COMMENCEMENT The meeting began with a Land Acknowledgement given by the Mayor and the singing of "O Canada." 1 2. MINUTES FOR APPROVAL On motion by Councillor M. Johnston the minutes of the regular meeting held November 10, 2025, and special meetings held November 10, December 1, and December 11, 2025, as mailed to the Mayor and Councillors, were accepted. 3. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF 3.1 Councillor P. Singh - Notice of Motion - Inclusionary Zoning Set-aside Rates - Councillor B. loannidis, listed as item 9.2. Councillor P. Singh declared a conflict with Notice of Motion - Inclusionary Zoning Set-aside Rates - Councillor B. loannidis, listed as item 9.2, due to a member of his family owning property within the Downtown PTMSA (Central), and he did not participate in any voting or discussion on this location within the Inclusionary Zoning discussion. 3.2 Councillor S. Stretch - Heritage Permit Application HPA-2025-V-025 - 50-56 Weber Street West and 107 Young Street, DSD -2025-464 Councillor S. Stretch declared a conflict a conflict with Heritage Permit Application HPA-2025-V-025 - 50-56 Weber Street West and 107 Young Street, DSD -2025-464, due to her residing within the notification area, and she did not participate in any voting or discussion on this matter. 3.3 Councillor P. Singh - Missing Middle and Affordable Housing Community Improvement Plan Update, DSD -2025-494 Councillor P. Singh declared a conflict with Missing Middle and Affordable Housing Community Improvement Plan Update, DSD -2025-494, due to a member of his family owning property within the 1500m radius program eligibility requirements, and he did not participate in any voting or discussion on program requirements within that boundary. 3.4 Councillor C. Michaud - Missing Middle and Affordable Housing Community Improvement Plan Update, DSD -2025-494 Councillor C. Michaud declared a conflict regarding Missing Middle and Affordable Housing Community Improvement Plan, DSD -2025-371, due to her place of employment, and she did not participate in any discussion or voting regarding this matter. 3.5 Councillor J. Deneault - Missing Middle and Affordable Housing Community Improvement Plan Update, DSD -2025-494 Councillor J. Deneault declared a conflict regarding Missing Middle and Affordable Housing Community Improvement Plan, DSD -2025-371, due to his place of employment, and he did not participate in any discussion or voting regarding this matter. 3.6 Councillor S. DELEGATIONS 6.1 Centre in the Square (CITS) Appointments and Board of Director Amendments, COR -2025-498, listed as item 11.1.b Council considered Corporate Services Department report COR -2025-498, listed as item 11.1.b, related to the appointment of Board of Director Members; as well as, amendments to the composition to the Board of Directors. Eric Lariviere, Executive Director, Centre in the Square, was in attendance to respond to questions from Council if required. Moved by Councillor B. loannidis Seconded by Councillor S. Davey "That Tony Giovinazzo be appointed as a Centre In The Square, Board Director for a three-year term, expiring November 19, 2028; and further, That the appointment of Alex Kinsella and Kayleigh Platz, Board Directors be renewed for a second three-year term, expiring November 15, 2028; and further, 3 That the appointment of Dan Carli, Chair, be renewed for a two-year term, expiring January 1, 2028; and further, That the by-law attached as Appendix A to Corporate Services report COR -2025-498, to expand the number of Board Directors from fourteen to fifteen members, be adopted." Carried 6.2 Heritage Permit Application HPA-2025-IV-024 - 1385 Bleams Road, DSD - 2025 -462, listed as item 7.1.a Council considered Heritage Permit Application HPA-2025-IV-024 - 1385 Bleams Road, DSD -2025-462, listed as item 7.1.a on the agenda this date. Alina and loan Solomes were in attendance in opposition to the recommendation from staff and Heritage Kitchener. A. Solomes addressed Council in opposition to the proposed condition to enter into a heritage easement agreement and expressed concerns with the need to restore/reconstruct the belfry, which in their opinion is not required by legislation. A. Solomes noted if Council opted to approve the recommendation, they would appeal the decision to the Ontario Land Tribunal (OLT). G. Stevenson, Director, Development and Housing Approvals, was in attendance to respond to questions from Council. Moved by Councillor D. Chapman Seconded by Councillor C. Michaud "That pursuant to Section 34 of the Ontario Heritage Act, Heritage Permit Application HPA-2025-IV-024 be approved to permit the demolition of a shed, two additions, and belfry at the property municipally addressed as 1385 Bleams Road, in accordance with the supplementary information submitted with this application, and subject to the following conditions as outlined in Development Services Department Report, DSD -2025-462: 1. That the Heritage Impact Assessment Addendum be approved by the Director of Development and Housing Approvals prior to the issuance of this permit; 2. That the Owners enter into a heritage easement agreement with the City in accordance with Section 37 of the Ontario Heritage Act for the restoration/reconstruction of the belfry prior to the issuance of this permit; M 3. That the building permit be reviewed, and heritage clearance be provided by Heritage Planning staff prior to the issuance of a building permit to facilitate the restoration/reconstruction of the belfry; 4. The heritage clearance be provided by heritage planning staff prior to the issuance of a demolition permit for the demolition of the shed and c.1920s and 1987 addition." Goss, Manager of Policy and Research and Rosa Bustamante, Director, Planning and Housing Policy/City Planner were in attendance to respond to questions from Council. Sam Nabi and Heline Chow addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Councillor D. Chapman left and returned to the meeting at this time. Larry Masseo, Waterloo Region Home Builders' Association (WRHBA), addressed Council in support of the proposed Notice of Motion. Hal Jaeger, Melissa Hughes, and John MacDonald, addressed Council in opposition to the proposed Notice of Motion. Councillor P. Singh left and returned to the meeting at this time. Elliot Wand, addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Mayor B. Vrbanovic left the meeting at this time. Councillor S. Davey assumed the role of the Chair. l Jacquie Wells and Ken Vogelpohl, ACORN Waterloo Region Chapter, addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Mayor B. Vrbanovic returned to the meeting at this time and re -assumed the role of the Chair. Ryan Murdock addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Peggy Nickels, on behalf of the Kitchener Citizens for Livable Development, addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Councillor M. Johnston left and returned to the meeting at this time. Emanuel Melo read a prepared statement for Ella Donaldson who had to leave the meeting earlier this date, in opposition to the proposed Notice of Motion to amend the set-aside rates. Emanuel Melo addressed Council in opposition to the proposed Notice of Motion to amend the set-aside rates. Melissa Durrell addressed Council on behalf of Build Urban, in support of reduced set aside rates with minor adjustments to the implementation of Inclusionary Zoning: within the PMTSA's due to the current real estate market conditions. 6.4 Recess and Reconvene The Council meeting then recessed at 8:51 p.m. and reconvened at 9:06 p.m., chaired by Mayor B. Vrbanovic with all members present. 6.5 Notice of Motion - Inclusionary Zoning Set-aside Rates - Councillor B. loannidis, listed as item 9.2. (Cont'd) Council resumed consideration of Notice of Motion - Inclusionary Zoning Set- aside Rates - Councillor B. loannidis, listed as item 9.2. on the agenda this date. Members of Council then asked questions of staff regarding set aside rate calculations on development, Housing Accelerator Fund (HAF) commitments, activities undertaken by the city to increase affordable housing opportunities, impact of IZ on development, for-profit developers building affordable housing units, IZ application to the rental market in addition to the condominium market, CMHC requirements for purpose-built rentals, set aside rates and cost certainty for the development industry, development charge fee waivers for registered not - n. for -profits, and received responses from N. Goss, Manager of Policy and Research, Rosa Bustamante, Director, Planning and Housing Policy/City Planner, Justin Readman, General Manager, Development Services and Jonathan Lautenbach, Chief Financial Officer. It was noted, should the Notice of Motion fail, the existing rates as included in the approved By-law would be implemented January 1, 2026. Councillor B. loannidis brought forward the Notice of Motion as listed on the agenda this date, which was seconded by Councillor S. Davey. As per the previously declared conflict by Councillor P. Singh, the inclusionary zoning rates for the Downtown Core, were then voted on and were LOST on a recorded vote, with Councillors S. Davey, D. Schnider and B. loannidis voting in favour; and, Mayor B. Vrbanovic and Councillors J. Deneault, C. Michaud, A. Owodunni, M. Johnston, D. Chapman and S. Stretch voting in opposition. Councillor P. Singh did not vote or participate in this matter. The following motion was then voted on, on a recorded vote. Moved by Councillor B. loannidis Seconded by Councillor S. Davey "WHEREAS Staff retained N. Barry Lyons Consulting (NBLC) land economists to conduct an updated 2025 Residential Market Assessment ("report") which analyzed the recent local market activity and conditions; WHEREAS the updated 2025 Residential Market Assessment ("report") reinforced multiple key indicators, the market and economic context for investing in new high density residential development in Protected Major Transit Station Areas (PMTSA) is markedly more challenging than it was in 2024 when Inclusionary Zoning was approved by Council; and, WHEREAS the City's residential market continues to experience limited activity, to date, there have been no 50+ unit housing developments started this year within the City's PMTSAs (50+ unit developments trigger IZ); and, WHEREAS population growth, development feasibility; condominium market trends and the rental market outlooks are all factors that are adding challenges to high density developments in the PMTSA; and, WHEREAS the development community has expressed concerns that Inclusionary Zoning now is ill-timed due to the current stagnation of the 7 housing market, noting suggestions that the requirements only begin once the number of housing starts are above historic averages; and, WHERESAS set-aside rates were established for 2026, but may have a negative impact on the construction of new units; THEREFORE BE IT RESOLVED that staff be directed to prepare a City initiated Official Plan Amendment and Zoning By-law Amendment to change the Inclusionary Zoning set aside rate from 2% to 0.5% and from 1 % to 0.25% in their respective PMTSA; THEREFORE BE IT FURTHER RESOLVED that these set aside rates be maintained for 2026 and 2027; THEREFORE BE IT FURTHER RESOLVED that the effective date of the Zoning By-law amendment shall be the effective date for the purpose of section 8(1)(d) of O.Reg 232/18; and, THEREFORE BE IT FINALLY RESOLVED that staff be directed to report back on local market conditions occur in 2027, 2029, and 2031." Stretch did not participate in any voting or discussion on this matter. The balance of the report was then voted on and was Carried. Moved by Councillor C. Michaud Seconded by Councillor D. That the final Phase II Heritage Impact Assessment be approved by the Director of Development and Housing Approvals prior to final site plan approval; 2. That the final building elevations be reviewed and approved by the City's Heritage Planner prior to the issuance of this heritage permit; and 3. That the final building permit be reviewed, and heritage clearance be provided by Heritage Planning staff prior to the issuance of the building permit for the building." 7.1.c Update to Delegated Approval Authority By-law, DSD -2025-465 Carried 9 "That the draft by-law attached as Appendix `A' to Development Services Department report, DSD -2025-465 be enacted, as amended by Heritage Kitchener, to repeal and replace Chapter 642 of the City of Kitchener Municipal Code regarding the delegation of power to consent to alterations to properties designated under Part IV and Part V of the Ontario Heritage Act." Carried 7.2 PLANNING AND STRATEGIC INITIATIVES COMMITTEE - DECEMBER 1, 2025 At the request of Councillor D. Chapman, item 7.2.a Elimination of Return Envelopes, FIN -2025-407, was voted on separately and was Carried. The balance of the Planning and Strategic Initiatives Committee was then voted on. Chapman "That the report of the Planning and Strategic Initiatives Committee, dated December 1, 2025, listed as items 7.4.a to 7.4.h on the agenda this date, be adopted." Carried 7.2.a Elimination of Return Envelopes, FIN -2025-407 "That the City of Kitchener discontinue the practice of including return envelopes with mailed paper bills effective February 1, 2026, as outlined by Financial Services Department report, FIN -2025-407" Carried 7.2.b 2025 Victus Hockey Academy LP Agreement at Sportsworld Arena, CSD -2025- 472 "That the General Manager, Community Services and Deputy Chief Administrative Officer be authorized to execute a license agreement and any amendments or renewals with Victus Academy LP for space at Sportsworld Arena, municipally known as 35 Sportsworld Crossing Road, said agreement to be satisfactory to the City Solicitor, as outlined in Community Services Department report, CSD -2025-472." Carried 7.2.d Municipal Act Section 357(g) Applications - Repairs and Renovations, FIN -2025- 453 "That Council approve the draft policy attached as Appendix A to Financial Services Department report, FIN -2025-453." Carried 7.2.e Municipal Act Section 357(1)(d.1) Application for Sickness or Extreme Poverty, FIN -2025-451 That the draft by-law attached to Financial Services Department report, FIN -2025-451 as Appendix "A" to delegate authority to the Assessment Review Board for determining the eligibility for property tax relief for applications received under Section 357(1)(d.1) of the Municipal Act, 2001 be approved; and further, That staff forward a certified copy of the by-law to the Registrar of the Assessment Review Board and the Municipal Property Assessment Corporation, as required under Section 357(12) of the Municipal Act, 2001 and thereafter forward a copy of every application received to which this by-law applies. Carried 7.3 PLANNING AND STRATEGIC INITIATIVES COMMITTEE - DECEMBER 15, 2025 It was noted the recommendation for item 7.3.a Missing Middle and Affordable Housing Community Improvement Plan Update, DSD -2025-494, was arising from the Planning and Strategic Initiatives Committee earlier this same date. Due to the previously declared conflict by Councillors P. Singh and S. Stretch related to properties within a 1500m radius of the Community Improvement plans, that radius was voted on separately and was Carried. Councillor P. Singh and S. Stretch did not participate in any voting or discussion on this matter. The Balance of the Community Improvement Plan was then voted on and was Carried. Moved by Councillor M. QUESTIONS AND ANSWERS Councillor S. Davey brought forward an inquiry regarding the Region of Waterloo's recent announcement of a water supply issue, and received responses from Mayor B. Vrbanovic and Denise McGoldrick, General Manager, Infrastructure Services. Councillor S. Davey requested that staff share information as it's made available by the Region. 11.
