CORPORATION OF THE CITY OF KITCHENER
(Being a by-law to amend Chapter 430 of The City of Kitchener
Municipal Code with respect to Group Homes - Registration.)
WHEREAS it is deemed expedient to amend Chapter 430 of The City of
Kitchener Municipal Code as adopted by By-law 88-100;
NOW THEREFORE the Council of the Corporation of the City of Kitchener
enacts as follows:
1. Section 430.1.1 of The City of Kitchener Municipal Code is hereby deleted in its
entirety and the following is substituted therefor:
"430.1.1
"group home" means a residence licensed or funded under a federal
or provincial statute for the accommodation of three to ten persons,
exclusive of staff, living under supervision in a single housekeeping
unit and who, by reason of their emotional, mental, social or physical
condition or legal status, require a group living arrangement for their
well being."
2. Section 430.1.2 of The City of Kitchener Municipal Code is hereby deleted in its
entirety and the following is substituted therefor:
"430 1 .2
"registrar of group homes" means the City's Manager of Design and
Development or designate."
3. Section 430.2.2 of The City of Kitchener Municipal Code is hereby amended by
deleting "as Schedule 'A' to this Chapter" and substituting "by the registrar of group
homes" therefor.
4. Section 430.2.3 of The City of Kitchener Municipal Code is hereby deleted in its
entirety.
5. Section 430.2.4 of The City of Kitchener Municipal Code is hereby deleted in its
entirety and the following is substituted therefor:
"430.2.4
Every owner or operator of a group home shall submit to the City a
brief description of the future group home on the owner/operator's
letterhead. The City will circulate the information to all property
owners within 60 meters (197 feet) of the proposed group home at

least twenty days prior to occupancy of the group home. The 60
meters (197 feet) shall be measured from the closest point of the lot
lines associated with each lot."
6. Section 430.2.5(a) of The City of Kitchener Municipal Code is hereby amended by
deleting "as Schedule 'A'to this Chapter" and substituting "in 430.2.2" therefor.
7. Section 430.2.6 of The City of Kitchener Municipal Code is hereby deleted in its
entirety and the following is substituted therefor:
"430.2.6
Every owner or operator of a group home, prior to first registration,
shall pay to the City a one time fee for the first registration of the
group home in such amount as is prescribed by Council from time to
time."
8. Section 430.2.7 of The City of Kitchener Municipal Code is hereby amended by
deleting "in the amount of Forty Dollars ($40) for the year 2002 and thereafter".
