1. Commencement
The Heritage Kitchener Committee held a meeting this date commencing at 4:05
p.m.
2. Disclosure of Pecuniary Interest and the General Nature Thereof
3. Discussion Items
3.1 Heritage Permit Application HPA-2024-IV-002, 1385 Bleams Road, Removal
of Chimney and Fence, DSD-2024-088
The Committee considered Development Services Department report DSD-2024-
088, dated February 12, 204, recommending approval of Heritage Permit

Application (HPA) HPA-2024-IV-002 to permit the removal of chimney and the
fence on the property municipally addressed as 1385 Bleams Road.
D. Choudhry presented an overview of the report. G. Stevenson and S.
Bassanese were also in attendance to respond to questions from the Committee.
O. Scott, CHC Limited was in attendance in support of the staff recommendation
and responded to questions from the Committee.
In response to questions from the Committee, D. Choudhry noted salvaging of
the fence is not possible as it is extremely damaged. Further, it was noted
replication of the fence falsifies its' Heritage value.
It was noted the recommendation arising from this matter would be processed
under Delegated Approval Authority as it received unanimous consent from the
Committee.
Moved by D. Vongphakdy
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit
Application HPA-2024-IV-002, as outlined in Development Services
Department report DSD-2024-088, be approved to permit the removal of
chimney and the fence on the property municipally addressed as 1385
Bleams Road in accordance with the supplementary information submitted
with this application."
Carried unanimously
3.2 Heritage Permit Application HPA-2024-IV-003, 300 Joseph Schoerg
Crescent, One-Storey Rear Addition and Two-Storey Deck, DSD-2024-090
The Committee considered Development Services Department report DSD-2024-
088, dated February 12, 204, recommending approval of Heritage Permit
Application (HPA) HPA-2024-IV-002 to permit the removal of chimney and the
fence on the property municipally addressed as 1385 Bleams Road.
J. Vieira presented an overview of the report. G. Stevenson and S. Bassanese
were also in attendance to respond to questions from the Committee.
L. Passmore, Frey Building Contractors was in attendance in support of the staff
recommendation and responded to questions from the Committee.

It was noted the recommendation arising from this matter would be processed
under Delegated Approval Authority as it received unanimous consent from the
Committee.
Moved by I. Bodendorfer
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit
Application HPA-2024-IV-003, as outlined in Development Services
Department report DSD-2024-090, requesting permission for:
1. The demolition of an existing rear deck and concrete slab; and
2. Construction of a new one-storey rear addition and second-storey deck
on the property municipally addressed as 300 Joseph Schoerg Crescent,
BE APPROVED in accordance with the supplementary information
submitted with the application and subject to the following conditions:
a. That final building permit drawings be reviewed, and heritage
clearance provided by Heritage Planning staff prior to the issuance of a
building permit."
Carried unanimously
3.3 Notice of Intention to Designate - 60 Victoria Street North under Part IV of
the Ontario Heritage Act, DSD-2024-089
The Committee considered Development Services Department report DSD-2024-
089, dated February 15, 2024 recommending a Notice of Intention to Designate
60 Victoria Street North as being of cultural heritage value or interest, under Part
IV of the Ontario Heritage Act.
J. Vieira, Heritage Planner presented an overview of the staff report. G.
Stevenson and S. Bassanese were also in attendance to respond to questions
from the Committee.
L. Wells, Region of Waterloo provided a presentation in support of the staff
recommendation.
It was noted any recommendation arising from this matter would be considered
at the Council meeting taking place on March 18, 2024.
Moved by N. Pikulski
it was resolved:

"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be
directed to publish a Notice of Intention to Designate the property
municipally addressed as 60 Victoria Street North as being of cultural
heritage value or interest, as outlined in Development Services
Department report DSD-2024-089."

3.4 Notice of Intention to Designate - 72 Victoria Street South under Part IV of
the Ontario Heritage Act, DSD-2024-091
The Committee considered Development Services Department report DSD-2024-
091, dated February 13, 2024 recommending a Notice of Intention to Designate
72 Victoria Street North as being of cultural heritage value or interest, under Part
IV of the Ontario Heritage Act.
J. Vieira, Heritage Planner presented an overview of the staff report. G.
Stevenson and S. Bassanese were also in attendance to respond to questions
from the Committee.
It was noted any recommendation arising from this matter would be considered
at the Council meeting taking place on March 18, 2024.
Moved by Councillor D. Chapman
it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be
directed to publish a Notice of Intention to Designate the property
municipally addressed as 72 Victoria Street South as being of cultural
heritage value or interest, as outlined in Development Services
Department report DSD-2024-091."

3.5 Notice of Intention to Designate - 33 Eby Street South under Part IV of the
Ontario Heritage Act, DSD-2024-094
The Committee considered Development Services Department report DSD-2024-
094, dated February 14, 2024 recommending a Notice of Intention to Designate
33 Eby Street South as being of cultural heritage value or interest, under Part IV
of the Ontario Heritage Act.

from the Committee.
It was noted any recommendation arising from this matter would be considered
at the Council meeting taking place on March 18, 2024.

it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be
directed to publish a Notice of Intention to Designate the property
municipally addressed as 33 Eby Street South as being of cultural
heritage value or interest, as outlined in Development Services
Department report DSD-2024-094."

3.6 Bill 23 Municipal Heritage Register Review - March 2024 Update, DSD 2024-
093
The Committee considered Development Services Department report DSD-2024-
093, dated February 15, 2024 recommending designation be pursued for the
properties municipally addressed 35 Courtland Avenue West and 131 Victoria
Street South, as being of cultural heritage value or interest, under Part IV of the
Ontario Heritage Act.
D. Choudhry, Heritage Planner presented an overview of the staff report. G.
Stevenson and S. Bassanese were also in attendance to respond to questions
from the Committee. It was noted that at the Committee's approval Staff would
contact the property owners advising of the intention to designate.
J. Halboom raised a matter related to non-designated heritage properties listed in
the municipal heritage register, noting the Ontario Heritage Act requires that any
heritage property listed on a municipal register as of December 31, 2022 shall be
removed from the register on January 1, 2025, if the Council of the municipality
has not given a notice of intention to designate the property under subsection
29(1) of the Ontario Heritage Act. Properties that are removed from the Register
cannot be re-listed for another five years.
Councillor D. Chapman advised the Committee she would be bringing forward a
Notice of Motion at the March 18, 2024 Council meeting, requesting City Council
lobby the Province to amend the Ontario Heritage Act to grant municipalities an

additional five years to consider the designation of properties listed in the
Heritage Register. Further, Councillor D. Chapman noted this matter is being
brought forward to Councils of several municipalities across Ontario. The
Committee expressed its' support for the Notice of Motion.
Moved by D. Vongphakdy
it was resolved:
"The pursuant to Section 29 of the Ontario Heritage Act, the cultural
heritage value or interest be recognized, and designation pursued, as
outlined in Development Services Department report DSD-2024-093, for
the following properties:
o 35 Courtland Avenue West
o 131 Victoria Street South."

At the request of Staff, the Committee agreed to reschedule its' June 4, 2024
meeting to June 11, 2024.
