SPECIAL COUNCIL MINUTES
JUNE 27,2005
CITY OF KITCHENER
A special meeting of City Council was held at 12:25 noon this date, Chaired by Mayor C. Zehr and
with all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of correspondence from P. Bardouniotis, Dandy's Restaurant, requesting
permission to extend an outdoor patio on July 1, 2005 during the "Cruise Night" event. G. Sosnoski
advised that several requirements in regard to the original Encroachment Agreement for a sidewalk
patio have yet to be fulfilled and that the agreement itself has not been executed; however, it is
expected that all conditions will be fulfilled very shortly.
Moved by Councillor C. Weylie
Seconded by Councillor G. Lorentz
"That Kitchener City Council has no objection to the extension of the sidewalk patio at 85 King
Street West (Dandy's Restaurant) on July 1, 2005 only in conjunction with the Cruise Night
Event hosted by the Kitchener Downtown Business Association, and has no objection to an
extension of the current liquor licence in this regard; and further,
That the above approval is conditional upon execution of the patio encroachment agreement
previously approved by Council and the fulfilling of any and all conditions or requirements in
regard to that agreement."

Seconded by Councillor M. Galloway
"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a labour relations matters and three matters subject to solicitor-client privilege."
Carried.
The special Council meeting then recessed at 12:27 p.m. and reconvened at 10:12 p.m. Chaired by
Mayor C. Zehr with the following members present: Councillors C. Weylie, M. Galloway, J. Smola, B.
Vrbanovic, and J. Gazzola.
Council considered the recommendation of the Development and Technical Services Committee,
from its meeting held earlier this date, concerning the Region of Waterloo draft by-law to reduce the
use of pesticides.
Moved by Councillor C. Weylie
Seconded by Councillor B. Vrbanovic
"That the rationale provided by staff for requesting exemptions from any pesticide reduction for
the City of Kitchener Cemeteries and Sportsfield Sections be accepted and forwarded to the
Region of Waterloo for inclusion in any Pesticide Reduction By-law it may adopt; and,
That the City of Kitchener continue to monitor, and participate in, ongoing consultation In
respect of a possible Regional by-law to reduce the use of pesticides; and,
That the City of Kitchener reiterates its support for public education as a key initiative in efforts
to encourage the reduction of the non-essential use of pesticides in our community; and
further,
That the City of Kitchener thanks the Region of Waterloo for this first opportunity to provide
comment on its proposed Pesticide Reduction By-law, and looks forward to reviewing
proposed changes to any possible Regional by-law resulting from this public consultation
process and offering final comments in September 2005."

Seconded by Councillor C. Weylie
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2005-130 by the Clerk."
Carried.
On motion, the meeting adjourned at 10: 15 p.m.
