REPORT NO.: COR-2022-394
SUBJECT: Execution of Shared Servicing Agreements
RECOMMENDATION:
That the CAO or Department Heads be authorized to execute Shared Servicing
Agreements pursuant to Division B, Article 7.1.5.4 (Separate Services) of Ontario
Regulation 33/12, as amended, under the Building Code Act; said agreements to be
to the satisfaction of the Chief Building Official and the City Solicitor
REPORT HIGHLIGHTS:
The purpose of this report is to request delegated authority for the execution of shared
servicing agreements within new phased condominium developments.
This report supports the delivery of core services in a timely manner.
BACKGROUND:
Certain phased condominiums require Shared Servicing Agreements for the installation of
Water, Sanitary and Storm Water services to ensure Building Code and Safe Water Drinking Act
compliance before all phases are registered. Shared Servicing Agreements are legislated
through the Building Code Act and permit services to be legally shared between a registered
condominium and its future phases during the construction process.
REPORT:
To facilitate the servicing of approved phased condominium developments in a timely manner,
delegation of the execution of shared servicing agreements to the CAO or Department Heads,
subject to review by the Chief Building Official and Legal Services, is appropriate.
