2. Commencement
The Planning and Strategic Initiatives Committee held a meeting this date
commencing at 5:03 p.m.
3. Disclosure of Pecuniary Interest and the General Nature Thereof
There were no conflicts declared.
4. Consent Items
4.1 Draft Plan of Condominium 30CDM-23202, 630 and 690 Benninger Drive,
Activa Holdings Inc., DSD -2023-252
The Committee considered Development Services Department report DSD -2023-
252, dated May 19, 2023, recommending draft approval be granted for
Condominium Application 30CDM-23202, for the properties municipally
addressed as 630 and 690 Benninger Drive.
Moved by Councillor A. Clancy
it was resolved:
"That the City of Kitchener, pursuant to Section 51(31) of the Planning Act
R.S.O. 1990, c.P.13, as amended, and By-law 2005-170, as amended by
By-law 2007-042, hereby grants draft approval to Condominium
Application 30CDM-23202 for the property municipally addressed as 630
and 690 Benninger Drive in the City of Kitchener, subject to the conditions
shown in Appendix "A" of Development Services Department report DSD -
2023 -252."

5. Discussion Items
5.1 Inclusionary Zoning - Policy and Implementation Directions, DSD -2023-258
The Committee considered Development Services Department report DSD -2023-
258, dated June 8, 2023, recommending that staff in coordination with the Cities
of Waterloo and Cambridge; and the Region of Waterloo, develop a draft
Inclusionary Zoning Official Plan policy and implement Zoning By-law
amendments, for Council's consideration. In addition, the Committee was in
receipt of written submissions from D. Parker and M. Schroeder.
T. Donegani was in attendance and provided a presentation on the proposed
inclusionary zoning policy and implementation.

G. Stevenson and N. Goss were also in attendance to respond to questions from
the Committee.
D. Parker was in attendance and provided comments noting there are meagre
opportunities for affordable housing thus, urged the Committee to implement
inclusionary zoning to the maximum extent. Specifically, D. Parker suggested
that inclusionary zoning be implemented (as feasible) in all Major Transit Station
Areas (MTSAs) with no ramp -up period, that inclusionary zoning be applied to all
buildings having 10 units or more and lastly, that the MTSA boundaries be
expanded to 800 meters. Further, D. Parker noted that there should be
engagement with households potentially impacted by inclusionary zoning
legislation.
Councillor A. Owodunni left the meeting and re-entered.
In response to questions from the Committee, T. Donegani noted the MTSA
boundaries outlined in the report were reviewed by the previous Council through
the Regional Official Plan review and further, was approved by the Minister of
Municipal Housing and Affairs. As such, it was noted the outlined MTSA
boundaries are in full force and effect thus, cannot be modified.
T. Donegani noted that the proposed inclusionary zoning policy is intended to
strike a balance between providing affordable housing and addressing the
current the housing supply reality, where construction costs and interest rates are
significantly high.
Mayor B. Vrbanovic left the meeting at this time.
In response to questions regarding the policy parameter of operating off-site
units, T. Donegani noted there is no jurisdiction for developers to pay cash in lieu
to the municipality for inclusionary zoning use.
T. Donegani highlighted the importance of the inclusionary zoning policy being
responsive and adaptive to changes in the market and regulatory environment
thus noted, Staff will report back to Council every other year to bring forward any
changes to the policy as needed.
Councillor D. Chapman asked that Staff review its' recommendation and
suggested the inclusionary zoning policy be required for buildings having 10 or
more residential units rather than 50. Further, that the set aside rate begin at 5%
due to the significant need for affordable housing.
Councillor P. Singh left the meeting at this time. Councillor S. Davey assumed
Chair.

it was resolved:
"That staff, in coordination with the Cities of Waterloo and Cambridge; and
the Region of Waterloo, be directed to use the Discussion Paper in
Attachment 1 as the basis for further consultation with the development
industry, affordable housing providers, other affected groups and the
public, as outlined in Development Services Department report DSD -
2023 -258; and further,
That staff, in coordination with the Cities of Waterloo and Cambridge; the
Region of Waterloo, be directed to develop a draft Inclusionary Zoning
Official Plan policy and implementing Zoning By-law amendments, for
Council's consideration, in accordance with the directions set out in the
Discussion Paper of Attachment A of Development Services Department
Report, DSD -2023-258, and with consideration of the results of the
consultation process and any subsequent analysis."

5.2 Growing Together - Engagement Summary Report Overview, DSD -2023-251
The Committee considered Development Services Department report DSD -2023-
251, dated May 19, 2023, recommending that staff use the community input as
summarized in the 'Growing Together Engagement Summary' to inform
continued work on Growing Together. In addition, the Committee was in receipt
of written submissions from G. Wheeler and P. Nickels, Victoria Park
Neighbourhood Association Development Committee.
A. Clark provided an overview of the Growing Together engagement noting,
workshops consisted of a geographically accurate 3D printed model of
Kitchener's Major Transit Station Areas with existing buildings accurately
represented at a 1:1000 scale. Participants were asked to place housing units on
the model, represented by low, mid and high-rise building typologies. A. Clark

highlighted themes that emerged from these workshops including broad support
for growth and intensification within the MTSAs with walkable, vibrant, transit -
oriented development and a need for availability of parkland to be considered as
the city grows. Engagement also revealed concern for housing affordability and
access to a variety of housing styles and lastly, the importance of community
infrastructure keeping pace with new growth, particularly schools, hospitals, and
grocery stores. N. Goss, G. Stevenson, J. Zunic and R. Kelly-Ruetz were also in
attendance to respond to questions from the Committee.
S. Burrows was in attendance and provided comments about the workshops,
noting the information presented did not clearly outline the implications of
residents placing developments in certain areas. S. Burrows expressed concern
for the reduction of parklands in the downtown core and the increase in narrow
streets and sidewalks. Further, S. Burrows expressed concern that 15 -minute
cities are being exacerbated.
Councillor A. Owodunni left the meeting at this time and re-entered.

it was resolved:
"That staff use the community input as summarized in the Growing
Together Engagement Summary, attached as Attachment W on
Development Services Department report DSD -2023-251, to inform
continued work on Growing Together."

6. Public Hearing Matters under the Planning Act (advertised)
This is a formal public meeting to consider applications under the Planning Act.
If a person or public body does not make oral or written submissions to the City
of Kitchener before the proposed applications are considered, the person or
public body may not be entitled to appeal the decision to the Ontario Land
Tribunal and may not be added as a party to a hearing of an appeal before the
Ontario Land Tribunal.
6.1 Plan of Subdivision Application 30T-22202 and Zoning By-law Amendment
Application ZBA22/021/N/KA, 1000 New Dundee Road, Cache
Developments (New Dundee) Inc., DSD -2023-237
The Committee considered Development Services Department report DSD -2023-
237, dated June 19, 2023, recommending that draft approval to Plan of
Subdivision Application 30T-22202 be granted, and that Zoning By-law
Amendment Application ZBA22/021/N/KA be adopted, for Cachet Developments
(New Dundee) Incorporated.
K. Anderl was in attendance and provided an overview of the applications. G.
Stevenson and T. Malone -Wright were in attendance to respond to questions
from the Committee.
S. Matveena, Glenn Schnarr and Associates Incorporated was in attendance in
support of the staff recommendation and provided a presentation summarizing
the details of the application. J. Ha Kong was also in attendance in support of the
staff recommendation.
In response to concerns from the Committee regarding the singular access to the
proposed development, K. Anderl noted a transportation impact study was
conducted and findings indicate that only one access is appropriate due to
visibility requirements. K. Anderl noted, a secondary access will be available only
for emergency purposes.
In response to questions from the Committee regarding the provision of non-
vehicular transit, K. Anderl noted future Regional improvement projects are
planned for the subject area. It was noted, the City also continually advocates for
the inclusion of bike lanes and sidewalks.
Moved by Councillor C. Michaud
it was resolved:
"That the City of Kitchener, pursuant to Section 51 (31) of the Planning
Act R.S.O. 1990, Chapter P 13 as amended, and delegation By-law 2002-
64, grant draft approval to Plan of Subdivision Application 30T-22202 in
the City of Kitchener, for the property municipally addressed as 1000 New
Dundee Road, for Cachet Developments (New Dundee) Incorporated,
subject to the conditions attached to Development Services Department
report DSD -2023-237 as Appendix "A", and further,
That Zoning By-law Amendment Application ZBA22/021/N/KA to amend
Zoning By-law 2019-051 for Cachet Developments (New Dundee)
Incorporated, for the property municipally addressed as 1000 New
Dundee Road be approved in the form shown in the "Proposed By-law"
and "Map No. 1" attached to Development Services Department report
DSD -2023-237 as Appendix "B"."
