Gosse, Committee Administrator DTS-05-012 MOORE AVENUE TRAFFIC CONTROL CONDITIONS BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 012 dated January 21,2005, regarding traffic control conditions on Moore Avenue. On motion by Councillor B. Vrbanovic - it was resolved: "That an all-way stop control be installed at the intersection of Moore Avenue and Shanley Street; and further, That the Uniform Traffic By-law be amended accordingly." DTS-05-014 - HOMER WATSON BLVD / FOUNTAIN STREET / HWY 401 INTERCHANGE IMPROVEMENTS CITY OF KITCHENER NOISE BY-LAW EXEMPTION FAIRVIEW-GATEWAY WARD & SOUTH WARD The Committee considered Development and Technical Services Department report DTS-05- 014 dated January 19, 2005, regarding a noise by-law exemption for Homer Watson Boulevard / Fountain Street / Highway 401 interchange improvements. On motion by Councillor B. Vrbanovic - it was resolved: "That the Ministry of Transportation and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work, during the reconstruction and improvements of the interchange of Homer Watson Boulevard/Fountain Street/Highway 401, between the hours of 7:00 p.m. to 7:00 a.m. for the period from May 1,2005 to December 31,2006." DTS-05-019 - DUKE & ONTARIO GARAGE POST TENSIONING TENDON REPAIRS CONSULTANT SELECTION BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 019 dated January 26, 2005, regarding a consultant selection for the Duke & Ontario Garage post tensioning tendon repairs. Councillor B. Vrbanovic questioned why the hiring of the consultant was being done at this time when the project was not going ahead until later in the year. Mr. J. DTS-05-019 - DUKE & ONTARIO GARAGE POST TENSIONING TENDON REPAIRS CONSULTANT SELECTION BRIDGEPORT-CENTRE WARD (CONT'D) consultant will prepare the tender which should take approximately 5 months so that when the project is ready to go ahead the tender can be posted immediately. On motion by Councillor B. Vrbanovic - it was resolved: "That the consultant selection process be waived and award the 2005 Duke and Ontario Garage Post-Tensioning Tendon Structural Engineering Services to Read Jones Christoffersen Ltd." 4. DTS-05-023 - ZELLER DRIVE PUMPING STATION The Committee considered Development and Technical Services Department report DTS-05- 023 dated February 2, 2005, regarding the Zeller Drive pumping station. On motion by Councillor B. Vrbanovic - it was resolved: "That the Mayor and City Clerk be authorized to enter into an agreement satisfactory to the City Solicitor with Lyndale Holdings to accommodate temporary pumping of sewage until the construction of the Zeller Drive pumping station is completed." 5. DTS-05-013 2003 COLLISION REPORT The Committee considered Development and Technical Services Department report DTS-05- 013 dated January 13, 2005, regarding the 2003 Traffic Collisions Report. Mr. R. Parent advised that a database of traffic collisions that occurred in 2003 on Kitchener roads has been developed which will provide Council and staff with important data and statistics with respect to traffic collisions. The data can then be analysed which may lead to functional changes to the road network and also assist in determining target enforcement areas and other traffic control measures. Mr. Parent then gave a presentation highlighting various aspects of the report including when and where the highest number of collisions take place and some of the contributing factors. Mr. Parent concluded his presentation advising that the 2004 Traffic Collision Report will be available mid 2005 which will assist in determining which measures undertaken as a result of the 2003 report have been successful. SSD-05-004 - MID-PENINSULATRANSPORTATION CORRIDOR (MPTC) - NIAGARA FALLS TO TORONTO The Committee considered Strategic Services Department report SSD-05-004 dated January 10, 2005, regarding a proposed transportation corridor between Niagara Falls and the City of Toronto. Mr. H. Gross advised that a private sector advocacy group has been organised, supporting the construction of a transportation corridor been the City of Toronto and Niagara Falls. Mr. Gross explained that the corridor was identified in the provincial growth strategy document as a key transportation link and the advocacy group wants to ensure that the corridor goes ahead without any long term delays. He further explained that the Region of Waterloo could benefit from this transportation corridor but only if a link is established between the region and the proposed transportation corridor. On motion by Councillor B. Vrbanovic - it was resolved: "That the City of Kitchener supports, in principle, the development of the Mid-Peninsula Transportation Corridor (MPTC); and further, DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES FEBRUARY 77 2005 6. SSD-05-004 - 11- CITY OF KITCHENER - MID-PENINSULA TRANSPORTATION CORRIDOR (MPTC) NIAGARA FALLS TO TORONTO (CONT'D) That the City of Kitchener encourages the Region of Waterloo to pursue the development of a connecting link corridor between the Region of Waterloo and the new MPTC." DTS-05-024 - FAIRWAY ROAD EXTENSION ENVIRONMENTAL ASSESSMENT - STATUS REPORT The Committee considered Development and Technical Services Department report DTS-05- 024 dated February 2, 2005, regarding the Class Environmental Assessment Study with respect to the Fairway Road extension from Zeller Drive in Kitchener to Fountain Street in Cambridge. Mr. J. McBride advised that the Region of Waterloo is undertaking a class environmental assessment to address the impacts of possible routes and new road alignment of the Fairway Road extension which will involve a crossing of the Grand River. He further advised that two public consultations have been held in order to obtain public comment on the various routes and from the process so far 3 routes have been short listed for a more detailed evaluation. Mr. McBride explained that the environmental assessment is still in the evaluation stage, public comments are still being solicited and staff will continue to participate in the Steering Committee meetings representing the City's interest. Once a preferred route has been selected a report will be brought back to the Committee for comment and the City's position. Councillor G. Lorentz raised a concern in waiting for a preferred route being selected by the Steering Committee suggesting that the City should take a position now to ensure that the citizens of Kitchener have a voice in the matter. Mr. J. McBride advised that at this point in time staff believe that alternative D3 which follows a southerly route crossing the Grand River along the south east embankment and will connect with Fountain Street in Cambridge to be the best option. He explained that this route would feed into the future employment area which will have a direct impact on the City of Kitchener in the future. Mr. McBride advised that staff will report back to the Committee on the Fairway Road extension when further information is obtained and the environmental assessment is completed. On motion by Councillor J. Smola - it was resolved: "That Staff continue to participate in the Fairway Road Extension Environmental Assessment Steering Committee; and further, That once a preferred route alternative is determined, that a report be tabled with the Development and Technical Services Committee." DTS-05-016 - ZONE CHANGE APPLICATION ZC 04/22/E/CB 87 ELLIS AVENUE R. LEHMANN BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 016 dated January 18, 2005, regarding zone change application ZC 04/22/E/CB to change the zoning on the subject lands at 87 Ellis Avenue. Mr. L. Masseo advised that the City has received zone change application ZC 04/22/E/CB from Rose and Dave Lehmann to change the zoning on the subject lands at 87 Ellis Avenue from Residential Four Zone (R-4) to Residential Six Zone (R-6) to allow multiple dwellings or street townhouses to be constructed on the property. Mr. Masseo advised that staff have worked with the applicant on the proposed development including reduced setbacks and building heights to ensure compatibility with the surrounding neighbourhood. Mr. Masseo concluded that staff are recommending the approval of the zone change application in the form shown in the proposed by-law attached to the staff report. DTS-05-016 - ZONE CHANGE APPLICATION ZC 04/22/E/CB 87 ELLIS AVENUE R. LEHMANN BRIDGEPORT-CENTRE WARD (CONT'D) On motion by Councillor J. Smola - it was resolved: "That Zone Change Application ZC 04/22/E/CB, for Rose and Dave Lehmann, to change the zoning on the subject lands, at 87 Ellis Ave, from Residential Four Zone (R-4) to Residential Six Zone (R-6) with Special Regulation Provision 422R on lands legally described as Tract German Company Sub of Lot 4 Part Lot 1, in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated January 9, 2005, attached to Development and Technical Services Department report DTS-05-016." Chair C. Weylie raised a concern regarding the report on the zone change for 87 Ellis Avenue and the fact that some of the attached comments from the public have the names of the person and their address removed therefore making it difficult to assess their comments. Councillor G. Lorentz agreed advising that in many cases involving planning issues, it is important that Council knows the address of the person making any comments to the various applications. The Committee was advised that the removal of the names and addresses was in keeping with privacy issues that have been raised by members of the public on former applications. Additionally there may be a question with respect to federal and provincial privacy legislation with respect to the publication of personal information. Councillor Lorentz suggested that if there is a change in process and policy regarding the publication of names, that a report should come before Council for approval. 9.
