LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE MINUTES
APRIL 7, 1995
CITY OF KITCHENER
The Local Architectural Conservation Advisory Committee met this date, under the Chairmanship of
Councillor M. Wagner, commencing at 12:10 p.m., with the following members present: Councillor T.
Galloway, Councillor Jake Smola, Mr. M. Badran, Mr. E. Bow, Ms. B. Buchanan, Mr. P. Bufe, Ms. S.
Burke, Mr. R. Coo, Ms. P. Costigan, Mr. W. Ristau, Mr. V. Tarbutt, Ms. P. Wagner and Ms. D. Westman.
Regrets: Councillor B. Vrbanovic and Ms. E. Essenbergs.
Others: Ms. L. Pasternak, Mr. L. Bensason, Mr. T. Boutilier and Ms. D. H. Gilchrist.
1. CHAIRMAN'S REMARKS
Councillor M. Wagner introduced Mr. M. DeGroot, who has expressed an interest in becoming a
member of this Committee.
2. MINUTES
Mr. L. Bensason requested an amendment to item 5 (b) of the L.A.C.A.C. Minutes of March 3,
1995 to change "Dean Millens" to "David Newlands".
On motion by Mr. E. Bow,
It was resolved:
"That the Minutes of the Local Architectural Conservation Advisory Committee of
March 3, 1995, as mailed to the members and amended with respect to item 5(b), be
approved.
3. CLOCK TOWER UPDATE
Councillor M. Wagner advised that Mr. J. Clinckett is the architect for this project. Mr. Clinckett
had hoped to make a presentation at this meeting but was unable to attend. Councillor Wagner
advised that drawings have been made available for viewing at the end of this meeting and that
Mr. Clinckett has faxed certain specifications for the Committee's information.
Ms. S. Burke advised that the project has chosen a logo which is the same as that used by the
Waterloo-Wellington Museum Association; however, the Association will raise this concern with
the Clock Tower Committee on their own.
4. ALTERATION FORM
Mr. L. Bensason distributed the current draft of an Alteration Form with a declaration on the back
which has been designed by the Legal Services Division. Ms. L. Pasternak, Assistant City
Solicitor, was in attendance for this reason. Mr. Bensason advised that a resolution from this
Committee is required, which must be ratified by City Council. Mr. Bensason suggested that once
finalized and approved, a copy of the form should be sent to each owner of a designated property.
Ms. S. Burke advised that the Policies & Procedures Sub-Committee has reviewed the form and is
in agreement with this draft. Councillor T. Galloway questioned whether the form applies only to
those features which are sited in the reason for designation. A discussion then took place on how
to know whether the work being undertaken impacts on the designation; what type of work impacts
the reasons for designation and which ones don't.
Ms. Pasternak advised that if a property owner does work which does not contravene the Act,
there will be no penalty.

On motion by Mr. E. Bow,
it was resolved:
"That we accept the Designated Heritage Property Alteration Application as presented to
the Local Architectural Conservation Advisory Committee on April 7, 1995, subject to the
concurrence of the Chief Building Official."
5. SUB-COMMITTEE REPORTS
a) INVENTORY SUB-COMMITTEE
Mr. V. Tarbutt advised that the Committee is preparing the next package for the site survey. He
will be looking for volunteers at the next L.A.C.A.C. meeting.
Ms. P. Wagner stated that the question of whether a property is 50 years old or older should be
included on subdivision applications. Mr. L. Bensason agreed to discuss this matter with Regional
Staff.
b) HERITAGE DISTRICT SUB-COMMITTEE
Mr. R. Coo advised that he had nothing to report at this time.
Ms. S. Burke spoke of her letter to Ms. J. Given concerning the Pioneer Tower Area. Councillor T.
Galloway advised that by-in-large he was in agreement; however, he was concerned about her
comments on the Pioneer Tower Road. It was his understanding that L.A.C.A.C. was in
agreement with turning it into walking trail and he also thought that L.A.C.A.C. was in agreement
with back lotting.
Ms. Burke stated that she did not remember L.A.C.A.C. agreeing to change the road into
something other than a road.
Mr. P. Bufe advised that he was in favour of back lotting Pioneer Tower Road. If the lots front onto
Pioneer Tower Road the same problem will occur as with Old Chicopee Road in that it will be
realigned, serviced and widened.
c) EDUCATION SUB-COMMITTEE
Ms. B. Buchanan reported, advising of the success of the display, during Heritage Week, at the
Conestoga Mall. This display is now being used at different schools in the City. Further, Ms.
Buchanan advised that a letter is being sent to each of the property owners whose properties were
photographed and used for the display, along with copies of the photographs, to thank them. Ms.
Buchanan also advised that the sub-committee would like to sponsor another neighbourhood walk.
It was suggested that the Education Sub-Committee delay the walking tour until 1996 and co-
ordinate its efforts with the Victoria Park 100th Birthday Committee.
A discussion then took place on the lecture series sponsored by Joseph Schneider Haus.
On motion by Ms. B. Buchanan,
it was resolved:
"That the Local Architectural Conservation Advisory Committee pay the cost of any of its members
who wish to attend the "Architecture: inside and out" lectures at the Joseph Schneider Haus.
Ms. S. Burke requested that any members wishing to take part in the lecture series registered in
advance.

d) POLICIES AND PROCEDURES SUB-COMMITTEE
Ms. S. Burke advised that the sub-committee is working on a student project which will involve the
creation of an electronic data base of inventoried and designated properties to allow for sorting.
The sub-committee will also be reviewing the strategic plan for those items to be completed in
1995.
e) DESIGNATION SUB-COMMITTEE
Ms. P. Wagner reported as follows:
i)
Kaufman Footwear - Still awaiting the A.C.O. representative to do a survey of the building
and report back to L.A.C.A.C..
ii) 12 Wellington Street North - Mr. V. Tarbutt is working on this property.
iii)
Forsyth Building - Ms. D. Westman and Mr. M. Badran have looked at the building and
prepared a written description; however, a little more research is required.
iv)
35 Sheldon Avenue North - Mr. Ristau has visited with Mrs. E. Macintosh who was in favour
of the designation; however, her husband and son are not. There concern is with the sale
of the land at the front of the house.
v)
43 Sheldon Avenue North - Mr. Ristau advised that he has submitted a request to the
Church Council who will considered it at a meeting either the last Sunday in May or the first
Sunday in June.
vi) 189 Queen Street North - Green Gable - Nothing has been done on this property yet.
vii) 189 Queen Street South - W.H. Schmaltz Home - Former Mayor - to be demolished.
viii) 85 Walter Street - Ms. L. O'Krafka wants this property listed on the Heritage Inventory.
On motion by Ms. P. Wagner,
it was resolved:
"That 85 Walter Street and 189 Queen Street South be added to the Heritage Inventory."
ix)
Margaret Avenue School - Ms. P. Costigan advised that she has made a presentation to
the Board of Education Management Committee requesting the designation of Margaret
Avenue School.
Councillor M. Wagner congratulated Ms. Costigan and Ms. Westman on the excellent presentation
which they made on behalf of L.A.C.A.C..
Ms. Costigan advised that the Board has some concerns regarding the wooden front door and
window openings. She advised that the 1925 addition completely covers the 1894 building. Ms.
P. Wagner listed the specific features to be included in the designation. Ms. Costigan advised that
the timing is tight, as the Board would not consider the request to designate until April 24, but the
schools 100th Anniversary Celebrations will be held on May 4 - 5, 1995 and they want a heritage
plaque installed for the celebrations. Ms. Costigan suggested that two dates, 1894 and 1925, be
inscribed on the plaque.
On motion by Ms. P. Costigan,
it was resolved:

"That we approved, in principle, the designation of Margaret Avenue School, subject to meeting
the requirements of the Ontario Heritage Act."
Councillor Wagner asked for the Committee's direction on which properties to concentrate on for
designation. Mr. L. Bensason suggested that a letter be sent property owners, as soon as
possible, to see which are in agreement with designation. He agreed to prepare a package of
information to go along with the letter prepared by Ms. P. Wagner.
Councillor Wagner requested that a priority list be prepared by the next meeting, of those
properties recommended for designation and a list of what must still be done before designation
can take place.
Mr. L. Bensason advised that he had received phone calls from two property owners who are
interested in having their properties designated; being 11-15 Pandora Avenue North and 21 Ellen
Street West. Two sub-committees were formed to investigate these properties: 11-15 Pandora
Avenue North, Ms. D. Westman and Mr. M. Badran; 21 Ellen Street West, Mr. M. DeGroot and Mr.
R. Coo.
Mr. L. Bensason suggested that a property reporting form be completed for each property before
they are added to the inventory.
On motion by Mr. P. Bufe,
it was resolved:
"That 11-15 Pandora Avenue North and 21 Ellen Street West be added to the Heritage Inventory.
6. 30 FRANCIS STREET SOUTH
The By-law designating 30 Francis Street South has been registered on title. Councillor M.
Wagner advised of a possible trade between the City of Kitchener and the Wittington Group of
green space adjacent to their property at the corner of King and Francis Street in exchange for this
house. A price for both properties must be established before anything can take place.
7. LETTER OF COMPLIANCE
Mr. L. Bensason advised that a new section is being added to the City's Letter of Compliance
concerning heritage. He provided the members with a draft of the form.
8. BUR OAK UPDATE
The Committee acknowledged receipt of a letter from Mrs. J. Haalboom concerning the retention
of the Bur Oak in Upper Doon.
9. L.A.C.A.C.'S ROLL IN PLANNING APPLICATIONS
The Committee referred to a memorandum from Mr. P. Mason, Director of Development Planning,
Region of Waterloo to Mr. D. Newlands, Heritage Resource Planner, Region of Waterloo, dated
March 14, 1995, concerning "L.A.C.A.C. Roll in Circulation of Approval of Planning Applications-
Bill 163 changes."
Planning applications will come through Mr. L. Bensason to L.A.C.A.C.. Mr. Bensason advised
that, as a practice, if a subdivision application is impacted by an archaeological study, then he will
bring it forward to L.A.C.A.C.'s attention. If there is no time to bring the matter to a LAC.AC.
meeting, then he will approach a specific committee member.
Ms. P. Wagner then advised of her meeting with Mr. P. Mason at the Region and the following is
the information provided:

1. L.A.C.A.C. must be notified and circulated with plans of subdivision.
2. L.A.C.A.C. must be prepared to deal with these applications.
3. L.A.C.A.C. must come to conclusions and respond without delay as there is a time frame.
L.A.C.A.C. must work with the 3lanning staff and through the Official Plan to resolve
differences.
Municipalities and planning departments must acknowledge L.A.C.A.C. and other groups.
If L.A.C.A.C. does not participate, especially at public meetings, their objections will be
disregarded at an O.M.B. hearing.
10. ADAPTIVE REUSE COMMITTEE
Councillor Wagner advised that this Committee is trying to finalize a list of incentives and
disincentives on reusing industrial buildings, which should be completed by the Committee's next
meeting and then forwarded to City Council. At the following meeting, the Committee will prioritize
industrial structures for reuse. They will then be approaching L.A.C.A.C. for historical background.
11. REGIONAL ELECTRONIC HERITAGE INVENTORY
Mr. L. Bensason distributed a letter concerning the Regional Electronic Heritage Inventory and
requested that the Committee members provide him with their comments over the next few days so
that he can take them back to the next regional meeting.
Councillor Wagner stated that no other Committee is expected to deal with the amount of
information this Committee deals with. He commended the members for their efforts.
12. U P DATES
Ms. P. Wagner advised that she had spoken with Mr. G. MacDonald at the Region concerning the
widening of Huron Road. A noise study has been completed and four houses will be affected. An
eight foot high wall will be constructed as a noise barrier, possibly similar to that in front of the
Steckle Farm. Further, these houses are in the Heritage District.

Ms. P. Wagner then spoke of the histories being prepared by the Waterloo Historical Society.
