Wagner, commencing at 5:00 p.m., with the following members present: Councillor T. Galloway, Councillor Jake Smola, Councillor B. Vrbanovic, Ms. S. Burke, Ms. S. Campbell, Ms. E. Essenberg, Ms. B. Buchanan, Mr. E. Bow, Mr. D. Gowland and Mr. R. Coo. Regrets: Ms. P. Costigan. Others Present: Mr. T. Boutilier, Mr. L. Bensason and Ms. D. Gilchrist. 1. DESIGNATION - 410 KING STREET WEST (KAUFMAN FOOTWEAR) Councillor M. Wagner introduced this matter, stating that the purpose of this special meeting is to discuss the concerns about the form of the proposed designation for 410 King Street West, as expressed at the Committee's regular meeting held on January 12, 1996. A resolution will be reached at this meeting which will be forwarded to a special meeting of City Council to be held at 12 noon on Monday January 22, 1996. It was noted that Mr. W. Dahms, of Sims, Clement, Eastman, was in attendance on behalf of Kaufman Footwear. Councillor M. Wagner stated that at the last meeting, concerns were raised over the term "sympathetic alterations" and who would interpret what this term means and who would approve of these alterations. Councillor Wagner clarified that drawings and plans for these proposed alterations will be submitted to staff who will bring them to L.A.C.A.C. and in turn, L.A.C.A.C. will make a recommendation to City Council for a final decision. If Council determines that they are not sympathetic, they will request Kaufman to reconsider their plans. Mr. L. Bensason addressed the Committee and provided copies of a letter from Mr. W. Dahms to Ms. D. Arnold, Assistant City Solicitor, dated January 16, 1996, in which Mr. Dahms acknowledges Council's authority to determine whether or not any proposed alteration is sympathetic and in keeping with the drawings submitted by The Walter Fedy Partnership. Mr. Bensason advised that when drawings are received by staff they will be provided to L.A.C.A.C. who will then be expected to make a recommendation to City Council. It will then be up to Council to determine if the alterations are sympathetic and in keeping with the reasons for designation. The Committee enquired as to whether Kaufmans will agree to a recording when features of the building are to be demolished. Ms. S. Burke spoke of this property as having landmark status. She questioned whether L.A.C.A.C. has any say on what would be required in the way of documentation. Mr. L. Bensason responded that, if a demolition permit is required for a heritage property, documentation, to the satisfaction of this Committee, is required. When no permit is required there is no documentation required. Mr. Dahms advised that he has spoken with Kaufmans Vice-President of Finance on the matter of documentation and it is a difficult question to answer because the costs are unknown. He stated that the Company has cooperated fully in this process and the record shows that it has been very cooperative in this regard. He stated that the Company will cooperate fully in the future. Ms. S. Burke suggested that the documentation done on the Breithaupt property should be the standard for this type of building. Councillor T. Galloway advised that he spoke in favour of this designation at the last meeting; however, he does recognize the concerns of some of the members that this may become the precedent or model for other designations, especially with respect to alterations. He suggested that there be included with the resolution to Council a statement that this particular designation is being done on its own merits and the Committee does not wish to create a precedent. Galloway - it was resolved: "That the recommendation from the Local Architectural Conservation Advisory Committee to City Council recommending designation of 410 King Street West (Kaufman Footwear) contain the following statement: "That based on the merits of the specific designation and without prejudice to future designations in the City". Carried Unanimously Mr. W. Dahms advised that he was not opposed to such a statement appearing in the recommendation to Council. Councillor M. Wagner stated that he would not want this to become a precedent for residential properties; however, it maybe necessary to allow for adaptive re-use of other industrial properties the Committee wishes to designate. Ms. S. Burke stated that the sub-committee had always discussed this building as being a landmark. She asked that the reasons for designation be amended to include the following statement: "It has been a physical landmark in Kitchener for close to a century, dominating the intersection of King Street and Wilmot Street (now Victoria) and serving as a 'gateway' to the downtown as one approaches from Waterloo." The Committee generally agreed to this amendment to the reasons for designation and Mr. Dahms advised that he was also in agreement. On motion by Councillor Jake Smola - it was resolved: "That, based on the merits of this specific designation and without prejudice to future designations in the City, pursuant to Section 29 of the Ontario Heritaqe Act, R.S.O. 1990, the Clerk be directed to publish a notice of intention to designate the property municipally known as 410 King Street West, Kitchener (Kaufman Footwear) as being of historic and architectural significance, and further That the designation shall include the east, south and west elevations of the 1908, 1911,1920 and 1925 phases of the main building with the designation to include only the following features: the exposed concrete frame, window openings, cornice and dentil mouldings, primary leading roofline (to the height of the existing 1908 and 1911 building frame) and porticos, all applying to the 1908 and 1911 building phases; the exposed concrete frame, brick and concrete block infill panels (spandrels), concrete lintels and sills, glass and metal enclosed entranceway with closed transom, limestone Doric columns and architrave with frieze and inscription reading "Kaufman Rubber Co. Ltd.", window openings, cornice and dentil mouldings, roof and roofline, and interior features of the entrance foyer, save for the reception counter line of the northwest wall from floor to underside of the height of the existing wall opening,all applying to the 1920 building phase; and the exposed concrete frame, brick and concrete block infill panels (spandrels), concrete lintels and sills, window openings, cornice and dentil mouldings, roof and roofline, all applying to the 1925 building phase, and further That, notwithstanding the proposed designation, sympathetic alterations, in keeping with the drawings submitted by The Walter Fedy Partnership, dated January 1996, to be appended to the reasons for designation, are permitted."
