MINUTES OF THE REGULAR MEETING HELD FEBRUARY 8, 2005
MEMBERS PRESENT: Ms. D. Angel and Messrs. P. Britton and B. Isaac.
OFFICIALS PRESENT:
Mr. B. Sloan, Planner, Ms. R. Brent, Assistant Secretary-Treasurer, and
Ms. D. Gilchrist, Secretary-Treasurer
Mr. P. Britton, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener
Municipal Code. The Committee will not make a decision on these applications but rather will make a
recommendation which will be forwarded to the Committee of the Whole and Council for final
decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, February 28, 2005, at 7:00 p.m., and
the applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant requests permission for a new ground sign to
be located 0.3 m (0.98 ft.) from the front lot line instead of the required 3.0 m (9.84 ft.) setback.
The Committee considered the report of the Development and Technical Services Department,
dated January 31,2005, advising there are no objections to this application.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
January 31,2005, advising they have no concerns with this application.

That the application of MTE Consultants Inc. requesting permission for a new ground sign to
be located 0.3 m (0.98 ft.) from the front lot line rather than the required 3.0 m (9.84 ft.) on Part

520 Bingemans Centre Drive, Kitchener, Ontario, BE APPROVED.

It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680
(Signs) is being maintained on the subject property.

Mr. P. Britton declared a pecuniary interest in this application as his planning firm has done
consulting work for Heffner Toyota, and he did not participate in any discussion or voting with
respect to this application. Mr. B. Isaac Chaired the meeting during consideration of this
application.

The Committee was advised that the applicant requests permission for a new pylon sign at the
King Street frontage to have cladding within the required 2.44 m (8 ft.) high sign clearance
area, whereas pylon signs are to remain clear from obstructions in the sign clearance area.
The Committee considered the report of the Development and Technical Services Department,
dated January 31,2005, advising they have no objections to this application, provided the sign
is located outside of the 4.57 m driveway visibility triangle.
The Committee considered the comments of the Region of Waterloo Transportation Planner,
dated January 31,2005, in which they advise they have no concerns with this application.
The Committee considered electronic mail from the Ministry of Transportation, dated January
28, 2005, advising they have no objection to this application. They note that should this sign
be visible from Highway 8, a Ministry Sign permit will be required.
The Committee considered correspondence from the Kitchener-Wilmot Hydro dated January
25, 2005, advising of safety standards established by Ontario Regulation 22/04, and the
Occupational Health and Safety Act, for the benefit of the applicant.

That the application of Heffner Toyota requesting permission to erect a pylon sign to have
cladding within the required 2.44 m (8 ft.) high sign clearance area, whereas pylon signs are to
remain clear from obstructions in the sign clearance area, on Part Lot 27, Registered Plan 986,
being Parts 1-3, Reference Plan 58R-7992, 3111 King Street East, Kitchener, Ontario, BE
APPROVED, subject to the following conditions:
That the proposed pylon sign shall be located outside of the 4.57 m (15 ft.) driveway
visibility triangle.

2. That the applicant shall provide the required clearances and allow for construction and
maintenance of the proposed sign in compliance with Ontario Regulation 22/04 and the
Occupational Health and Safety Act.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680
(Signs) is being maintained on the subject property.
