FOR THE
MINUTES OF THE REGULAR MEETING HELD AUGUST 16~ 2005
CITY OF KITCHENER
MEMBERS PRESENT: Messrs. D. Cybalski, Z. Janecki and B. Isaac.
OFFICIALS PRESENT: Ms. D. Ross, Senior Planner, Ms. R. Brent, Assistant Secretary-Treasurer,
and Ms. D. Gilchrist, Secretary-Treasurer
Mr. D. Cybalski, Chair, called this meeting to order at 10:05 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to Chapter 630 (Fence) of the City of Kitchener
Municipal Code. The Committee will not make a decision on these applications but rather will make a
recommendation which will be forwarded to the Committee of the Whole and Council for final
decision.
The Chair explained that the Committee's decisions with respect to fence variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, August 29, 2005, at 7:00 p.m., and
the applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant requests permission to erect a 3rd ground sign
on a institutionally zoned property, rather than the permitted 2 ground signs, to have a setback
of 1 m (3.28 ft.) from Westmount Road rather than the required 3 m (9.84 ft.), and a sign area
of 4 sq. m. (43.05 sq. ft.) rather than the permitted 3 sq. m. (32.29 ft.).

The Committee considered the report of the Development and Technical Services Department,
dated August 9, 2005, in which they advise they have no concerns with this application.
The Committee considered the report of the Region of Waterloo, Transportation Planner, dated
August 2, 2005, in which they advise they have no concerns with this application.
Mr. Snyder advised the Committee they had purchased this property 5 years ago, it having
formerly been used as a fire hall. The property merged in title with their existing property at 695
Blockline Road. The building is currently used as a daycare, which requires its own signage.
Upon questioning, Mr. Snyder advised the size of the sign is consistent with their corporate
standard, and is consistent with the other 2 signs on the property. With respect to the location, it
would place the sign well ahead of a tree on the property. Further, there is a very wide boulevard
in front of this property, and to set this sign any further into the property would make it ineffective.

That the application of Winston Hall Nursing Homes Ltd. requesting permission to erect a 3rd
ground sign on a institutionally zoned property, rather than the permitted 2 ground signs, to

5, Registrar's Compiled Plan 1483, being Part 3, Reference Plan 58R-1352, 1000 Westmount
Road East, Kitchener, Ontario, BE APPROVED, subject to the following condition:
1. That the proposed sign shall be located outside the 4.5 m (14.76 ft.) driveway visibility
triangle.
It is the opi nion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680
(Signs) is being maintained on the subject property.

Mr. Z. Janecki voted in opposition to this decision as he could not support the reduced
setback.

The Committee was advised that the applicant requests permission to add aluminium cladding
to cover the pylon on the 2 pylon signs on this property. They also request permission for the
sign on the Charles Street East frontage to be located 0.2 m (0.65 ft.) from a parking area
rather than the required 0.6 m (1.96 ft.), and to add a changeable copy panel having an area of
0.5 m (5.38 sq. ft.) to be located within the required 2.44 m (8 ft.) clearance.

The Committee considered the report of the Development and Technical Services Department,
dated August 9, 2005, in which they advise they have no concerns with this application.

Mr. Droeske advised the aluminium cladding proposed for these signs will contain the address of
the property, and provide a better appearance. The location for the Charles Street sign is
between the parking lot and the sidewalk, and is necessary in order to stay out of the visibility
triangle, and a barrier has been placed in that parking stall. The proposed chargeable copy will
inform people of upcoming events.
Upon questioning Ms. Ross advised the owners have received site plan approval for this
development, and the number and location of parking stalls are in compliance with the approved
site plan. Ms. Ross noted that it is the copy area of the sign and not the pylon, that will be located
0.2 m from the parking area.
Mr. Droeske advised the sign has already been erected, based on the sign contractor's
discussions with staff; further, any additional setback for the Charles Street sign would mean the
sign is not visible to traffic coming down Charles Street.
