1. Commencement
The Heritage Kitchener Committee held a meeting this date commencing at 4:01
p.m.
2.Disclosure of Pecuniary Interest and the General Nature Thereof
None.
3.Discussion Items
3.1Notice of Intention to Demolish Smokehouse -1478 Trussler Road, DSD-
2024-343

The Committee considered Development Services Department Report, DSD-
2024-343, dated July 8, 2024, recommending approval regarding the Notice of
Intention to demolition the Smokehouse located on the property municipally
addressed as 1478 Trussler Road.
M. Drake, Senior Planner presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
K. Doehn was in attendance in support of the staff recommendation.
M. Drake noted a revised Statement of Significance (SOS) was provided to the
Committee on June 11, 2024, as outlined in Attachment 'C' of Development
Services Department report, DSD-2024-343, and the Committee recommended
that designation under Part IV of the Ontario Heritage Act be pursued.
M. Drake stated the property owner raised objections to the proposed
designation, noting concerns related to the condition of the smoke house. For
this reason, the property owner advised they would be pursuing demolition of the
smokehouse. Heritage Planning staff agreed to revise the draft SOS (Attachment
C) based on discussions with the owner, information obtained onsite on June 25,
2024, and additional research. It was noted heritage planning staff committed to
sharing a revised draft SOS with the owner in September 2024.
In response to questions from the Committee, M. Drake stated a visual
inspection of the exterior and interior of the smoke house revealed significant
building deficiencies, including but not limited to: major cracks through parging
and mortar, missing bricks, step cracks and missing mortar, deteriorated/missing
asphalt shingles, shifting foundation and inappropriate mortar repairs.
It was noted the recommendation arising from this matter would be forwarded for
Council's consideration on August 26, 2024.
In response to further questions from the Committee, it was noted under the
Ontario Heritage Act, Council does not have the authority to approve or refuse an
owner’s Notice of Intention to Demolish. Rather, Council’s options include:
1. Receive the Notice of Intention to Demolish, allowing the notice period to
run its course, at the end of which the Building Division may issue a
demolition permit. And/Or,
2. Council may issue a Notice of Intention to Designate, at which point
Council would have the authority to deny demolition; however, the owner
could object to Council’s decision.

it was resolved:
"That, in accordance with Section 27(3) of the Ontario Heritage Act, the
Notice of Intention to Demolish received on June 28, 2024, regarding the
intent to demolish the smoke house located on the property municipally
addressed as 1478 Trussler Road, be received for information and that
the notice period run its course, as outlined in Development Services
Department report, DSD-2024-343"

3.2 Heritage Permit Application HPA-2024-V-014, 103 Lorne Crescent, Demolish
Detached One Car-Garage and Construction of New Shed, DSD-2024-345
The Committee considered Development Services Department Report DSD-
2024-345, dated July 15, 2024, recommending approval of a Heritage Permit
Application (HPA) HPA-2024-V-014 to permit the demolition of a detached one
car-garage and construction of a new shed on the property municipally
addressed as 103 Lorne Crescent.
M. Drake, Senior Planner, presented the report. K. Hoekstra, Student Planner,
and G. Stevenson, Director of Development and Housing Approvals, were also in
attendance to respond to questions from the Committee.
In response to questions from the Committee, M. Drake noted the application is
proposed to demolish the detached one-car garage and to construct a new shed
at the same location. It was noted the demolition and construction of the new
shed, would not negatively impact the heritage attributes of the subject property,
the Lorne Crescent streetscape, or the St. Mary’s Heritage Conservation District
in the opinion of Heritage Planning staff.
It was noted any recommendations arising from this matter would be forwarded
for Council's consideration on August 26, 2024.

it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit
Application HPA-2024-V-014 be approved to permit the demolition of a
detached one car-garage and construction of a new shed on the property
municipally addressed as 103 Lorne Crescent, in accordance with the

supplementary information submitted with the application, as outlined in
Development Services Department report, DSD, 2024-345."

3.3 Notice of Intention to Designate, 113-151 Charles Street West (Lang Site A),
DSD-2024-335
The Committee considered Development Services Department Report DSD-
2024-335, dated July 4, 2024, recommending a Notice of Intention to Designate
113-151 Charles Street West / 170-180 Joseph Street / 3-44 Francis Street South
(Lang Site A) as being of cultural heritage value or interest, under Part IV of the
Ontario Heritage Act be published.
M. Drake, Senior Planner presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
M, Drake noted an updated Statement of Significance describing the cultural
heritage value or interest of 113-151 Charles Street West / 170-180 Joseph
Street / 3-44 Francis Street South (Lang Site A) was brought to the Heritage
Kitchener Committee on June 11, 2024. The Committee recommended that
pursuant to Section 29 of the Ontario Heritage Act, the cultural heritage value or
interest of the subject properties should be confirmed by pursuing designation of
the property under Part IV of the Ontario Heritage Act.
It was noted any recommendations arising from this matter would be forwarded
for Council's consideration on August 26, 2024.

directed to publish a Notice of Intention to Designate the property

The Committee considered Development Services Department report DSD-2024-
339, dated July 4, 2024 recommending a Notice of Intention to Designate 148
Madison Avenue South as being of cultural heritage value or interest, under Part
IV of the Ontario Heritage Act be published.
M. Drake, Senior Planner presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
M. Drake noted an updated Statement of Significance describing the cultural
heritage value or interest of 148 Madison Avenue South has been drafted by
Heritage Planning staff, as attachment to Development Services Department
report, DSD-2024-340.
It was noted any recommendations arising from this matter would be forwarded
to Council for consideration on August 26, 2024.

339
The Committee considered Development Services Department report DSD-2024-
339, dated July 4, 2024 recommending a Notice of Intention to Designate 171-
173 Victoria Street North as being of cultural heritage value or interest, under
Part IV of the Ontario Heritage Act be published.

Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
M. Drake noted an updated Statement of Significance describing the cultural
heritage value or interest of 171-173 Victoria Street North has been drafted by

Heritage Planning staff, as attachment to Development Services Department
report, DSD-2024-339.
It was noted any recommendations arising from this matter would be forwarded
to Council for consideration on August 26, 2024.

3.6 Notice of Intention to Designate, 1738 Trussler Road, DSD-2024-341
The Committee considered Development Services Department report DSD-2024-
341, dated July 10, 2024 recommending a Notice of Intention to Designate 1738
Trussler Road, as being of cultural heritage value or interest, under Part IV of the
Ontario Heritage Act be published.
M. Drake, Senior Planner presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
M. Drake noted an updated Statement of Significance describing the cultural
heritage value or interest of 1738 Trussler Road has been drafted by Heritage
Planning staff, including feedback from the property owner, as attachment to
Development Services Department report, DSD-2024-341.
It was noted any recommendations arising from this matter would be forwarded
to Council for consideration on August 26, 2024.

3.7 Notice of Intention to Designate, 709 King Street West, DSD-2024-330
The Committee considered Development Services Department report DSD-2024-
330, dated July 19, 2024 recommending a Notice of Intention to Designate 709
King Street West, as being of cultural heritage value or interest, under Part IV of
the Ontario Heritage Act be published.
J. Vieira, Heritage Planner, presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
J. Vieira noted an updated Statement of Significance on the property’s cultural
heritage value was considered by the Heritage Kitchener Committee on June 11,
2024. It was noted at the June 11, 2024 Heritage Kitchener meeting, the
Committee recommended that pursuant to Section 29 of the Ontario Heritage
Act, the cultural heritage value or interest of 709 King Street West be recognized
and designation pursued.
It was noted any recommendation arising from this matter will be forwarded to
Council for consideration on August 26, 2024.

The Committee considered Development Services Department report DSD-2024-
336, dated July 2, 2024 recommending a Notice of Intention to Designate 83-85
King Street West, as being of cultural heritage value or interest, under Part IV of
the Ontario Heritage Act be published.
M. Drake, Senior Planner presented Development Services Department reports,
DSD-2024-336, DSD-2024-337, and DSD-2024-338 related to Notices of

Intention to Designate properties municipally addressed as 85-85 King Street
West, 87-91 King Street West, and 97-99 King Street West (items 3.8-3.10 on the
agenda this date). It was noted these properties are close in location and
possess similar design/physical, historical/associative, and contextual values. G.
Stevenson, Director of Development and Housing Approvals was also in
attendance to respond to questions from the Committee.
It was noted each recommendation for items 3.8-3.10 on the agenda this date
would be considered and voted on separately.
It was also noted any recommendation arising from this matter would be
forwarded to Council for consideration on August 26, 2024.

The Committee considered Development Services Department report DSD-2024-
337, dated July 2, 2024 recommending a Notice of Intention to Designate 87-91
King Street West, as being of cultural heritage value or interest, under Part IV of
the Ontario Heritage Act be published.
M. Drake, Senior Planner presented Development Services Department reports,
DSD-2024-336, DSD-2024-337, and DSD-2024-338 related to Notices of
Intention to Designate properties municipally addressed as 85-85 King Street
West, 87-91 King Street West, and 97-99 King Street West (items 3.8-3.10 on the
agenda this date). It was noted these properties are close in location and
possess similar design/physical, historical/associative, and contextual values. G.
Stevenson, Director of Development and Housing Approvals was also in
attendance to respond to questions from the Committee.

King Street West, as being a of culture heritage value or interest, under Part IV of
the Ontario Heritage Act be published.
M. Drake, Senior Planner presented Development Services Department reports,
DSD-2024-336, DSD-2024-337, and DSD-2024-338 related to Notices of
Intention to Designate properties municipally addressed as 85-85 King Street
West, 87-91 King Street West, and 97-99 King Street West (items 3.8-3.10 on the
agenda this date). It was noted these properties are close in location and
possess similar design/physical, historical/associative, and contextual values. G.

3.11 Notice of Intention to Designate, 103-109 King Street West, DSD-2024-331
The Committee considered Development Services Department report DSD-2024-
331, dated July 19, 2024 recommending a Notice of Intention to Designate 103-
109 King Street West, as being of cultural heritage value or interest, under Part
IV of the Ontario Heritage Act be published.
J. Vieira, Heritage Planner, presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
J. Vieira noted an updated Statement of Significance on the property’s cultural
heritage value was considered by the Heritage Kitchener Committee on June 11,
2024. It was noted at the June 11, 2024 Heritage Kitchener meeting, the
Committee recommended that pursuant to Section 29 of the Ontario Heritage
Act, the cultural heritage value or interest of 103-109 King Street West be
recognized and designation pursued.
It was noted that any recommendations arising from this matter would be
forwarded to Council for consideration on August 26, 2024.

3.12 Heritage Permit Application HPA-2024-V-015, 99 College Street, Construct a
Rear-Yard Addition, DSD-2024-324,
The Committee considered Development Services Department Report DSD-
2024-324, dated July 22, 2024, recommending a refusal of a Heritage Permit

Application (HPA) HPA-2024-V-015 to construct a rear-yard addition on the
property municipally addressed as 99 College Street.
D. Choudhry, Heritage Planner, presented the report. G. Stevenson, Director of
Development and Housing Approvals, was also in attendance to respond to
questions from the Committee.
D. Choudhry noted the proposed addition outlined in Heritage Permit Application,
HPA-2024-V-015, does not meet the policies related to new additions to existing
buildings, outlined in the Civic Centre Neighborhood Heritage Conservation
District Plan. It was noted approval of the subject HPA would have a negative
impact on the integrity of the Civic Centre Neighborhood Heritage Conservation
District.
S. Burrows, Facet Design Studio, addressed the Committee in opposition to the
staff recommendation, noting the construction of the rear yard addition would
create additional housing units, increase fire safety and would not have negative
impacts on the integrity of the Civic Centre Neighborhood Conservation District.
In response to questions from the Committee, S. Burrows stated the existing
chimney is not proposed to be demolished.
In response to questions from the Committee, D. Choudhry noted the proposed
addition and material of dark grey aluminum siding is incompatible with the
original structure.
In response to further questions, D. Choudhry stated despite the addition being
proposed to be located at the rear of the property, it will have a negative visual
impact on the existing home and street, and will be highly visible due to the size,
colour and design. It was noted the design of the roof is incompatible with the
existing building and due to its size and scale, the addition would most likely
dominate the original building.
It was noted any recommendations arising from this matter would be forwarded
to Council for consideration on August 26, 2024.

it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit
Application HPA-2024-V-015 be refused to construct a rear-yard addition
on the property municipally addressed as 99 College Street, in
accordance with the supporting information submitted with this application,
as outlined in Development Services Department report, DSD-2024-324."

3.13 Proposed Update to the Heritage Grant Program 2024, DSD-2024-332
The Committee considered Development Services Department report DSD-2024-
332, dated July 10, 2024 recommending that staff be directed to finalize changes
to the Designated Heritage Grant Program and associated guidelines with
Kitchener City Council as part of the 2025 Budget.
J. Vieira, Heritage Planner presented the report, noting staff are seeking input to
update the City’s Designated Heritage Grant Program (DHG Program) and to
implement new administration and operation guidelines as outlined in the draft
Program Guidelines for the Designated Heritage Property Grant, attached as
Appendix B of Development Services Department report, DSD-2024-332.
J. Vieira stated the recommended changes are as follows:
1. The existing maximum grant value which can be awarded to a successful
applicant is proposed to be increased from $3000 to $5000 per property
per year, subject to the availability of funding.
2. An increase to the annual capital budget allocation per year from $30k to
$90k to fund increased grants and introduce a new two-tiered system,
which would permit two $15k grants per year for Special Projects.
Staff provided an online survey to the Committee to receive input and feedback
on the proposed recommendations.
It was noted any recommendations arising from this matter would be forwarded
to Council for consideration on August 26, 2024.

"That staff be directed to finalize the draft revised Designated Heritage
Grant Program and associated guidelines, attached as Appendix B to
Development Services Department report, DSD-2024-332; and
That staff be directed to finalize changes to the Designated Heritage Grant
Program and associated guidelines with Kitchener City Council as part of
the 2025 Budget."

3.14Bill 23 Municipal Heritage Register Review -August 2024 Update, DSD
2024-333
The Committee considered Development Services Department report DSD-2024-
333, dated July 22, 2024 recommending cultural heritage value or interest be
recognized, and designation be pursed for the following properties: 83 Benton
Street, 107 Courtland Avenue East, 621 King Street West, 47 Onward Avenue,
33 Queen Street South, 44-54 Queen Street South, 148 Margaret Avenue, 100
Margaret Avenue, 104-106 Margaret Avenue, and 112 Margaret Avenue.
M. Drake, Senior Heritage Planner, presented the report, outlining the
design/physical, historical/associative and contextual values of the properties that
meet the criteria for designation under Ontario Regulation 9/06 (amended
through Ontario Regulation 569/22). G. Stevenson, Director of Development and
Housing Approvals, was also in attendance to respond to questions from the
Committee.
It was noted the recommendation arising from this matter would be processed
under Delegated Approval Authority if the recommendation receives unanimous
consent from the Committee.
