CITY OF KITCHENER
MINUTES OF THE REGULAR MEETING HELD JUNE 14, 2005

Mr. P. Britton, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to Chapter 630 (Fence) of the City of Kitchener
Municipal Code. The Committee will not make a decision on these applications but rather will make a
recommendation which will be forwarded to the Committee of the Whole and Council for final
decision.
The Chair explained that the Committee's decisions with respect to fence variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, June 20, 2005, at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that for each of these properties the applicant requests
permission to locate a noise wall, having a height of 1.82 m (5.97 ft.), 0 m from the side lot line
abutting a street, rather than the required 1.5 m (4.92 ft.). The noise walls have been required
through an approved noise study.
The Committee considered the report of the Development and Technical Services Department,
dated June 7, 2005, advising that Transportation Planning has reviewed these applications
and has determined that each of the existing noise walls infringe into the driveway visibility
triangle. It is recommended that they be altered so that they are outside of the 4.57 m
driveway visibility triangle ensuring vehicular and pedestrian traffic.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
June 7, 2005, advising they have no concerns with this application.
Upon questioning Ms. Dietrich advised she had just become aware these noise walls are
within the corner visibility triangles, and of the easement on 519 Doon South Drive. She
advised the walls are being constructed to meet the requirements of a noise study, and asked
for deferral of these applications to resolve issues with respect to compliance with the noise
study.

It was generally agreed by all parties that consideration of these applications be deferred to the
Committee of Adjustment meeting of July 12, 2005.
