SPECIAL COUNCIL MINUTES
SEPTEMBER 12, 2005
CITY OF KITCHENER
A special meeting of City Council was held at 3:16 p.m. this date, Chaired by Mayor C. Zehr and with
all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor G. Lorentz
Seconded by Councillor B. Vrbanovic
"That an in-camera meeting of City Council be held immediately following this special meeting
to consider two matters subject to solicitor-client privilege."
Carried.
Mayor C. Zehr advised of a request from staff that Council consider Corporate Services Department
report CRPS-05-136 (F. McCrea), dated September 12, 1005, which was not listed on the special
Council agenda.
Moved by Councillor M. Galloway
Seconded by Councillor C. Weylie
"That pursuant to Chapter 25 (Council Procedure) of the Municipal Code, the following matter
be added to the agenda of the special meeting of Council on September 12, 2005:
· Consideration of Corporate Services Department report CRPS-05-136 recommending that
the City enter into a Sub-License Agreement with the University of Waterloo."
Carried Unanimously.
Council was in receipt of Corporate Services Department report CRPS-05-136 (F. McCrea), dated
September 12, 2005, recommending that the City enter into a Sub-License Agreement with the
University of Waterloo to license the former Victoria Park Community Centre located at 25 Joseph
Street.
Moved by Councillor C. Weylie
Seconded by Councillor B. Vrbanovic
"That the City of Kitchener enter into a Sub-License Agreement with University of Waterloo to
license the former Victoria Park Community Centre premises located at 25 Joseph Street,
Kitchener, owned by Kitchener Housing Inc., for a term of 30 years (including renewals) for a
license fee of $1.00 per annum plus utilities and taxes and on such other terms and conditions
as are satisfactory to the City Solicitor; and,
That the City of Kitchener consent to the further Sub-License of the former Victoria Park
Community Centre by University of Waterloo to the physicians practicing in association as The
Centre for Family Medicine Teaching and Research on terms and conditions satisfactory to the
City Solicitor; and further,
That the Mayor and Clerk be authorized to execute the Sub-License to the University of
Waterloo and the Sub-License to the Centre for Family Medicine, and such other
documentation as may be necessary and approved by the City Solicitor."
Carried.
The special meeting then recessed at 3:20 p.m. and re-convened at 5:15 p.m., Chaired by Mayor C.
Zehr and with all members present.
Council considered a memorandum from L. Gordon regarding Tender T05-008, dated September 6,
2005, recommending that the tender for the Brentwood Avenue Reconstruction be awarded to E & E
Seegmiller Limited.

Seconded by Councillor M. Galloway
"That Tender T05-008, Brentwood Avenue Reconstruction (Sheldon Avenue North to
Montgomery Creek Outlet), be awarded to E. & E. Seegmiller Limited, Kitchener at their
tendered price of $2,586,397,85, including provisional and contingency items of $194,600. and
G.ST; and further,
That the Mayor and City Clerk be authorized to execute an agreement satisfactory to the City
Solicitor."
Carried.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held this date with respect to a requested exemption to Chapter 450 (Noise) of the Municipal
Code from the Freedom in Christ Family Church.
Moved by Councillor M. Galloway
Seconded by Councillor B. Vrbanovic
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the Freedom in Christ Family Church at 1643 Bleams Road, on Saturday, September 23,
2005, between the hours of 6:30 PM and 11 PM."
Carried.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held this date with respect to a requested exemption to Chapter 450 (Noise) of the Municipal
Code from Sowa Tool Limited.
Moved by Councillor G. Lorentz
Seconded by Councillor B. Vrbanovic
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the Concordia Club at 429 Ottawa Street South, on Thursday, September 29, 2005,
between the hours of 7:00 PM and 12 AM."

Seconded by Councillor J. Gazzola
"That leave be given the Mover and Seconder to introduce the following by-laws for three
readings and that the same be taken as read a first, second and third times, be finally passed and
numbered serially by the Clerk.
(a) Being a by-law to exempt certain lots from Part Lot Control - Part of Block 96, Registered
Plan 58M-226 - Chestnut Hill Crescent.
(By-law No. 2005-171)
(b) To confirm all actions and proceedings of the Council.
(By-law No. 2005-172)."
Carried.
On motion, the meeting adjourned at 5:16 p.m.
