Blake, Committee Administrator M. Mills, Committee Administrator 1 1. Commencement A meeting of City Council was held at 3:57 p.m. this date, chaired by Mayor B. Vrbanovic. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. The meeting began with a Land Acknowledgement given by the Mayor. 2. Disclosure of Pecuniary Interest and the General Nature Thereof None. 3. Mayoral Business and Updates - Mayor B. Vrbanovic None. 4. In -camera Meeting Authorization Moved by Councillor M. Johnston Seconded by Councillor J. Deneault "That an in -camera meeting of City Council be held immediately following the special council meeting this date to consider a personal matter about an Identifiable individual, including municipal employees as authorized by Section 239 (2) (b) and to receive education and training as authorized by Section (3.1) of the Municipal Act, 2001, respectively." Carried 5. Recess and Reconvene The Special Council meeting recessed at 4:01 p.m. and reconvened at 8:08 p.m., chaired by Mayor B. Vrbanovic with all members present. Councillors B. loannidis and A. Owodunni were in attendance virtually. 6. Disclosure of Pecuniary Interest and the General Nature Thereof 6.1 Councillor P. Singh - Item 7.1 Inclusionary Zoning Policies - 200 Victoria Street South, DSD -2024-149 Councillor P. Singh declared a conflict with regards to Inclusionary Zoning Policies - 200 Victoria Street South, including the associated By-laws included on the agenda for three readings, as he has family that owns property within the vicinity, and he did not participate in any voting or discussion on the matter. E 6.2 Councillor D. Chapman - Item 7.1 Inclusionary Zoning Policies - 200 Victoria Street South, DSD -2024-149 Councillor D. Chapman declared a conflict with regards to Inclusionary Zoning Policies - 200 Victoria Street South, including the associated By-laws included on the agenda for three readings, as she owns property within the vicinity, and she did not participate in any voting or discussion on the matter. 7. Staff Reports 7.1 Inclusionary Zoning Policies - 200 Victoria Street South, DSD -2024-149 Councillor P. Singh declared a conflict on this item. (Councillor P. Council considered Development Services Department report DSD -2024-149, entitled Supplemental Report to DSD 2024-111 - Inclusionary Zoning for 97-101 Park Street and 186-194 Victoria Street South, dated March 21, 2024, recommending the property municipally addressed as 97-101 Park Street and 186-194 Victoria Street South be approved for an Official Plan Amendment and Zone Change to impose inclusionary zoning, as recommended at the January 29, 2024 Planning and Strategic Initiatives Committee, further considered at the March 18, 2024 Council meeting and deferred for consideration to this date. Victor Labreche, Arcadis Professional Services (Canada) Inc. addressed Council in opposition to the staff recommendation outlined in Supplemental Report DSD - 2024 -111, noting staff provided an alternative recommendation outlined in bullet three of the report highlights which have an alternative recommendation, to advance a site specific approach for affordable housing for these properties in line with its June 2023 decision, which were outlined in Attachments 'D' and 'E' of the report. V. Labreche stated they were in support of the alternative recommendation and requested Council adopt the site specific zoning for the subject property. 3 Moved by Councillor S. Davey Seconded by Councillor M. Johnston "That Official Plan and Zoning By-law amendments to exempt the lands at 97-101 Park Street and 186-194 Victoria Street South from inclusionary zoning requirements be approved in form included as Attachments 'D' and 'E' of Development Services Department report DSD -2024-149; and further, That pursuant to Section 35(17) of the Planning Act, R.S.O. C P.13, as amended further notice is not required to be given in respect of the Zoning By-law Amendment." Carried, as amended 7.2 Resolution of Support for AMO Board Nomination (Dan Chapman), CAO - 2024 -151 Moved by Councillor P. Singh Seconded by Councillor D. Chapman "That the Council of the City of Kitchener nominate Dan Chapman, Chief Administrative Officer, for the position of Secretary -Treasurer on the AMO Board of Directors for the 2024-2026 term, including the cost of reasonable expenses associated with Board membership, as outlined in Chief Administrative Officer report CAO -2024-051." Carried 8. Planning and Strategic Initiatives Committee Report Council considered the following matter arising from the Planning and Strategic Initiatives Committee meeting earlier this date. 8.1 Official Plan Amendment Application OPA23/020/K/KA, Zoning By-law Amendment Application ZBA23/035/K/KA, Enabling Four Units, DSD -2024- 066 Moved by Councillor P. Singh Seconded by Councillor D. Chapman "That City -Initiated Official Plan Amendment OPA23/020/K/KA, for the purpose of permitting up to 4 dwelling units on lots which permit a single detached dwelling, semi-detached dwelling or street -townhouse dwelling, M be adopted, in the form shown in the Official Plan Amendment attached to Development Services Department report DSD -2024-066 as Attachment `A', and accordingly forwarded to the Region of Waterloo for approval; and, That City Initiated Zoning By-law Amendment Application ZBA23/035/K/KA to amend Zoning By-law 85-1, be approved in the form shown in the "Proposed By-law" attached to Development Services Department report DSD -2024-066 as Attachment `B1'; and, That City Initiated Zoning By-law Amendment Application ZBA23/035/K/KA to amend Zoning By-law 2019-051, be approved in the form shown in the "Proposed By-law" attached to Development Services Department report DSD -2024-066 as Attachment `B2'; and further, That Staff provide data regarding the number of 4 -unit dwellings, including discrete Additional Dwelling Units constructed following approval of the "Proposed By-law" attached to Development Services Department report DSD -2024-066, and report back to the Planning and Strategic Initiatives Committee by the Fall of 2025 with additional recommendations, or to provide or information if no additional recommendations are proposed." Carried 9. By-laws At the request of D. Saunderson, Manager, Council and Committee Services, Deputy Clerk, Council agreed to consider the By-laws listed on the agenda this date under the heading late starter by-laws to be added to the agenda, as the reports of the Committees have been adopted and the associated By-laws also requiring approval. 9.1 Three Readings Due to the previously declared conflicts by Councillors P. Singh and D. Chapman, the By-laws related to Growing Together and Inclusionary Zoning were dealt with separately and they did not participate in any voting or discussion related to the By-laws. Michaud "That the by-laws be given third reading, namely: 10. 9.1.a Being a by-law to adopt Amendment No. 47 to the Official Plan (2014) - Enabling Four Units. (By-law 2024-072) 9.1.b Being a by-law to amend By-law 85-1, as amended, known as the Zoning By-law for the City of Kitchener. (By-law 2024-073) 9.1.c Being a by-law to amend By-law 2019-051, as amended, known as the Zoning By-law for the City of Kitchener — Enabling Four Units. (By-law 2024-074) 9.1.d Being a by-law to adopt Official Plan Amendment 134 - Inclusionary Zoning - 97-101 Park Street and 186-194 Victoria Street South (By-law 2024-075) 9.1.e Being a by-law to amend By-law 85-1 known as the Zoning By-law for the City of Kitchener — Inclusionary Zoning 97-101 Park Street and 186-194 Victoria Street South (By-law 2024-076) 9.1.f To confirm all actions and proceedings of the Council for March 25, 2024.
