housing (O.Reg 454/19, s.3(1));and, that staff be directed to consider, prior to
the sale of any City -owned property, that such property be considered for use as
parkland in any community having a high or critical need for parkland acquisition,
in consideration with affordable housing and economic development.
It was clarified that the Policy and the By-law attached to report INS -2022-224
included a 25% credit incentive for developers who implement a Privately Owned
Public Spaces (POPS) as well as a 12 -month transitional period for the new
Parkland Dedication in the Downtown.
Councillor M. Johnston brought forward an amendment to increase the proposed
transition person for the implementation of the Parkland Dedication By-law to 24 -
months rather than 12 -months, which was seconded by Councillor B. loannidis.

Councillor Johnston's amendment was then voted on and was LOST on a tie, on
a recorded vote, with Councillors P. Singh, B. loannidis, M. Johnston, D.
Schnider and S. Davey voting in favour; and, Councillors J. Gazzola, S. Marsh,
D. Chapman, K. Galloway-Sealock and C. Michaud voting in opposition.
Councillor D. Schnider brought forward a motion to increase the credit incentive
for developers who implement a Privately Owned Public Spaces (POPS) from
25% to 100%, which was seconded by Councillor B. loannidis.
Councillor Schinder's amendment was then voted on and LOST on a recorded
vote, with Councillors P. Singh, B. loannidis, D. Schnider and S. Davey voting in
favour; and, Councillors J. Gazzola, S. Marsh, M. Johnston, D. Chapman, K.
Galloway-Sealock and C. Michaud voting in opposition.

Councillor loannidis's amendment was then voted on and LOST on a recorded

favour; and, Councillors J. Gazzola, S. Marsh, M. Johnston, D. Chapman, K.
Galloway-Sealock and C. Michaud voting in opposition.
Councillor B. loannidis brought forward a motion to increase the credit incentive

25% to 50%, which was seconded by Councillor D. Schnider.
Councillor loannidis's amendment was then voted on and was LOST on a tie, on
a recorded vote, with Councillors P. Singh, B. loannidis, M. Johnston, D.
Schnider and S. Davey voting in favour; and, Councillors J. Gazzola, S. Marsh,
D. Chapman, K. Galloway-Sealock and C. Michaud voting in opposition.
The following motion was voted on clause by clause on recorded vote.
Following the vote on clauses 1 and 2 staff identified that the clause brought
forward by Councillor S. Marsh related to parkland dedication for all Supportive
Housing Initiatives being defined as Non -Profit Housing (O.Reg 454/19, s.3(1))
was redundant and no longer required as the Policy and By-law approved
through clauses 1 and 2 already include the requirement. Due to the comment
was agreed to remove the clause from the final recommendation.
Councillor P. Singh noted due to his previously declared conflict on the Urban
Growth Centre he needed to abstain from voting on Clause 3 the direction to
remove the downtown exemptions for parkland dedication requirements such
that all development within the downtown will be subject to parkland dedication
requirements.
It was further requested that Council vote to include the additional clause related
to the staff direction to investigate and bringing forward a report to Council before
the 2024 budget cycle on other ways in which parkland acquisition might be
advanced and funded, including exploring tools such as a special tax program
that would support the Parkland Reserve fund to acquire parkland above and
beyond the tools proposed in Spaces and the Parkland Dedication Bylaw, which
was voted on and Carried unanimously on a recorded vote.

"That Spaces be approved and recognized as the City's Parks Plan
pursuant to the requirements of the Planning Act, as outlined
Infrastructure Services Department staff report INS -2022-224; and,
That the updated Park Dedication By -Law and Park Dedication Policy be
approved, as amended, in the form shown in "Proposed Park Dedication
By -Law (2022)" and "Proposed Park Dedication Policy (2022)", attached
to Report INS -2022-224 as Appendix 2 and 3 attached, including:
o Providing a credit of up to 25% for Privately owned Public Spaces
(POPS);
o A Transition Phase of 12 months, and,
That staff be directed to remove the downtown exemptions for parkland
dedication requirements such that all development within the downtown
will be subject to parkland dedication requirements; and,
That staff be directed to work with the school boards to explore shared
use agreements that provide for a common understanding of where public
use can be supported on existing school board lands, and where school
board use of public parks may occur; and,
That staff be directed to continue to work with agencies such as Kitchener
Wilmot Hydro and Hydro One in managing areas of transmission corridors
to support and link a planned park and open space system, and continue
to work with partners such as Chicopee Ski Hill and the Grand River
Conservation Authority to enhance the City's parks and open space
system; and,

That staff be directed to identify specific properties of interest for
acquisition or repurpose (in the event lands are identified that are in public
ownership) to address identified Critical Needs Areas and bring these
forward when opportunities exist to Council; and,
That staff be directed to incorporate relevant directions from Spaces into
the City's Official Plan through its next review; and,
That staff be directed to consider, prior to the sale of any City -owned
property, that such property be considered for use as parkland in any
community having a high or critical need for parkland acquisition, in
consideration with affordable housing and economic development; and
further,
That staff be directed to investigate and bring a report to Council before

6.5 Class Environmental Assessment (EA) - Upper Hidden Valley Pumping
Station and Forcemain, Development Services Department report DSD -
2022 -258, and follow up Report DSD -2022-392
Council considered Development Services Department report DSD -2022-258,
and follow up Report DSD -2022-392 related to Class Environmental Assessment
(EA) - Upper Hidden Valley Pumping Station and Forcemain, which was initially
considered by Council on June 20, 2022 and deferred to this date. H. Gross,
Director, Engineering and K. Wood, Project Manager were in attendance to
respond to questions from Council.
Councillor B. loannidis brought forward a motion, which was seconded by
Councillor P. Singh, to approve Class Environmental Assessment (EA) - Upper
Hidden Valley Pumping Station and Forcemain as follows:
"That the Upper Hidden Valley Sanitary Pumping Station and Forcemain
Environmental Study Report (ESR) prepared by MTE Consultants, dated
May 25, 2022, which recommends Alternative 2a as the preferred sanitary
pumping station, be received, as outlined in Development Services
Department report DSD -2022-258 and amended in Development Services
Department report DSD -2022-392; and,
That the Upper Hidden Valley Sanitary Pumping Station and Forcemain
Environmental Study Report (ESR) be filed with the Ministry of the
Environment for the mandatory thirty (30) days review period as required
by the Environmental Assessment (EA) Act; and,
That the City of Kitchener proceed with an Addendum to the EA for the
purpose of determining the servicing methodology for parcel 2B
immediately after a Species at Risk Study for the 2B lands has been
completed and approved by the MECP and any other necessary
agencies; and further,
That necessary funding to complete the Addendum be secured in the City
of Kitchener budget."

Hanna Domagala, Prime Valley Developments, addressed Council in support of
the motion being brought forward by Councillor loannidis and responded to
questions from Council.
H. Gross advised staff had no objections with the motion as proposed.
