Mills, Committee Coordinator _____________________________________________________________________ 1. Commencement The Heritage Kitchener Committee held a meeting this date commencing at 4:01 p.m. 2. Disclosure of Pecuniary Interest and the General Nature Thereof 2.1 A. Portengen - Heritage Permit Application-2024-IV-01, 25 Joseph Street, Replacement of Windows, DSD-2024-052 A. Portengen declared a pecuniary interest with respect to Heritage Permit Application-2024-IV-01, 25 Joseph Street, Replacement of Windows, DSD-2024- 052 on the agenda this date as he is a member of the Board of Directors for 1 Kitchener Housing Inc., the owner of the subject property. Accordingly, A. Portengen did not participate in any discussion or vote regarding this matter. 3. Discussion Items 3.1 Heritage Permit Application-2024-IV-01, 25 Joseph Street, Replacement of Windows, DSD-2024-052 A. Portengen declared a conflict on this item. (A. Portengen declared a pecuniary interest with respect to Heritage Permit Application-2024-IV-01, 25 Joseph Street, Replacement of Windows, DSD-2024-052 on the agenda this date as he is a member of the Board of Directors for Kitchener Housing Inc., the owner of the subject property. Accordingly, A. Portengen did not participate in any discussion or vote regarding this matter.) The Committee considered Development Services Department report DSD-2024- 052, dated January 12, 2024 recommending the replacement of windowpanes on the property municipally address as 25 Joseph Street. J. Vieira presented an overview of the staff report. G. Stevenson and S. Bassanese were also in attendance to respond to questions from the Committee. It was noted the recommendation arising from this matter would be processed under Delegated Approval Authority as it received unanimous consent from the Committee. Moved by Councillor D. Chapman it was resolved: "That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2024-IV-01 be approved to permit the replacement of seven windowpanes on the property municipally addressed as 25 Joseph Street." Carried unanimously 3.2 Notice of Intention to Demolish, 1027 King Street East, DSD-2024-057 A. Portengen re-entered the meeting at this time. The Committee considered Development Services Department report DSD-2024- 057, dated January 18, 2024 recommending the Notice of Intention to Demolish received on January 18, 2024, and dated January 17, 2024 regarding the property municipally addressed as 1027 King Street East, be received for information and that the notice period run its course. 2 J. Vieira presented an overview of the staff report noting the subject property is currently listed on the Municipal Heritage Register as a non-designated property of cultural heritage value or interest. J. Vieira noted the Notice of Intention to Demolish has been submitted as part of a re-development proposal for the construction of a new mixed-use building having two towers, 11 and 29 storeys in height. J. Vieira noted a Heritage Impact Assessment was completed for the proposed redevelopment and presented to the Heritage Kitchener Committee on January 4, 2022 and there were no concerns or comments raised. Further, it was noted only one portion of the existing building has been identified as having cultural heritage value or interest however, retention of this portion of the building is not feasible as it relies on adjacent sections of the building for structural stability. As a result, documentation, salvage, and commemoration have been recommended as mitigation measures of retaining heritage values of the existing building. J. Vieira noted the Ontario Heritage Act does not permit Council to approve or refuse a Notice of Intention to demolish rather, Council has the option to either request further information related to the demolition or receive the Notice of Intention to Demolish, allowing the notice period to run its course, at the end of which the Building Division may issue a demolition permit or Council may issue a Notice of Intention to Designate, at which point Council would have the authority to deny demolition. J. Viera noted Staff recommend the Notice of Intention to Demolish be received and the notice period run its' course. G. Stevenson and S. Bassanese were also in attendance and responded to questions from the Committee. The Committee noted the property has significant heritage value and is a landmark of Art Deco architectural style in the City of Kitchener thus, should be retained. The Committee noted further work could be done to ensure portions of buildings with heritage significance are innovatively incorporated into new building designs rather than being demolished. It was noted any recommendation arising from this matter would be considered at the Council meeting taking place on February 12, 2024. Moved by A. Portengen it was resolved: "That, in accordance with Section 27(3) of the Ontario Heritage Act, the Notice of Intention to Demolish received on January 18, 2024, and dated January 17, 2024 regarding the property municipally addressed as 1027 King Street East, be received for information and that the notice period run 3 its course, as outlined in Development Services Department report DSD- 2024-057." LOST on a tie 3.3 Bill 23 Municipal Heritage Register Review - February 2024 Update, DSD- 2024-056 The Committee considered Development Services Department report DSD-2024- 056, dated January 15, 2024 recommending designation be pursued for the properties municipally addressed as 91 Madison Avenue South and 23 Water Street North, as being of cultural heritage value or interest, under Part IV of the Ontario Heritage Act. J. Vieira presented an overview of the staff report. G. Stevenson and S. Bassanese were also in attendance to respond to questions from the Committee. Councilor D. Chapman requested that a motion for each property be voted on separately. The following motions were then voted on and were Carried unanimously. Moved by N. Pikulski it was resolved: "That pursuant to Section 29 of the Ontario Heritage Act, the cultural heritage value or interest be recognized, and designation pursued for property municipally addressed as 91 Madison Avenue South. Carried unanimously Moved by I. Bodendorfer it was resolved: "That pursuant to Section 29 of the Ontario Heritage Act, the cultural heritage value or interest be recognized, and designation pursued for property municipally addressed as 23 Water Street North. Carried unanimously 3.4 2023-2026 Strategic Plan Committee Areas of Interest & 2024 Heritage Kitchener Committee Workplan 4 G.
