Galloway, commencing at 12:05 p.m., with the following members present: Ms. P. Wagner and Messrs. P. Bufe, R. Green, E. Lucy and B. Scott. Mr. W. Stauch was in attendance for part of the meeting. Regrets: Ms. G. Engel and Ms. C. Martindale. Others Present:Ms. C. Ladd, Ms. D. Gilchrist and Messrs. L. Masseo and L. Bensason. 1 .AYRES COURT VISUAL EASEMENT – ALTERATION APPLICATION The Committee had been provided with correspondence from Mr. G. Scheels, Green Scheels Pigeon Planning Consultants Ltd. to Mr. L. Bensason, dated December 20, 2000, attached to which is the Alteration Application of Monarch Construction, of the same date, requesting permission to alter the District Plan requirement for a 50 foot wide “Visual Easement” along the south edge of new infill development on Oregon Drive. Mr. G. Scheels appeared as a delegation to represent the application. Ms. S. Nequest of 37 Oregon Drive and Mr. D. Jones, representing the Society for the Preservation of Upper Doon, appeared as delegations to present their concerns with the above application. In this regard, Ms. Nequest provided the Committee with copies of a letter from herself and Paul Nequest to Mr. G. Scheels, dated January 8, 2001, as a follow up to a meeting held at 37 Oregon Drive on January 4, 2001. The Committee members had also been provided with copies of a written submission from Mr. R. Haalboom, dated January 10, 2001, concerning the location of the boundary of the Upper Doon Heritage Conservation District as identified in Schedule “B” of By-law 88-17 and the differing boundary as assumed in the Monarch Construction application. In his written submission, Mr. Haalboom points out that any change to the boundary of the Upper Doon Heritage Conservation District requires a by-law amendment and Ontario Municipal Board approval. Mr. L. Bensason asked that consideration of this application be deferred, as some last minute issues have been raised. He advised that initially the Alteration Application was to deal with a reduction in the size of the buffer strip dividing the Wyldwoods Subdivision from the Heritage Conservation District, which is proposed to fluctuate from 30 feet to 75 feet in width. He explained that the issue recently brought forward in Mr. Haalboom’s written submission, with respect to the location to the boundary of the Heritage Conservation District, places not only the properties on Ayres Court in the District, but also other subdivision lands. Mr. Bensason pointed out that the Heritage Impact Assessment prepared for the subdivision, and previously considered by Heritage Kitchener, recommends the interpretation of a new boundary for the Heritage Conservation District, at the edge of the properties on Ayres Court. Mr. Haalboom argues that the City of Kitchener does not have any authority to interpret the boundary differently, without amending the By-law. Mr. Bensason advised that he has discussed this matter with the City’s Legal Department who agrees with Mr. Haalboom. Mr. Bensason requested the Committee defer consideration of this matter to its February meeting, and he will request that Monarch Construction submit a further application with respect to the size of the lots now known to be located in the Heritage Conservation District. Mr. W. Stauch entered the meeting at this time. Following a brief discussion, the Committee agreed to defer consideration of this matter to the February meeting. Councillor M. Galloway thanked the delegations for attending and invited them to make their presentations at the Heritage Kitchener meeting scheduled for Friday, February 9, 2001, at 11:45 a.m. in the Conestoga Room. The members of Heritage Kitchener agreed to meet informally to discuss these applications prior to the February meeting. 2. 2001 MIKE WAGNER HERITAGE AWARDS HERITAGE KITCHENER JANUARY 11, 2001- 2 -CITY OF KITCHENER Mr. L. Bensason distributed packages of information to the Committee members containing a list of those properties nominated for the 2001 Mike Wagner Heritage Awards and copies of the nomination forms and attachments for each of the properties. He noted that the following properties have been nominated for Mike Wagner Heritage Awards; 811 Bleams Road (J. Steckle Heritage Homestead), 1 King Street West (Walper Terrace Hotel), 466 Queen Street South (Joseph Schneider House – Outbuildings), 67-69 Ahrens Street West, 132 Young Street, 134 Lancaster Street East and the Huron Road Bridge. With the aid of a PowerPoint presentation Mr. Bensason then displayed photographs of each of the nominated properties. In reviewing each of the properties the Committee members considered the judging criteria established for the Mike Wagner Heritage Award and also the 8 Guiding Principles in the Conservation of Historic Properties as contained in the Architectural Conservation Notes produced by the Ministry of Culture, Tourism and Recreation. Committee members voted on each of the nominated properties resulting in the following motion. On motion by Councillor M. Galloway – it was resolved: That the following receive Mike Wagner Heritage Awards: “ Outstanding Achievement Awards 811 Bleams Road J. Steckle Heritage Homestead Long Term Conservation 134 Lancaster Street West Restoration of House Huron Road Bridge Restoration of Bridge Award of Merit 1 King Street West Walper Terrace Hotel Use of Furniture from Old City Hall In Redesign of Front Foyer” As the Awards are normally presented during Heritage Week, the Committee requested that this recommendation not be forwarded to City Council until its meeting of February 26, 2001. Mr. B. Scott left the meeting at this time. 3. HERITAGE AREA OF INTEREST – LOWER DOON The Committee was in receipt of a memorandum from Mr. L. Bensason, dated 2001-01-02, attached to which was a map identifying the Heritage Area of Interest for a possible Heritage Conservation District in Lower Doon. It is noted in the memorandum that the Heritage Area of Interest identified on the map is the same area as determined by Heritage Kitchener at its October 20, 2000, meeting. The memorandum also requests that a Draft Heritage Area of Interest be identified for the Civic Centre, and requests that two Committee members assist staff with this initiative. It is noted in the memorandum that once Heritage Areas of Interest have been identified for both potential districts, public meetings can be held to determine if there is sufficient public support to pursue studying these areas for designation. Mr. Bensason advised that a decision on which of these two areas should be pursued for possible Heritage District designation should be made by mid-year so that a public information meeting can be scheduled in the area for early fall 2001. 3. HERITAGE AREA OF INTEREST – LOWER DOON (CON’T) HERITAGE KITCHENER JANUARY 11, 2001- 3 -CITY OF KITCHENER On motion by Mr. P. Bufe – it was resolved: “That Heritage Kitchener approves the Heritage Area of Interest for Lower Doon, as shown on the map attached to the memorandum of L. Bensason, dated 2001-01-02.” Mr. P. Bufe agreed to assist staff in identifying a draft Heritage Area of Interest in Civic Centre. 4. 24 PINNACLE DRIVE – UPDATE Mr. L. Bensason provided further information with respect to the Demolition Control Application received for the property municipally known as 24 Pinnacle Drive, which the Committee was advised of at its December meeting. He advised that the property owner also owns 20 Pinnacle Drive which is designated under the Ontario Heritage Act, and the property is located within the Heritage Area of Interest of Lower Doon. He stated that the owner wants to leave the property vacant at this time. Mr. Bensason then displayed slides of the interior of this building advising that following inspection of the property the Building Inspector estimates that the costs to make the building habitable is $58,000. to $60,000. Staff are recommending that the application be approved. 5. 171 QUEEN STREET SOUTH - UPDATE Mr. L. Bensason advised that Council approved the applications of the owner to demolish the property municipally known as 171 Queen Street South. He noted that he has recorded this building and the demolition can proceed at any time. Mr. Bensason pointed out that the previous owner had some salvage rights; however, the bricks will be used on the Schmalz House. 6. MUNICIPAL HERITAGE PROPERTY GRANT PROGRAMME Mr. L. Bensason advised that the Finance and Administration Committee is recommending that Council approve the Heritage Property Grant Programme which this Committee supported at its December meeting. If approved by Council, there will be $15,000. available in 2002 to commence the programme. 7. WATERLOO COUNTY GOVERNOR’S HOUSE AND GAOL – FURTHER ALTERATION APPLICATION The Committee was in receipt of the next, in a series of Alteration Applications, for 73 Queen Street North, Waterloo County Governor’s House and Gaol, dated December 20, 2000. This application applies to the following alterations: 1. Gaol front entrance and canopy, 2. Rear door of Governor’s House, south elevation, 3. Door into Law Enforcement in existing arch, south elevation, 4. Windows in stair, south elevation, 5. New oval openings, north and south elevations, 6. Emergency exit door. Mr. B. Bechtel, Region of Waterloo, appeared as a delegation to represent the application and with the aid of an overhead projector displayed elevation drawings showing each of the alterations requested. Concerning Item No. 1 in the application, Mr. Bechtel advised that the proposed door is Type ‘F’ as shown on the “Door Schedule” submitted with the application, being solid wood and matching as close as possible the front door on the Governor’s House. It will have a light on top, a panel on the bottom and there will be a glass transom above. He then advised they are withdrawing their request for a canopy over the Gaol’s front entrance. In considering Item No. 2 in the application, it was noted that the door on the south elevation of the Gaol is a side door and not a rear door and the application was amended accordingly. WATERLOO COUNTY GOVERNOR’S HOUSE AND GAOL – FURTHER ALTERATION APPLICATION (CONT’D) Mr. Bechtel advised that the door will be solid wood with a light on the top, a panel on the bottom and a glass transom above. Mr. Bechtel then provided information with respect to the doors for Items No. 3 and 6 in the application. For Item No. 3, Mr. Bechtel noted that there will be stones above the door, rather than the glass transom shown on the elevation drawing. Following discussion it was generally agreed that the doors proposed for Items 3 and 6 be the same and be of the style of door shown as Door Type ‘G’ as shown in the “Door Schedule” submitted with the application. Mr. Bechtel advised that Item No. 4 in the application requesting permission to alter the windows in the stair in the south elevation has been withdrawn. It was noted by the Committee that Item No. 5 in the application with respect to the oval openings on the north and south elevations has already been dealt with in the last application and is therefore redundant. On motion by Councillor M. Galloway – it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Council approve the application “ of the owner, dated December 20, 2000, to alter the designated property, municipally known as 73 Queen Street North (Waterloo County Governor’s House and Gaol) as follows: a) installation of double doors on the front entrance of the Gaol, with the doors having a glass light on the top, panels in the bottom which match as close as possible to the panels on the existing door to the Governor’s house, and a glass transom above the door; b) installation of a door on the south elevation of the Governor’s House having a glass light on the top, a panel on the bottom and a glass transom above; c) installation of two doors on the south elevation of the Gaol, being the “Law Enforcement Entrance” and “Emergency Exit” doors as shown on drawing A3.1 and A3.2, dated October 26, 2000, with such doors to be “Door Type G” in the “Door Schedule” Drawing A7.2, dated October 26, 2000; and further, That Council acknowledge that the owner has withdrawn its request to erect a canopy over the rebuilt front entrance of the Gaol and to alter windows in the stairs of the south elevation of the Gaol.” 8. WATERLOO COUNTY GOVERNOR’S HOUSE AND GAOL BARS ON WINDOWS – FURTHER ALTERATION APPLICATION The Committee was advised that their recommendation to Council, of October 20, 2000, had been referred by Council back to this Committee due to the owner’s concerns about the request to retain bars on the windows on the left side of the rebuilt front entrance of the Gaol. In this regard, Ms. C. Giller and Mr. K. Noonan of the Region of Waterloo appeared as a delegation. Mr. L. Bensason advised that the sub-committee overviewing all the alterations proposed for the Gaol recommended maintaining some of the bars on the front windows. He pointed out that, to the right of the front entrance, was the Turnkey residence and up to the 1930’s there were no bars on th those windows. He then reviewed the discussion which had taken place at the October 20 meeting leading to the Committee’s recommendation to maintain bars on 8 windows on the ground floor level of the Gaol. Ms. C. Giller addressed the Committee advising that the Region of Waterloo has concerns about maintaining bars on the three ground floor windows to the left of the Gaol’s main entrance. Their concerns are for staff working in the offices behind those windows and the public impression HERITAGE KITCHENER JANUARY 11, 2001- 5 -CITY OF KITCHENER 8. Ms. Giller pointed out that the only jail she is aware of that has maintained bars on windows have been converted to museums, not on buildings used for court functions. She also advised that they have no concerns about maintaining bars on the two side windows. Ms. Giller then proposed the maintenance of bars on windows on other parts of the Gaol and displayed an elevation drawing showing the Region’s proposal to maintain bars on the following windows: 3 windows on the second story of the east elevation of the Gaol, on that portion of the building overlooking the courtyard, and 2 windows on the second story on the west elevation of the Gaol. She then explained the history of those portions of the Gaol. Councillor M. Galloway then questioned the use proposed for the front of the second story of the Gaol and was advised by Mr. Noonan that the space will be used for offices. Following further discussion Mr. L. Bensason questioned the possibility of hinging the bars so they could be opened at certain times of the day. Mr. K. Noonan provided the Committee with the Region’s reasoning for not wanting the bars which related to not wanting to deprive staff of natural light. Concerning Mr. Bensason’s suggestion of hinging the bars so they could be opened, Mr. Noonan stated that it could be possible and they would be willing to investigate that idea. Committee members were supportive of Mr. Bensason’s suggestion. While reviewing the elevation drawings presented by Ms. C. Giller, the Committee noted that the new window on the second floor above the rebuilt front entrance of the Gaol is shown to have a 2/2 configuration rather than the 1/1 configuration previously recommended by this Committee. The Committee discussed the merits of each configuration relative to this specific location on the building. On motion by Mr. R. Green – it was resolved: “That Heritage Kitchener’s resolution of October 20, 2000, relative to the Alteration Application for the Governor’s House and Gaol, dated August 9, 2000, be amended with respect to Item No. 12 on the application to recommend a 2/2 window configuration rather than a 1/1 window configuration for the centre window above the front entrance of the Gaol.” On motion by Councillor M. Galloway – it was resolved: “That pursuant to Section 33 of the Ontario Heritage Act, Council approve the outstanding items in Schedule “A” to the application of the owner, dated August 9, 2000, to alter the designated property municipally known as 73 Queen Street North (Waterloo County Governor’s House & Gaol), as follows: Item #1 -That the steel mesh be removed from the Gaol windows; and further, That bars be located on the following windows on the Gaol: a)3 main floor windows and 3 second floor windows on the left side of the Gaol’s rebuilt front entrance, west elevation; b) 2 main floor windows on the south elevation; c) 2 second floor windows on the north elevation; d) 3 second floor windows on that portion of the east elevation overlooking the walled courtyard; and further, That the owner be permitted to remove the existing bars from the windows, HERITAGE KITCHENER JANUARY 11, 2001- 6 -CITY OF KITCHENER 8. WATERLOO COUNTY GOVERNOR’S HOUSE AND GAOL BARS ON WINDOWS – FURTHER ALTERATION APPLICATION (CONT’D) frame and retrofit as required, with bars being re-installed in the above windows with hinges, so that the bars may be opened or closed over the window opening. Item #5 -That a new arch be installed in the Gaol courtyard wall, immediately adjacent to and identical to the existing arch, to allow for vehicular access to the parking area; and, That the existing arch be infilled with stones to match the wall, the infill material to be recessed 1 foot, subject to the archstones and keystone being maintained in their existing position; and further, That the opening for the new man door shall not accommodate a transom or sidelight. Item #7 -That acknowledgement be given to the fact that the applicant has withdrawn its request to remove existing archstones. Item #8 -That the door opening to the rear entrance to the Governor’s House be of a size to accommodate a transom but no sidelights. Item #9 -That oval vents be installed in the gable end on the north and south elevations of the Gaol, to be identical in proportion to the plaster detail in the gable ends on the east and west elevations of the Gaol. Item #12 -That the front entrance of the Gaol be rebuilt as shown in drawing A-3-1 submitted with the application; subject to the bars remaining in the upper windows with the bricks to remain behind the bars in the two narrow windows and the configuration of the centre window being 2/2.” 9. HERITAGE SHOWCASE AND HERITAGE DAY WORKSHOP The Committee Administrator advised that this year’s Heritage Showcase will be held on Saturday, February 17, 2001, at Fairview Park Mall. A display is required for the showcase which will have to be set-up in the mall, tended throughout the day and taken down at close. Volunteers will be needed to look after this. A few members of the Committee volunteered to tend the display. Mr. Bensason volunteered to show the volunteers how to set-up the display panel. The Committee Administrator also advised that the display is required for Heritage Day Workshop to be held at the Walper Terrace Hotel on Monday, February 19, 2001, and volunteers to be greeters for the function are requested. 10. HERITAGE KITCHENER MEMBERSHIP Mr. L. Bensason advised that Mr. John Clinkett, Architect, has volunteered to be a member of Heritage Kitchener. On motion by Mr. R. Green – it was resolved: “That Mr. John Clinkett be appointed a member of Heritage Kitchener for a term to expire November 30, 2001.” 11. 161 QUEEN STREET NORTH – POTENTIAL DESIGNATION Mr. L. Bensason advised that the owner of 161 Queen Street North is interested in having that property designated and asked that 2 members of this Committee volunteer to investigate this property. 12. STRATEGIC PRIORITIES FOR 2001 HERITAGE KITCHENER JANUARY 11, 2001- 7 -CITY OF KITCHENER Mr. L. Bensason asked that Committee members to give some thought to strategic priorities for this Committee for the year, to be discussed at the next meeting. 13. INFORMAL DISCUSSION MEETING The members of Heritage Kitchener agreed to meet on Tuesday, February 6, 2001, at 5:00 p.m. to discuss the situation with respect to the Ayres Court Visual Easement and the boundary for the Upper Doon Heritage Conservation District. 14.
