HomeMy WebLinkAboutCouncil - 2005-06-09 S SPECIAL COUNCIL MINUTES JUNE 9, 2005 CITY OF KITCHENER A special meeting of City Council was held at 6:00 p.m. this date, Chaired by Mayor C. Zehr and with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of Corporate Services Department report CRPS-05-1 05 (P. Harris), dated June 7, 2005, recommending that permission be granted to hold a 'Running of the Bulls event' at the Kitchener Portuguese Club, 1548 Fischer-Hallman Road. R. Gosse, Director of Legislated Services, advised that the organizers of this event which will be part of the Portuguese Club's festival celebration and fundraising to be held June 11-12, 2005, will require a licence and an exemption to the Animal By-law to permit the involvement of the bulls which is a prohibited animal within the City. He further advised that the recommendation contained in the staff report contains various conditions to the licence which, in staff's opinion, will protect the City, the attendees to the event and the animals. L. MacDonald, Director of Legal Services & City Solicitor, advised that Council may wish to consider an additional condition restricting alcohol service on the premises until such time as the event is completed or as an alternative, prohibit consumption of alcohol by the participants of the event. Council agreed that the additional condition regarding the serving of alcohol would not be required by the City. Moved by Councillor G. Lorentz Seconded by Councillor J. Gazzola "That Mr. Joe Borges be granted permission to hold a running of the bulls event at the Kitchener Portuguese Club, 1548 Fischer Hallman Rd., on June 11 & 12, 2005 provided the necessary licence is obtained and the following conditions are attached to the required licence: Any Inspector of the Ontario Society for the Prevention of Cruelty to Animals, agent, or employee of a Humane Society must be in attendance throughout the two day event; and, Two Waterloo Regional Police officers must be in attendance at all times during the two day event and such officers are to be arranged and hired at the expense of the applicant; and, There must be an ambulance on the grounds at all times during the event; and, A big animal veterinarian must be on site at all times during the bull run and arranged for and hired at the applicants expense; and, An agent of the Canadian Food Inspection Agency is entitled to inspect the animals at any time; and, The animal cannot be involved in the event for more than 10 minutes at one time; and, The organizer of the event must provide a copy of their insurance policy to the City having at least $5,000,000.00 liability; and further, That Mr. Joe Borges be granted an exception under Chapter 408.2.13 and be granted an exemption from the Zoning By-law for the purposes of this event." Carried. Moved by Councillor M. Galloway Seconded by Councillor J. Smola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2005-110 by the Clerk."
