Disclosure of Pecuniary Interest and the General Nature Thereof 2.1 Councillor S. Stretch - Zoning By-law Amendment Application ZBA24/019/T/ES, 60 Trussler Road, 1000160668 Ontario Corp., DSD -2024- 432 Councillor S. Stretch declared a conflict with Item 6.2. Zoning By-law Amendment Application ZBA24/019/T/ES, 60 Trussler Road, 1000160668 Ontario Ltd, DSD - 2024 -432, due to owning property in close proximity, and did not participate in any voting or discussion related to the matter. 3. Consent Items 3.1 Private Street Naming, 980 and 1018 Hidden Valley Road, DSD -2024-325 The Committee considered Development Services Department report, DSD - 2024 -325, dated September 17, 2024, recommending that the City of Kitchener acknowledge that Evaya Developments Inc. intends to name a private street: "Bridlewood Crescent" within a multiple residential development located at 980 and 1018 Hidden Valley Road. On motion by Councillor S. Davey it was resolved: "That the City of Kitchener acknowledge that Evaya Developments Inc. intends to name a private street: "Bridlewood Crescent" within a multiple residential development located at 980 and 1018 Hidden Valley Road, as outlined in Development Services Department report, DSD -2024-325; and further, That the City's Legal Services division be directed to proceed with the required advertising, preparation, and registration of the necessary By-law for the naming of "Bridlewood Crescent"." Carried 3.2 Q24-122 Audit Services - FIN -2024-450 The Committee considered Financial Serviced Department report, FIN -2024-450, dated September 16, 2024, recommending that Quotation Q24-122 Audit Services, be awarded to KPMG LLP, Kitchener, ON, at their estimated fee of $589,300 plus HST of $76,609 for a total of $665,909 for a three (3) year term with an option to renew for two (2) additional one (1) year terms beginning with the fiscal year ending December 31, 2024. E On motion by Councillor S. Davey it was resolved: "That Quotation Q24-122 Audit Services, be awarded to KPMG LLP, Kitchener, ON, at their estimated fee of $589,300 plus HST of $76,609 for a total of $665,909 for a three (3) year term with an option to renew for two (2) additional one (1) year terms beginning with the fiscal year ending December 31, 2024, for the Corporation of the City of Kitchener, its Boards and Municipal Enterprises including the Waterloo Region Municipalities Insurance Pool with the fiscal year ending May 31, 2025, as outlined in Financial Services Department report, FIN -2024-450, and further; That Chapter 103 of the City of Kitchener's Municipal Code be amended to reflect the appointment of KPMG LLP as the City's Auditor for the fiscal years 2024, 2025, and 2026. Upon the recommendation of the Chief Financial Officer, Council may consider a by-law amendment to extend KPMG LLP's appointment for fiscal years 2027 and 2028 at the appropriate time." Carried 4. Discussion Items 4.1 None 5. Public Hearing Matters under the Planning Act (advertised) This is a formal public meeting to consider applications under the Planning Act. If a person or public body does not make oral or written submissions to the City of Kitchener before the proposed applications are considered, the person or public body may not be entitled to appeal the decision to the Ontario Land Tribunal and may not be added as a party to a hearing of an appeal before the Ontario Land Tribunal. 5.1 Zoning By-law Amendment Application ZBA24/018/T/TS, 9-27 Turner Avenue, 1000918377 Ontario Inc., DSD -2024-415 The Committee considered Development Services Department report, DSD - 2024 -415, dated September 9, 2024, recommending adoption of Zoning By-law Amendment Application ZBA24/018/T/TS, for the properties municipally addressed as 9-27 Turner Avenue. 3 T. Seyler, Senior Planner presented the report. T. Malone -Wright, Manager, Development Approvals, and G. Stevenson, Director, Development and Housing Approvals were also in attendance to respond to questions from the Committee. J. Hale was in attendance in support of the application. In response to questions from the Committee, G. Stevenson confirmed there are no sidewalks located on the South side of Turner Avenue at this time. G. Stevenson noted sidewalks would be implemented on both sides of the proposed development through road reconstruction projects, sidewalk infill construction or by the developer themselves, should the building be built prior to sidewalk construction. On motion by Councillor S. Davey it was resolved: "That Zoning By-law Amendment Application ZBA24/018/T/TS requesting to amend Zoning By-law 2019-051, for the property municipally addressed as 9-27 Turner Avenue, for 100918377 Ontario Inc. be approved in the form shown in the Proposed `Proposed By-law' and `Map No. 1' attached to Development Services Department report, DSD -2024-415 as Attachment `A'." The Committee considered Development Services Department report, DSD - 2024 -432, dated September 17, 2024, recommending adoption of Zoning By-law Amendment Application ZBA24/019/T/ES, for the property municipally addressed as 60 Trussler Road. E. Schneider, Senior Planner presented the report. T. Malone -Wright, Manager, Development Approvals, and G. Stevenson, Director, Development and Housing Approvals were also in attendance to respond to questions from the Committee. M S. Patterson, Patterson Planning Consultants provided a brief presentation in support of the application. In response to questions from the Committee, S. Patterson noted the proposed development provides both one -bedroom and two- bedroom units, noting there are no affordable housing units proposed for the development at this time. In response to further questions, S. Patterson confirmed the applicant will report back to Council regarding proposed sustainability features for the subject property. G. Schnek, D. Thomas and S. Harvey addressed the Committee in opposition to the application, noting concerns including, but not limited to: the potential for water drainage on abutting lands, a lack of sustainability features, decreased privacy on abutting lots on Cora Drive, and concerns related to rent control exemptions under the Residential Tenancies Act. In response to questions from the Committee regarding the loss of privacy for abutting properties, E. Schneider noted the site was designed to locate the building as close to the north property line towards industrial lands, and furthest from the south property line, abutting the low-rise residential lands. E. Schneider also noted increased setbacks, and increased minimum height for the visual barrier has been proposed to mitigate any privacy concerns. In response to further questions, E. Schneider confirmed the City's Engineering staff have provided clearance that there is adequate sanitary capacity for the proposed development, and the applicant will be required to prepare a Stormwater Management Plan to the satisfaction of the City's Engineering division to address concerns related to water drainage on abutting lands. In response questions from the Committee, E. Schneider confirmed transportation staff have been made aware of concerns raised by residents related to cut through traffic of heavy-duty vehicles, and Staff have proposed a number of mitigation efforts such as proposing this location to the Waterloo Region Police Service (WRPS) for the Selective Traffic Enforcement Program (STEP). E. Schneider also noted this section of Trussler Road was approved for Hot Spot Improvements through the 2024 Vision Zero report approved by City Council in May 2024. As such, a series of raised measures (humps) will be installed in the fall of 2024. Councillor P. Singh left the meeting at this time. Councillor D. Chapman assumed the Chair. Councillor B. loannidis brought forward a motion to refer the recommendation outlined in Development Services Department report, DSD -2024-432 to the November 18, 2024 Council meeting to allow the applicant and staff the G� opportunity to engage in further conversations regarding the potential for a reduction in the number and size of the proposed development's units, and to review potential options for a visual barrier for the subject property. Councillor P. Singh returned to the meeting and this time and resumed the Chair. On motion by Councillor B. loannidis it was resolved: "That the following recommendation be referred to the November 18, 2024, Council Meeting to allow the applicant and staff the opportunity to engage in further discussion regarding the potential for a reduction in the number and size of the proposed development's units, and to review potential options for a visual barrier for the subject property: That Zoning By-law Amendment Application ZBA24/019/T/ES requesting to amend Zoning By-law 2019-051, for the property municipally addressed as 60 Trussler Road, for 1000160668 Ontario Corp. be approved in the form shown in the `Proposed By-law', and `Map No. 1', attached to Development Services Department report, DSD -2024-432, as it appears in Attachment 'Al' and `A2'." 6.
