HomeMy WebLinkAboutCouncil Minutes - 2001-10-15 SSPECIAL COUNCIL MINUTES OCTOBER 15, 2001CITY OF KITCHENER A special meeting of City Council was held at 12:05 p.m. this date and Chaired by Mayor C. Zehr with all members present . Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of correspondence from L. Gordon, Manager of Purchasing, dated October 11, 2001, recommending the awarding of a Expression of Interest E01-114, Consultant Services - Market Research - New Kitchener Market. Moved by Councillor C. Weylie Seconded by Councillor B. Vrbanovic "That Expression of Interest E01-114, Consultant Services - Market Research - New Kitchener Market, be awarded to CIC Innovation Consultants Inc., Waterloo, at their estimated fee of $34,186.50, including G.S.T., based on a satisfactory contract being negotiated and an upset fee being established." Carried. Council was in receipt of Development & Technical Services Department report DTS-01-012 (K. Smith), dated October 10, 2001, recommending execution of a Memorandum of Understanding to allow the temporary placement of a City of Mississauga employee in the Business Enterprise Centre. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler “That the Mayor and Clerk be authorized to execute a Memorandum of Understanding, satisfactory to the City Solicitor, with the Corporation of the City of Mississauga regarding the placement of a named Mississauga employee in the Business Enterprise Centre for the period October 22, 2001 to January 22, 2002.” Carried. Mayor C. Zehr advised of two additional items for discussion in-camera this date, both subject to solicitor-client privilege. Moved by Councillor J. Ziegler Seconded by Councillor B. Vrbanovic "That an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter, a land acquisition matter, a litigation matter, three labour relations matters and seven matters subject to solicitor-client privilege.” Carried. On motion, the meeting recessed at 12:12 p.m. and re-convened at 7:10 p.m., Chaired by Mayor C. Zehr and with all members present. Council then considered two matters referred from the in-camera meeting of this date. Moved by Councillor M. Galloway Seconded by Councillor J. Smola "That the Mayor and Clerk be authorized to execute an Extension Agreement pursuant to the Municipal Tax Sales Act with the registered owners of the property identified as Roll #30 12 040 037 223 00 0000, to extend the period of time to redeem the cancellation price by eight months, said agreement to be to the satisfaction of the City Solicitor." Carried. SPECIAL COUNCIL MINUTES OCTOBER 15, 2001- 400 -CITY OF KITCHENER Council was in receipt this date of Community Services Department report CSD-01-183 (K. Baulk/F. Pizzuto), dated October 15, 2001, recommending endorsement of a City of Cambridge staff report regarding the use of Cambridge lands in the expansion of the Doon Valley Golf Course. Mayor C. Zehr noted additional wording provided by Legal staff which is to form paragraph 2 of the recommendation in CSD-01-183. Moved by Councillor J. Ziegler Seconded by Councillor B. Vrbanovic "That staff be instructed to advise the City of Cambridge's Planning Services that the City of Kitchener voluntarily agrees to the recommendations contained in the October 15, 2001 report prepared by Jim Kirchin for the Planning and Development Committee of the City of Cambridge as it relates to the application for amendments to Cambridge's Official Plan and Zoning By-law, save and except that the City of Kitchener does not agree to pre-condition (ii) of the report (page 5) dealing with insurance/liability issues and suggest the following wording in its place: 'ii)provided a written undertaking to compensate, in exchange for a standard release, for property damage caused by errant golf balls from the City of Kitchener's golf course to the abutting residential properties on Morningside Drive, Cambridge, that back onto the golf course, to the satisfaction of the Commissioner of Planning Services for the City of Cambridge and the City of Kitchener's City Solicitor;'” Carried. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2001-190 by the Clerk."
