MINUTES OF THE REGULAR MEETING HELD MARCH 8, 2005
MEMBERS PRESENT: Messrs. P. Britton, D. Cybalski and B. Isaac.
OFFICIALS PRESENT:
Mr. B. Sloan, Planner, Ms. R. Brent, Assistant Secretary-Treasurer, and
Ms. D. Gilchrist, Secretary-Treasurer
Mr. P. Britton, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener
Municipal Code. The Committee will not make a decision on these applications but rather will make a
recommendation which will be forwarded to the Committee of the Whole and Council for final
decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, March 21,2005, at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant requests an exemption from the City's Sign By-
law to permit the replacement of an existing ground sign with a new ground sign that would be
set back 2.6 m (8.53 ft.) from the Queen Street property line instead of the required 3.0 m (9.8
ft.) and with a sign height of 2.38 m (7.8 ft) instead of 1.5 m (4.92 ft.). An exemption is also
requested for the installation of 2 signs proposed to be attached to the existing fence along the
entry to the Queen Street parking lot whereas the Sign By-law does not permit signs on
fences.
The Committee considered the report of the Development and Technical Services Department,
dated March 1,2005, advising they have no concerns with this application.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
February 25, 2005, advising they have no concerns with this application.
The Committee considered the report of the Grand River Conservation Authority, dated March
1,2005, advising that although the proposed new sign is located within the floodplain, a permit
from them is not required, and they have no objection to this application.

That the application of the Region of Waterloo requesting permission to replace an existing
ground sign with a new ground sign having a height of 2.38 m (7.8 ft.) rather than the permitted
height of 1.5 m (4.92 ft.) to be located 2.6 m (8.53 ft.) from Queen Street rather than the
required 3 m (9.8 ft.), and to erect 2 signs on the existing fence along the entry to the Queen
Street parking lot whereas signs on fences are not permitted in the Sign By-law, on Part Lot
11, Plan 58, being Part 1, Reference Plans 58R-1262, Part 1, Reference Plan 58R-4772, and
Part 1, Reference Plan 58R-6239, 464-466 Queen Street South, Kitchener, Ontario, BE
APPROVED.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
The general intent and purpose of the City of Kitchener Municipal Code Chapter 680
(Signs) is being maintained on the subject property.
