LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE MINUTES
J U LY 8, 1994
CITY OF KITCHENER
The Local Architectural Conservation Advisory Committee met this date,
commencing at 12:00 noon, under the Chairmanship of Councillor M. Wagner, with all members present
except Ms. S. Burke and Mr. D. Parrish.
Others present: Messrs. B. Stanley, L. Bensason and Mrs. D. H. Gilchrist.
1. 314 Old Chicopee Road
Mr. B. Toderian of McNaughton, Hermsen, Britton, Clarkson Planning Ltd. and Mr. R. Dodd of
Paragon Engineering were in attendance to advise the Committee of the proposed plan of
subdivision for this area and it's effects on the house known municipally as 314 Old Chicopee Road.
Mr. Toderian advised the Committee that the owner had always intended to keep the house;
however, this does not seem possible now, due to the detailed engineering study. Mr. Dodd
displayed a plan showing the proposed realignment of Old Chicopee Road, having a width of 16 m.,
which is the smallest road width permitted by the City for roads in a subdivision. He explained that
due to this new road width and alignment, a 10 foot high retaining wall, immediately underneath the
front wall of the existing house, would be required, if the house was to remain, due to the grade
difference. In fact, Mr. Dodd explained, that a retaining wall around three sides of the house would
be required at an estimated cost of One Hundred and Fifty Thousand Dollars ($150,000.00).
Many questions were raised by the Committee in response to the proposed plan. Mrs. Wagner had
advised that L.A.C.A.C. had been given assurances that this house would be preserved and also
that this portion of Old Chicopee Road was to be a scenic road. Mr. B. Stanley advised of some of
the history of this subdivision plan, where, initially, it had not been decided if Old Chicopee Road
would be front lotted of back lotted. These problems have come about as a result of the owners
choice to make this a front lotted road. Mrs. Wagner responded that these decisions where made
without any consultation with L.A.C.A.C.. The changes which have been made should have been
discussed with L.A.C.A.C. before a final decision was made, as they are quite different from the
assurances previously given by the owner.
Councillor T. Galloway advised that a Heritage Impact Study during the plan of subdivision would have
solved this problem. He advised that he voted against this proposal as he wanted this street to be
back lotted in order to preserve its scenic nature. Mr. Stanley advised that the owners should have
known, when the plan was first submitted, that the house could not be saved.
Ms. M. Welsh stated that enough information about the retaining wall has not been submitted and
suggested the Committee needs to see what it would look like visually.
The question was raised as to how certain the owner is that this subdivison would be built? Mr. Toderian
advised that the owner intends to have this subdivision registered by the end of the year with the
grading to commence as soon after as possible and then permits issued. It is the intent of the
owner to build as soon as possible as it is financially necessary.
It was suggested that a decision on this matter be deferred to the August meeting to have more
information from staff and the consultant.
Councillor M. Wagner stated that it is important that this does not happen again, not only with this
property but all properties.
On motion by Ms. M. Welsh
it was resolved:
"That the demolition control application for 314 Old Chicopee Road be refused at this time."

On motion by Mrs. J. Kraemer
it was resolved:
"That the Heritage Planner prepare a report, to be considered by the Local Architectural
Conservation Advisory Committee at its meeting of August 9, 1994; which will
recommend procedures to allow this committee to comment on the preservation of
historically and/or architecturally significant building contained in proposed and/or
draft plans of subdivision, prior to the draft plan of subdivision receiving approval."
2. MINUTES
On motion by Mr. E. Bow
it was resolved:
"That the minutes of the regular meetings of the Local Architectural Conservation Advisory
Committee, of June 10, 1994, as mailed to the members, be excepted."
3. L.A.C.A.C. STRATEGIC PLAN
It was noted that this matter had been considered at the June meeting and no one had advised Mr.
Bensason of any necessary changes.
On motion by Mr. V. Tarbutt
it was resolved:
"That we approve the Local Architectural Conservation Advisory Committee Strategic Plan
and Strategic Priorities by Key Activity Areas (1994-1998)."
4. PROPOSED ONTARIO HERITAGE ACT
Mr. L. Bensason distributed some printed information which contains comments made by Mr. A. Tyyska of
the Ministry of Culture, Tourism and Recreation at a symposium held in Mississauga on June 21
1994.
On motion by Councillor T. Galloway
it was resolved:
"That council correspond with the Ministry of Culture, Tourism and Recreation to advise of
their concerns over the weaknesses of the proposed Ontario Heritage Act."
It was agreed that this resolution would be further considered at the August meeting, at which time
Committee members are to bring forward those areas of concern in the Act, to be outlined in the
letter.
5. DESIGNATED PROPERTY GRANTS
The Committee was in receipt of a report from Mr. G. Sosnoski, dated July 7, 1994, outlining the
applications received under the Preserving Ontario's Architecture Program for designated property
grants. Mr. Sosnoski outlined the proposed work in each of the five applications, along with
information on the Provincial Guidelines in each case and suggested recommendations.
Dr. J. Steckle was in attendance concerning her application for the J. Steckle Heritage Homestead. She
was advised that the committee would consider only the repairs to the Forge Barn, at an estimated
cost of $7,300.00, which would entitle her to the maximum grant funding, should the funding come
through from the Province.

On motion from Mr. W. Ristau
was resolved:
"That a Designated Property Grant under the Preserving Ontario's Architecture Program for
50% of eligible costs to a maximum of $3,000.00 be approved, in principle, for 811
Bleams Road (J. Steckle Heritage Homestead) and the grant be used to fund the
repointing of the north and west elevation and repair the major crack in the north
wall of the Forge Barn, as outlined in the owners application dated July 4,
1994; and further
That this approval be conditional upon: the Province confirming it's funding commitment and
all receipts/invoices being submitted to the Clerk's Division by April 30, 1995."
The Committee noted the comments of Mr. G. Sosnoski with respect to the designating By-Law for this
property and the whole scope of the work being proposed for the Stekle Heritage Homestead. As
Mr. Ristau has been appointed by the Committee as it's liason with the Homestead, he was
requested to look into the matter with the assistance of one or two other members, and report back
to the Committee.
The Committee then considered the application for 150 Water Street South/73 Heins Avenue. The
Secretary advised that the Provincial Guidelines only allow for one painting grant and the owners
had received a grant in 1993 for painting. Further she asked the Committee to considered the
request to fund a reconstruction of a screen door, with a design and demension to be determined
based on the existing original hinge and style.
On motion by Councillor T. Galloway
it was resolved:
"That a Designated Property Grant under the Preserving Ontario's Architecture Program for
50% of eligible costs to a maximum of $3,000.00 be approved, in principle, for 150
Water Street South/73 Heims Avenue and the grant be used to fund the repair
and/or replacement of soffits, facia and supporting brackets and the new cedar
shingle roof for the sun porch; the selective replacement of railings and spindles on
the rear porch of 150 Water Street South; and the reconstruction of five wooden
storm windows, as outlined in the owner's application dated July 5, 1994; and
further
That no action be taken on the request of the owners to fund the painting of the sun porch and
the reconstruction of a storm/screen door for the Heins Avenue entrance; and
further
That funding of the new cedar shingle roof on the sun porch be conditional upon verification
by staff of the use of existing cedar shingles on the sun porch for the main roof;
and further
That this approval also be conditional upon: the Province confirming it's funding commitment;
all reconstructed features being identical in all respects to the existing original; and
all receipts/invoices being submitted to the Clerk's Division by April 30, 1995."
The Committee then considered the application for 23 Roland Avenue.

On motion by Mr. V. Tarbutt
it was resolved:
"That a Designated Property Grant under the Preserving Ontario's Architecture Program for
50% of eligible costs to a maximum of $3,000.00 be approved, in principle, for 23
Roland Street, and the grant be used to stabilize the front porch by the installation
of a concrete footing and a rebuilt pier, repointing of remaining piers and to repair
and/or replace portions of the front porch and upper balcony, as outlined in the
owner's application dated June 27, 1994 and further
That this approval be conditional upon:
The reconstruction of the upper balcony and lower porch must match as closely as possible the
woodwork shown in the historic photograph in "Berlin-Celebration of Cityhood 1912";
The mortar mix to be used in repointing the porch piers must be endorsed under Provincial Guidelines
with the tooling of the joints to match the existing;
The Province confirming it's funding commitment;
All reconstructed features being identical in all respects to the existing original; and
All receipts/invoices being submitted to the Clerks Division by April 30, 1995."
The Committee then considered the application for 43 Schneider Avenue. The Committee considered
the items in Mr. Sosnoski's report and agreed that they wanted the owner to submit, for approval, a
scaled drawing of the proposed steps. The Committee was in agreement with Mr. Sosnoski's
recommended condition.
On motion by Mr. P. Bufe
it was resolved:
"That a Designated Property Grant under the Preserving Ontario's Architecture Program
for 50% of eligible costs to a maximum of $3,000.00 be approved, in principle, for
43 Schneider Ave., and the grant be used to repair the front porch floor, front porch
posts, construct new wooden steps to replace existing masonry unit at the front
door, construct wooden steps to front porch, repair wood soffit above David Street
facade and the selective repointing of mortar joints on three elevations, as outlined
in the owners application dated June 30, 1994 and subsequent amendment; and
further
That this approval be conditional upon:
The reconstruction of the front door steps, to replace the existing masonry unit, must match as closely as
possible the circa 1910 photograph submitted by the owner;
The owners use a mortar mix which is endorsed under Provincial Guidelines and tool the mortar joints to
match the existing;
Prior to beginning construction, the owner shall submit a drawing, to scale, showing an appropriate
design for the proposed steps on the porch, for approval;
The Province confirming it's funding commitment;

All reconstructed features being identical in all respects to the existing original; and
All receipts/invoices being submitted to the Clerks Division by April 30, 1995."
The Committee then considered the application for 181 Park Street.
On motion from Mr. P. Bufe
it was resolved:
"That a Designated Property Grant under the Preserving Ontario's Architecture Program for
50% of eligible costs to a maximum of $3,000.00 be approved, in principle, for 181
Park Street, and the grant be used to fund work involving the front porch, the upper
balcony, and the front dormer, as outlined in the owners amended application
dated July 6, 1994; and further
That the installation of cedar shingles be conditional on staff verifying the existence of cedar
shingles on the balcony apron and eaves returns; and further
That this approval be conditional upon: the Province confirming it's funding commitment; all
reconstructed features being identical in all respects to the existing original; and all
receipts/invoices being submitted to the Clerks Division by April 30, 1995."
It was suggested that the Committee should discuss a way of getting the applications earlier so that there
is more time to consider them.
6. TRUSSLER ROAD
Councillor T. Galloway advised the Committee that a request had been made to the Public Works
Department to tar and chip Trussler Road between Bleams Road and New Dundee Road, by the
Township of Wilmot. The action had been delayed because the residents had not been informed.
It was noted that L.A.C.A.C. has considered this area for a Heritage Conservation District.
Councillor Galloway advised that this matter will be considered by Council on July 11, 1994.
On motion by Councillor T. Galloway
was resolved:
"That the Local Architectural Conservation Advisory Committee agrees with the surfacing of
Trussler Road with tar and chips; provided that the carriage way is not widened
and the vegetation is not destroyed; and further
That the City of Kitchener correspond with the Township of Wilmot indicating the future plans
of both municipalities to work towards a Heritage Conservation District plan for the
Trussler Road area.
7. DOON VILLAGE ROAD
Councillor T. Galloway spoke of a property on Doon Village Road which is owned by the City, for which
the City is considering demolotion. Councillor Galloway suggested that this space would be well
used as an Interpretive Centre for the District, perhaps with some commemoration of the Village.
On motion by Councillor T. Galloway
it was resolved:

"That a sub-committee, consisting of one member of the Local Architectural Conservation
Advisory Committee, one member of the Society For the Preservation of Upper
Doon and the Heritage Planner, discuss the potential use of the property on Doon
Village Road owned by the City of Kitchener, in the context of the Upper Doon
Heritage Conservation District Plan."
Mr. B. Tarbutt volunteered to be the L.A.C.A.C. member on the sub-committee.
8. DEMOLITION - 19 DURHAM STREET
The members were provided with a copy of a letter from Mr. L. Bensason, dated June 20, 1994 to Mr. I.
Biuk, proposed developer of this property. Mr. Bensason stated in the letter that he would
recommend to L.A.C.A.C. that they not pursue designation of this property. It also requested Mr.
Biuk's co-operation in allowing the Church to be recorded, among other things.
The Committee considered the recommendations contained in Mr. Bensason's letter. They decided to
ask Mr. Biuk to pay the full cost of recording the building, estimated at $200.00 - $300.00.
Mr. Bufe put forward an ammendment to the recommendation not to ask for the recording at all; which
was voted on and lost.
On motion by Mr. V. Tarbutt
it was resolved:
"That the Local Architectural Conservation Advisory Committee requests of the proposed
purchaser/developer of 19 Durham Street the following:
That, in an effort to prevent premature demolition of 19 Durham Street, the owner not proceed
to demolish the Church until he has written confirmation from City Staff that he will
be able to satisfy all the issues which need to be addressed relative to the
proposed development (ie. access, servicing, etc.);
That the owner allow the Church building to be recorded for L.A.C.A.C. archives with the
owner to pay the full, estimated cost of between $200.00 - $300.00;
That the owner make every effort to salvage the various existing features of the Church on 19
Durham Street, including: the 1868 date stone on the front facaud, all the windows
with muntins, trim and other detailing in tact, and as much of the exterior red brick
as possible; as L.A.C.A.C. would like the opportunity to contact various
individuals/organizations would be interested in acquiring the above-mentioned
features."
9.STUDENT PROJECT
Mr. Bensason distributed a Terms of Reference for the Scenic Road Project to be undertaken by students
this summer.
10. GRANT APPLICATION
Ms. E. Esenberg gave a brief discription of the Grant Application made to the Ministry of Culture, Tourism
and Recreation.
11. HARRY CLASS POOL - DESIGNATION CEREMONY
Mr. W. Ristau made a brief announcement concerning the Harry Class Pool Designation Ceremony to be
held on July 23, 1994, at 12:00 noon.

12.COLLECTION POLICY
Ms. P. Wagner requested that members of the Committee who are doing the building evaluations keep a
record of series of buildings built by the same builder. Also, she requested that these members
keep a record of stain glass windows found on these walks.
13. EVALUATION SUBCOMMITTEE
Packages were distributed to those members who are doing the building evaluation sheets for the next
area, being the Civic Centre area.
14. NEW BUSINESS
Ms. B. Buchanan questions whether the Committee was still interested in getting T-shirts made. Mr. V.
Tarbutt suggested waiting until a new logo was chosen.
Mr. Bufe questionned the new demolition control policy and Councillor Wagner advised that the
Committee would be provided with information well before a decision was made.
Ms. M. Welsh advised of the 125th Anniversary Celebrations to take place at the Kitchener Farmers
Market on July 16, 1994.
15. NEXT MEETING
The next regular meeting of the Local Architectural Conservation Advisory Committee is scheduled for
Friday, August 12, 1994 in the Conestoga Room, commencing at 1:00 p.m..
