SPECIAL COUNCIL MINUTES
APRIL 4, 2005
CITY OF KITCHENER
A special meeting of City Council was held at 5:57 p.m. this date, Chaired by Mayor C. Zehr and with
all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Corporate Services Department report CRPS-05-050 (D. Gilchrist), dated
March 22, 2005, recommending an amendment to the minutes of the special meeting of Council held
January 31, 2005. P. Houston advised that the proposed amendment to the minutes, which dealt
with the 2005 Budget, is a clerical amendment to clarify the net transfers to and from the reserves.
Moved by Councillor J. Gazzola
Seconded by Councillor C. Weylie
"That the special Council meeting minutes of January 31, 2005 (Budget Day) be amended, on
page 17, Clause 8 of the report of the special Finance and Corporate Services Committee
meeting, so that the introductory sentence of Clause 8 reads as follows:
That the following 2005 net transfers to/from Reserves, resulting in the following projected
closing balances, be approved:'"
Carried.
Council was in receipt of Financial Services Department report FIN-05-014 (R. Upfold), dated March
29, 2005, regarding authorization to distribute the surplus of City of Kitchener Firefighter Pension Plan
Registration No. 239475.
Councillor J. Smola disclosed a pecuniary interest in respect to the Firefighter Pension Plan surplus
as he has a relative who was a member of the Plan and he abstained from all discussion and voting
on this matter.
Moved by Councillor G. Lorentz
Seconded by Councillor J. Gazzola
"That Council authorize Standard Life, upon receiving approval from the Financial Services
Commission of Ontario, to distribute the surplus of the City of Kitchener Firefighter Pension
Plan, Registration Number 239475, to the members."
Carried.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held earlier this date regarding the revised Terms of Reference for the Economic
Development Advisory Committee.
Moved by Councillor C. Weylie
Seconded by Councillor G. Lorentz
"That the Terms of Reference for the Economic Development Advisory Committee, dated April
2005, attached to Corporate Services Department report CRPS-05-054 (March 30, 2005), be
adopted."
Carried.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held earlier this date regarding an appointment to the Downtown Advisory Committee.
Moved by Councillor J. Smola
Seconded by Councillor M. Galloway
"That Mr. Tony DiBattista be appointed to represent the Live Entertainment sector of the
Downtown Advisory Committee, for a term expiring November 30, 2006."

Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held earlier this date regarding an appointment to Compass Kitchener.
Moved by Councillor B. Vrbanovic
Seconded by Councillor M. Galloway
"That Douglas Parker be appointed to the Compass Kitchener Committee for a term to expire
November 30, 2006."
Carried.
Councillor B. Vrbanovic advised that although Council was to consider a recommendation arising
from the Finance and Corporate Services Committee meeting held earlier this date with respect to the
proposed Consolidated Maintenance Facility; he suggested that the matter not be considered at this
special meeting of Council and be allowed to go to the April 11, 2005 regular meeting of Council for
consideration. Council agreed with Councillor Vrbanovic's suggestion and the matter was withdrawn.
Mayor C. Zehr advised that staff are requesting Council's consideration of two additional items not
listed on the special Council agenda.

"That pursuant to Chapter 25 of the Municipal Code (Council Procedure), the following matters
be added to the agenda of the special meeting of Council on April 4, 2005: consideration of
Corporate Services Department report CRPS-05-056 dated April 1, 2005, recommending that
the Open Ears Festival be declared a community festival for the purpose of applying for a
liquor licence; and, a by-law to establish and layout Part Lot 122, German Company Tract,
being Part 3 on Reference Plan 58R-276 as part of Shirley Avenue."
Carried Unanimously.
Council then considered Corporate Services Department report CRPS-05-056 (P. Harris), dated April
1, 2005, recommending that the Open Ears Festival to be held April 26 - May 1, 2005 at the Registry
Theatre be declared a 'community festival' for the purpose of applying for a liquor licence.
Moved by Councillor B. Vrbanovic
Seconded by Councillor G. Lorentz
"That the City of Kitchener has no objection to a liquor licence being issued to the Open Ears
Festival Committee for an event to be held April 26 to May 1, 2005 at the Registry Theatre,
122 Frederick Street; and further,
That the event be declared a 'Community Festival' for the purpose of applying for a liquor
licence."

Seconded by Councillor M. Galloway
"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a labour relations matter and three matters subject to solicitor-client privilege."
Carried.
Moved by Councillor C. Weylie
Seconded by Councillor J. Smola
"That leave be given the Mover and Seconder to introduce the following by-laws for three
readings and that the same be taken as read a first, second and third times, be finally passed and
numbered serially by the Clerk.

a) To confirm all actions and proceedings of the Council.
(By-law No. 2005-63)
(b) Being a by-law to provide for the establishment and laying out of part of Shirley Avenue as
a public highway in the City of Kitchener.
(By-law No. 2005-64)."
Carried.
On motion, the meeting adjourned at 6:03 p.m.
