LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE MINUTES
SEPTEMBER 13, 1996
CITY OF KITCHENER
The Local Architectural Conservation Advisory Committee met this date, under the Chairmanship of
Councillor M. Wagner, commencing at 12:10 p.m., with the following members present: Councillor T.
Galloway, Councillor Jake Smola, Ms. S. Burke, Ms. P. Costigan, Ms. S. Campbell, Ms. D. Westman, Mr.
E. Bow, Mr. R. Coo and Mr. M. de Groot.
Regrets: Ms. B. Buchanan and Councillor B. Vrbanovic.
Others Present: Mr. L. Bensason, Mr. T. Boutilier and Ms. D. Gilchrist.
1. CHAIRMAN'S REMARKS
Councillor M. Wagner spoke of the workshop sponsored by the Waterloo Regional Heritage
Foundation, to be held at the Kitchener Public Library on Saturday October 26, 1996. He stated
that last year the City paid the registration fee for L.A.C.A.C. members and some members didn't
attend. This year, Councillor Wagner advised, the members would have to pay their own
registration fee up front, to be reimbursed by the City if they did attend.
Councillor Wagner advised that the Library Foundation will conducting a tour of heritage homes on
October 5, 1996. They are looking for volunteers to quara these homes during the tour. Anyone
interested in volunteering should contact Sherry Erb at 743-0271.
Councillor Wagner asked the members to review the information about other workshops coming
up, which had been distributed by the secretary.
Councillor Wagner then spoke about Epton Industries advising that although the property is not
designated, it is on the Heritage Inventory. He advised that, whatever happens, he thinks the
pump house should be retained. He advised that he and other members of Council will, when the
time comes, encourage the owners to keep the pump house.
2. 381 PIONEER TOWER ROAD - HERITAGE IMPACT ASSESSMENT
Mr. L. Bensason introduced this item advising that Mr. N. Hill has prepared the heritage impact
assessment for 381 Pioneer Tower Road and the members have received the preliminary
assessment in the agenda package. What is being requested of the Committee today is feedback
on the assessment, which will be come part of the Planning Department's position on the
assessment.
Mr. N. Hill then addressed the Committee starting with a few slides to show the property. He
advised that the barn foundation was constructed in approximately 1830 and the top of the barn
was constructed in approximately 1910. The farmhouse, constructed c. 1830, was built by David
Shirk and is a fine example of the Mennonite Georgian style. The bankbarn has an unusual
overshot four bay barn and there is a spring house on the property constructed c. 1830. Mr. N. Hill
then displayed some drawings and plans showing the buildings, development options and the
heritage significant areas. Mr. Hill then recommend, with some modification, option no. 1. He
advised that this option would allow the flow of Vista Ridge, from the adjacent development into
this property, which would divide the northerly windbreak from the rest of the property. Mr. Hill
then referred to page 15 & 16 of the heritage impact assessment, containing the recommendations
and priorities, which he reviewed with the Committee. He advised that the owners are looking for
a measure of support for what has been done thus far.
Councillor T. Galloway advised that he was quite encouraged by the study and by the actions of
the owners. A brief discussion took place on whether the property should be included in the
heritage conservation district and on the conversion of the barn.
Councillor M. Wagner stated that the Committee has to decide whether this property should be
designated under Part IV or Part V of the Act.
Ms. S. Burke stated that, having been inside the building, there are parts of the interior which
should be designated, such as the cook stoves and the bake oven. These are details which are
quite rare and not found in the city.

Mr. N. Hill responded that he agreed with Ms. Burke concerning the interior features; however, he
thought a Part V designation would tie everything together along the ridge, including the
neighbouring property. Further, the district would allow for controls over future development.
Mr. L. Bensason suggested that a Part IV designation could be considered for the buildings and a
Part V designation for the rest of the property. Councillor M. Wagner questioned whether a
decision in this regard could wait until the next meeting. Mr. L. Bensason requested that
something be done as soon as possible. He requested that a sub-committee be established. A
sub-committee composed of Ms. S. Burke and Ms. D. Westman agreed to meet with Mr. L.
Bensason the following week.
Mr. T. Boutilier referred to the preferred option on page 20 of the report. He advised that he
doubted that the trees could survive the development process. It is very onerous to protect trees
from the development process and trying to protect trees in the front yard is very difficult. Mr.
Boutilier advised that he is going to request the City's Chief Forester to evaluate the trees before
things get started.
A discussion then took place on the size of the heritage lot and its affordablity. Mr. L. Bensason
then referred to the memorandum from Mr. P. Britton, dated September 5, 1996. He asked that, if
the members have any comments to make in this regard, they be referred to Ms. D. Westman, Ms.
S. Burke or himself, prior to the sub-committee meeting.
Mr. N. Hill requested that the owners be involved in the sub-committee meetings and Councillor M.
Wagner agreed that there would be a benefit; as this would help to facilitate reaching timely
decisions.
Mr. D. Heron of MacNaughton, Hermsen, Britton Clarkson was in the audience and was
introduced to the members.
3. REQUEST TO ALTER - 31 TILT DRIVE
The Committee was receipt of plans showing the proposed alteration to the property known
municipally known as 31 Tilt Drive, located in the Upper Doon Heritage Conservation District. Ms.
N. Tilt was in attendance to represent the request.
Mr. L. Bensason advised that he had visited the site the day before. He stated that the existing
kitchen addition is to be demolished and the materials are to be used in the new addition.
Councillor Jake Smola referred to the east elevation and a brief discussion took place on the
membrane to be used for the flat roof.
Ms. S. Burke requested that the existing kitchen wing be photographically documented and
measured drawings be taken prior to being demolished.
On motion by Councillor T. Galloway
it was resolved:
"That, pursuant to Section 43 of the Ontario Heritaqe Act, we approve the request of the owner to
alter the property municipally known as 31 Tilt Drive, located in the Upper Doon Heritage
Conservation District, by demolishing the existing kitchen wing and replacing it with a new kitchen
addition, in accordance with the plans considered by the Local Architectural Conservation
Advisory Committee on September 13, 1996; and further
That a photographic record and measured drawings of the existing kitchen wing be prepared prior
to demolition."
Mr. L. Bensason advised that he would take the photographs and the contractor has already taken
measurements of the footprint of the existing kitchen addition.

PIONEER TOWER WEST
Mr. L. Bensason spoke of the heritage names for streets in the proposed subdivisions in this area,
which are being considered. Some of the names include: Joseph Shirk Place, William Langdon
Drive, Pennisylvania Crescent or Court and Detteweiler Drive or Court. He advised that all names
supplied and approved by the Region will be used.
Mr. Bensason then referred to a map supplied to the Committee, stating that the area outlined in
yellow is the proposed boundary for the heritage conservation district in the Pioneer Tower West
area.
Councillor T. Galloway then stated that the Pioneer Tower West area is coming together. The
matter is going to Planning Committee on November 4, 1996; also, the OMB hearings will take
place in January and the Board has set aside 6 weeks for these hearings.
Mr. Bensason then referred to the map supplied to the Committee members and Councillor M.
Wagner reminded the Committee that this study is to be done in house. A discussion then took
place over whether or not the lands in public ownership would be included in the area of study.
Mr. L. Bensason advised that he has been contacted by the federal government for a
recommendation on a federal designation in this area and questioned whether it should be the
same as the proposed heritage conservation district boundaries. He reminded the Committee
members that a federal designation does not prevent alteration but only recognizes the
significance of the area. He requested of the Committee their recommendation concerning the
area to be studied for the heritage conservation district and a recommendation to be forwarded to
the federal government concerning their designation.
On motion by Mr. R. Coo
it was resolved:
"That, pursuant to Section 40 of the Ontario Heritaqe Act, R.S.O. 1990, the City Solicitor be
directed to prepare a by-law to define the Pioneer Tower West area as an area to be
examined for future designation as a heritage conservation district; and further
That the area to be defined shall generally be as shown on the plan considered by the Local
Architectural Conservation Advisory Committee on September 13, 1996."
On motion by Mr. R. Coo
it was resolved:
"That a copy of the by-law, defining the Pioneer Tower West area as an area to be examined for
future designation as a heritage conservation district, pursuant to the Ontario Heritaqe Act, be
forwarded to the Historic Sites and Monuments Board of Canada for their consideration and
recommendation for a designation of national historic significance."
COMMUNITY HERITAGE ONTARIO CONFERENCE
Councillor M. Wagner advised that Community Heritage Ontario is looking for someone from
Kitchener L.A.C.A.C. to be voted to their Board. If any of the members would be interested in such
a position they were asked to contact Mr. Bensason or Councillor M. Wagner. Councillor M.
Wagner advised that the Board meets every other month in Kleinberg.
22 COURTLAND AVENUE WEST
Mr. L. Bensason advised that a sub-committee is required to review the property, currently vacant,
at Queen, Courtland and David, municipally known as 22 Courtland Avenue West. Mr. Bensason
advised that the owners are at the stage where a site plan has been submitted for approval, for
two 14 storey apartment buildings. Mr. Bensason suggested that the sub-committee be composed
of a L.A.C.A.C. member plus one or two members of the Victoria Park Area Heritage Conservation
District steering committee. Mr. R. Coo advised that he would be interested in volunteering for this
sub-committee.

EVALUATION SUB-COMMITTEE REPORT
The Committee members were provided two lists of properties in the downtown area one of which
is being recommended for addition to the Heritage Inventory. Ms. Burke advised that the
evaluation sub-committee met for approximately 4 1/2 hours and processed over 100 buildings.
On motion by Ms. S. Burke

Ms. Burke then advised that the properties listed on the pink sheet were not inventoried and need
to be reviewed to see if they should be left on the Heritage Inventory.
RECORDING AREA
Mr. L. Bensason advised that the recording packages for the last recording area for this year are
available and are the second part of the Mount Hope/Huron Park Area.
