Gazzola - Vice-Chair Mayor C. Zehr and Councillors J. Smola, G. Lorentz, B. Vrbanovic and M. Galloway. Staff: C. Ladd, Chief Administrative Officer G. Gosse, Committee Administrator DTS-05-022 - COLLEGE STREET ON-STREET PARKING BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 022, dated February 16, 2005, regarding on-street parking on College Street. On motion by Councillor M. Galloway - it was resolved: "That on-street parking be prohibited from January 1st to March 31st of each year on the east side of College Street from Ahrens Street to Weber Street West; and further, That the Uniform Traffic By-law be amended accordingly." DTS-05-034 - PERMIT ONLY PARKING BY-LAW REVISIONS ST. MARY'S & GRAND RIVER HOSPITALS The Committee considered Development and Technical Services Department report DTS-05- 034, dated February 17, 2005, regarding permit only parking by-law revisions around the St. Mary's and Grand River Hospitals. On motion by Councillor M. Galloway - it was resolved: "That the Uniform Traffic Control By-Law be amended to incorporate the following existing "Permit Only Parking" locations: On the south side of Patricia Avenue from Spadina Road West to a point 121 metres east thereof; On the west side of Spadina Road West from Patricia Avenue to Belmont Avenue West; On the east side of Spadina Road West from Belmont Avenue West to 50 metres north thereof." DTS-05-028 - DEMOLITION CONTROL APPLICATION DC 05/01/G/CB 715 FISCHER-HALLMAN ROAD (FORMERLY 78 GROVE DRIVE) SOUTH WARD The Committee considered Development and Technical Services Department report DTS-05- 028, dated February 24, 2005, regarding Demolition Control Application DC 05/01/G/CB, requesting permission to demolish a single detached dwelling located at 715 Fischer-Hallman Road. Councillor M. Galloway commented that he had no objection to the demolition control application but had concerns regarding the future development of the site and in particular any required traffic controls on Fischer-Hallman Road. Councillor Galloway noted that other developments in the area were required to install turning lanes on Fischer-Hallman Road as part of the site plan DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MARCH 77 2005 - 19- CITY OF KITCHENER 3. DTS-05-028 - DEMOLITION CONTROL APPLICATION DC 05/01/G/CB (CONT'D) approval process and he questioned whether this would be a requirement of the future planned development for the site. Mr. L. Masseo advised that turning lanes and any other traffic controls on Fischer-Hallman Road were the responsibility and jurisdiction of the Region and would be determined during the site plan process. Councillor G. Lorentz raised a concern with the current configuration of Fischer-Hallman Road south of Ottawa Street whereby the road narrows from two lanes to one lane and asked whether or not a requirement of the future development would be the widening of Fisher-Hallman Road. Mr. Masseo responded that this would be reviewed at the site plan process and would be the jurisdiction of the Region. Councillor Galloway noted that although Fischer-Hallman Road was the jurisdiction of the Region and any traffic controls and widening of the road with respect to the future development of the subject site were the Region's responsibilities, the City should forward its concerns regarding the requirement of the future development of the subject property with respect to turning lanes and widening of Fischer- Hallman Road. Mayor C. Zehr suggested that staff bring to the Region's attention the concerns raised with respect to Fischer-Hallman Road and the future development of the subject property and that the minutes of this meeting be forwarded to the Region. On motion by Councillor M. Galloway - it was resolved: "That demolition control application DC 05/01/G/CB requesting permission to demolish one single detached dwelling located at 715 Fischer Hallman Road, legally described as Tract German Company Part Lot 47, be approved." 4. DTS-05-037 CEDAR HILL STUDY The Committee considered Development and Technical Services Department report DTS-05- 037, dated February 23, 2005, regarding the Cedar Hill Study. Mr. L. Masseo advised that at this time staff were recommending that the Cedar Hill Study be tabled for public review and that further discussion take place at the April 4, 2005 Development and Technical Services Committee meeting. On motion by Councillor G. Lorentz - it was resolved: "That the recommendations related to the Cedar Hill Study, contained within Development and Technical Services report DTS-05-037, be received and tabled for public review and comment, to be brought back for approval on April 4, 2005." DTS-05-038 DEMOLITION CONTROL APPLICATION DC 05/02/C/SR 103-105 COURTLAND AVENUE EAST SARFRAZ HOLDINGS INC. WEST-VICTORIA PARK WARD The Committee considered Development and Technical Services Department report DTS-05- 038, dated February 25, 2005, regarding a demolition control application to demolish one three- unit multiple dwelling located at 103-105 Courtland Avenue East. On motion by Councillor G. Lorentz - it was resolved: "That demolition control application DC 05/02/C/SR requesting permission to demolish one three-unit multiple dwelling located at 103- 105 Courtland Ave E, legally described as Lot 3, Plan 419, be approved, subject to the following condition: That prior to the issuance of a demolition permit, the owner submits a site plan application to the City's Planning Division, and obtains approval thereof from the City's Supervisor of Site Plan Development, for the proposed eight-unit multiple dwelling." DTS-05-026 - ZONE CHANGE APPLICATION ZC 03/01/K/TB 410 KING STREET WEST 410 KING PROPERTIES LIMITED BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 026, dated February 25, 2005, regarding a zone change application pertaining to a portion of the lands known as 410 King Street West which will remove the current 9H holding zone, allow some residential use at the ground floor and permit parking to encroach within the 3 metre setback along Francis Street. Mr. T. Boutilier advised that the City has received Zone Change Application ZC 03/01/K/TB from the property owner of 410 King Street West to allow the development of the property and existing building as a multi-residential use. He advised that the application proposes to remove the 9H holding zone as the requirements of the holding provisions have now been met. Mr. Boutilier added that the application has been circulated to the various agencies and public notice given in accordance to the Act and no concerns were received prior to the report being prepared. He pointed out that copies of comments received since that time from two parties have been circulated to members of the Committee this date and he advised that the concerns raised in the comments have been satisfied. Mr. Boutilier concluded his presentation saying that staff were of the opinion that the proposed zone change is in keeping with the intent of the municipal plan policies and were recommending adoption. Mr. Bill Green, GSP Group, attended representing the applicant and advised that his client was in agreement with the recommendation contained in the staff report and requested that the Committee approve the zone change application. There were no other delegations to speak on the matter. On motion by Councillor J. Smola - it was resolved: "That Zone Change Application ZC03/01/K/TB, proposing a change in zoning from "Warehouse District Zone (D-6),138 U,9H" to "Warehouse District Zone (D-6), 343U, 423R", be approved, in the form shown in the "Proposed Bylaw", dated February 14, 2005, attached to Development and Technical Services Department report DTS-05-026, without conditions." 7. SHERK HOMESTEAD Mayor C. Zehr declared a pecuniary interest as he owns property in the area of the Sherk Homestead lands and he did not participate in any discussion on the matter. Councillor J. Gazzola advised that he requested this item be further discussed at the meeting this date to see if a decision could be made with respect to the Sherk Homestead buildings and land located in the Pioneer Tower area. Councillor Gazzola explained that there were two issues to be resolved with respect to the Sherk Homestead being, the possible land trade with JHS Properties and the final disposition of the barn materials that came from the demolition of the Sherk Homestead barn and is currently in possession of Kieswetter Demolition company. Mr. Vern Sherk attended advising on the history of the lands from the time his family sold them in 1948 and how they came into possession of JHS Properties. Councillor M. Galloway in reference to a letter dated February 28, 2005 from Mr. & Mrs. Sherk to Members of Council, asked if the Waterloo Regional Heritage Foundation has committed to funding the purchase of the Sherk barn materials as stated in the letter. Mr. Sherk responded that although the Heritage Foundation has not made such a commitment it is within their mandate to protect the history in the Region and Mr. Sherk suggested that these particular lands are of regional heritage significance. In answer to questions raised by the Committee, Mr. G. Stewart advised that discussions have taken place between Mr. J. Willmer, Director of Planning and JHS Properties and Kieswetter Demolition but Mr. Willmer is currently on vacation and therefore staff can not provide any DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES MARCH 77 2005 - 21- CITY OF KITCHENER 7. SHERK HOMESTEAD (CONT'D) information at this time. He further advised that Kieswetter Demolition has not given any firm deadlines with respect to the potential sale of the barn material but there are no assurances that the sale won't take place prior to a final decision of Council. On suggestion by Councillor B. Vrbanovic, the Committee directed staff to communicate to Kieswetter Demolition with respect to allowing Council time to make a decision with respect to the barn material, to discuss with the Region the possibility of partnering with the City in protecting the heritage lands and buildings and, to report back to the Committee. Mr. G. Stewart advised that staff would provide Council an update at its meeting of March 21st and would bring back a full report to the Committee on April 4, 2005. 8.
