1. Commencement
The Heritage Kitchener Committee held a meeting this date commencing at 4:02
p.m.
2. Disclosure of Pecuniary Interest and the General Nature Thereof
2.1 A. Portengen - Notice of Intention to Designate - 10 Duke Street West under
Part IV of the Ontario Heritage Act, DSD -2024-133
A. Portengen declared a pecuniary interest with respect to Notice of Intention to
Designate - 10 Duke Street West under Part IV of the Ontario Heritage Act, DSD -
2024 -133 on the agenda this date as his employer is the Civil engineer for a

redevelopment project at the subject property. Accordingly, A. Portengen did not
participate in any discussion or vote regarding this matter.
3. Discussion Items
3.1 Draft Heritage Impact Assessment (HIA) - 236-264 Victoria Street North,
DSD -2024-117
The Committee considered Development Services Department report DSD -2024-
117, dated March 5, 2024 regarding a Heritage Impact Assessment (HIA) for the
properties municipally addressed as 236-264 Victoria Street North which are
non -designated properties of cultural heritage value or interest on the Kitchener
Municipal Heritage Register. The subject lands are, however, located within the
Warehouse District Cultural Heritage Landscape (CHL) and are adjacent to
heritage resources.
J. Vieira presented an overview of the Heritage Impact Assessment (HIA),
advising it has been submitted in support of a Planning Application related to a
proposed mixed-use development comprised of three towers ranging 18-40
storeys in height. J. Vieira indicated staff in attendance this date are seeking the
Committee's feedback on the HIA. G. Stevenson, S. Bassanese and M. Drake
were also in attendance to respond to questions from the Committee.
G. Smith was in attendance in support of the staff recommendation. In response
to questions from the Committee, G. Smith noted a building is proposed to be
demolished to facilitate the mixed-use development. It was noted the subject
building was evaluated against Ontario Regulation 9/06 and was determined to
meet only one criteria, that is, association with a factory significant to the
community. G. Smith noted the factory building has been significantly altered and
no longer retains its' heritage integrity thus, commemoration of the subject lands
will be pursued.
The Committee raised concerns regarding the impact of shadows on heritage
resources surrounding the proposed development. In response, J. Vieira noted
shadows will be cast for brief periods of time during the summer months
however, shadows will not obscure the view of identified heritage attributes in the
subject area, as outlined in the shadow impact study attached to the staff report.
3.2 Heritage Permit Application HPA-2024-IV-006, 1385 Bleams Road, Removal
of Garage, DSD -2024-148
The Committee considered Development Services Department report DSD -2024-
148, dated March 20, 2024 recommending approval of Heritage Permit

Application (HPA) HPA-2024-IV-006 to permit the demolition of a garage on the
property municipally addressed as 1385 Bleams Road.
D. Choudhry presented an overview of the report noting the property is
designated under Part IV of the Ontario Heritage Act. D. Choudhry noted the
garage proposed to be demolished has no cultural heritage value and is not
protected by the designating By-law however, the Ontario Heritage Act requires
that any demolition on a designated property be approved by City Council. D.
Choudhry noted demolition of the garage will not impact the property's cultural
heritage attributes. G. Stevenson, S. Bassanese and M. Drake were also in
attendance to respond to questions from the Committee.
It was noted the recommendation arising from this matter would be processed
under Delegated Approval Authority as it received unanimous consent from the
Committee.
Moved by Councillor C. Michaud
it was resolved:
"That pursuant to Section 34 of the Ontario Heritage Act, Heritage Permit
Application HPA-2024-IV-006 be approved to permit the demolition of the
garage on the property municipally addressed as 1385 Bleams Road in
accordance with the supplementary information submitted with the
application, as outlined in Development Services Department report DSD -
2024 -148."

3.3 Notice of Intention to Designate - 10 Duke Street West under Part IV of the
Ontario Heritage Act, DSD -2024-133
A. Portengen declared a conflict on this item. (A. Portengen declared a pecuniary
interest with respect to Notice of Intention to Designate - 10 Duke Street West
under Part IV of the Ontario Heritage Act, DSD -2024-133 on the agenda this date
as his employer is the Civil engineer for a redevelopment project at the subject
property. Accordingly, A. Portengen did not participate in any discussion or vote
regarding this matter.)
The Committee considered Development Services Department report DSD -2024-
133, dated March 11, 2024 recommending a Notice of Intention to Designate 10
Duke Street West as being of cultural heritage value or interest, under Part IV of
the Ontario Heritage Act be published.

J. Vieira presented an overview of the report. G. Stevenson, S. Bassanese and
M. Drake were also in attendance to respond to questions from the Committee.
It was noted any recommendation arising from this matter would be considered
at the Council meeting taking place on April 8, 2024.

it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be
directed to publish a Notice of Intention to Designate the property
municipally addressed as 10 Duke Street West as being of cultural
heritage value or interest, as outlined in Development Services
Department report DSD -2024-133."
Carried unanimously
3.4 Notice of Intention to Designate - 91 Madison Avenue South under Part IV
of the Ontario Heritage Act, DSD -2024-138
The Committee considered Development Services Department report DSD -2024-
138, dated March 12, 2024 recommending a Notice of Intention to Designate 91
Madison Avenue South as being of cultural heritage value or interest, under Part
IV of the Ontario Heritage Act be published.
J. Vieira presented an overview of the report. G. Stevenson, S. Bassanese and
M. Drake were also in attendance to respond to questions from the Committee.
It was noted any recommendation arising from this matter would be considered
at the Council meeting taking place April 8, 2024.

it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be
directed to publish a Notice of Intention to Designate the property
municipally addressed as 91 Madison Avenue South as being of cultural
heritage value or interest, as outlined in Development Services
Department report DSD -2024-138."

3.5 Bill 23 Municipal Heritage Register Review - April 2024 Update, DSD -2024-
131
The Committee considered Development Services Department report DSD -2024-
131, dated March 8, 2024 recommending the cultural heritage value or interest
be recognized, and designation be pursued for: 56 Duke Street West, 156 Duke
Street West, 7 Fischer Court and 11-15 Pandora Avenue North.
D. Choudhry, J. Vieira and M. Drake presented an overview of the report. G.
Stevenson and S. Bassanese were also in attendance to respond to questions
from the Committee.
In response to questions from the Committee, J. Vieira provided an overview of
the heritage designation process noting Staff contact owners of properties being
considered for heritage designation at least four times advising them of the
intention to designate, and to provide an opportunity for property owners to raise
concerns or objections to the designation. Further, J. Vieira noted, the Ontario
Heritage Act only mandates that property owners be contacted twice regarding
the intention to designate.
It was requested that a motion for each property be voted on separately.
It was noted Staff will contact the subject property owners advising of the
intention to designate.

heritage value or interest be recognized, and designation be pursued
for 56 Duke Street West, as outlined in Development Services

for 11-15 Pandora Avenue North, as outlined in Development Services
Department report DSD -2024-131."

3.6 Bill 23 Municipal Heritage Register Review -April 2024 Update (Continued)
J. Vieira provided an update on the work to date that has been completed by the
Committee and Heritage Planning staff related to the Bill 23 Municipal Heritage
Register Review noting:
• The Committee has considered 51 of the 80 properties intended to be
reviewed for heritage designation this date.
• 22 properties have been fully designated.
• 14 properties are currently undergoing the designation process and are at
various stages of completion.
• No action has been taken on 15 properties this date.
Staff provided property assignments to the Committee and requested the
Committee provide evaluations of their assigned properties at the May 7, 2024
Heritage Kitchener Meeting.
