HomeMy WebLinkAboutAdjustment - 2005-07-12 FN COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JULY 12~ 2005 MEMBERS PRESENT: Ms. D. Angel and Messrs. D. Cybalski and Z. Janecki. OFFICIALS PRESENT: Ms. T. Malone-Wright, Senior Planner and Ms. D. Gilchrist, Secretary- Treasurer Mr. D. Cybalski, Chair, called this meeting to order at 9:35 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 630 (Fence) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to fence variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, August 29, 2005, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Dietrich Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to locate a noise wall, having a height of 1.82 m (5.97 ft.), 0 m from the side lot line abutting a street, rather than the required 1.5 m (4.92 ft.). The noise walls have been required through an approved noise study. The Committee considered the comments of the Region of Waterloo Transportation Planner, dated July 3, 2005, and correspondence attached thereto from J.E. Coulter Associates Limited, dated June 27, 2005. In his comments, Mr. Erb, Transportation Planner, advises the original noise impact study for this subdivision contained an error, and it has been determined that these lots do not require noise walls. Ms. K. Dietrich addressed the Committee, advising that based on the Regional comments, these applications are withdrawn. The owners of the 3 properties on which these walls have already been constructed will be advised to either remove the walls, or relocate them in compliance with City by-laws.
