LEGER STREET & WELLINGTON STREET NORTH - TRAFFIC CONTROL CONDITIONS - BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-05- 203, dated November 17, 2005, recommending an all-way stop control be installed at the intersection of S1. Leger Street and Wellington Street North. On motion by Councillor G. Lorentz - it was resolved: "That an all-way stop control be installed at the intersection of S1. Leger Street and Wellington Street North; and further, That the Uniform Traffic By-law be amended accordingly." 2. DTS-05-204 - HURON ROAD AT STRASBURG ROAD - TRAFFIC CONTROL - SOUTH WARD The Committee considered Development and Technical Services Department report DTS-05- 204, dated November 23, 2005, recommending an all-way stop control be installed at the intersection of Huron Road and Strasburg Road. On motion by Councillor G. Lorentz - it was resolved: "That an all-way stop be installed at the intersection of Huron Road and Strasburg Road; and further, That the Uniform Traffic Control By-law be amended accordingly." 3. DTS-05-207 - TRAFFIC CALMING PROVINCIAL STATEMENT The Committee considered Development and Technical Services Department report DTS-05- 207, dated November 28, 2005, requesting the Province to amend its legislation to remove the requirement for Environmental Assessments for the implementation of traffic calming measures. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES DECEMBER 5. 2005 - 119- CITY OF KITCHENER 3. DTS-05-207 - TRAFFIC CALMING PROVINCIAL STATEMENT (CONT'D) On motion by Councillor G. Lorentz - it was resolved: "That the Province be requested to amend its legislation to remove the requirement for Environmental Assessments for the implementation of traffic calming measures; and further, That the aforementioned request be circulated to the Association of Municipalities of Ontario and all Ontario municipalities having a population of greater than 100,000." 4. DTS-05-198 - ZONE CHANGE APPLICATION ZC OS/20/W/BB - 173 WOOLNER DRIVE - GRAND RIVER SOUTH - TLV DEVELOPMENTS INC. - CHICOPEE-GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-05- 198, dated November 24, 2005, regarding Zone Change Application ZC OS/20/W/BB to change the zoning on the lands municipally known as 173 Woolner Drive. Mr. B. Sloan reviewed the report for the benefit of the Committee. Mr. G. Scheels, GSP Group was in attendance on behalf of the applicant in support of the staff recommendation. On motion by Mayor C. Zehr - it was resolved: "That Zone Change Application ZC OS/20/W/BB (173 Woolner Drive) for the purpose of changing the zoning from Residential Three Zone (R-3) and Residential Three Zone (R-3) with special regulation provision 175R to Residential Three Zone (R-3) with special regulation provision 437R; Residential Three (R-3) with special regulation 438R; Residential Three (R-3) with special regulation 175R and Residential Three Zone (R-3) with special regulation provisions 175R and 437R on lands legally described as Part of Lots 117,118 & 124, G.C.T., Part of Lot 12, R.P. 591, in the City of Kitchener, ~ aooroved in the form shown in the "Proposed By-law" dated November 18, 2005, attached to Development and Technical Services Department report DTS-05-198, without conditions." 5. DTS-05-194 - PLAN OF SUBDIVISION 30T-98204 - WESTFOREST TRAIL - LOTCO LTD. - WEST-VICTORIA PARK WARD The Committee considered Development and Technical Services Department report DTS-05- 194, dated November 28, 2005, regarding Plan of Subdivision 30T-98204 for lands located on Westforest Trail. Mr. J. Will mer requested an amendment to Regional Municipality of Waterloo condition #5, on page 6 of the staff report, to remove the word "updated" before the words "noise study". Mr. J. Vernhout was in attendance on behalf of Lotco Ltd., in support of the staff recommendation, including the amendment put forward by Mr. Will mer. On motion by Councillor G. Lorentz - it was resolved: "That the recommendation contained in Development and Technical Services Department report DTS-05-194, dated November 28, 2005, regarding Plan of Subdivision 30T-98204, be aooroved, subject to removing the word "updated" before the words "noise study" in the first line of Regional Municipality of Waterloo condition #5." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES DECEMBER 5. 2005 - 120- CITY OF KITCHENER 6. DTS-05-195 - ZONE CHANGE APPLICATION ZC 05/02/G/BS - MODIFICATION TO DRAFT APPROVED PLAN OF SUBDIVISION 30T-88015 - 1094 GLASGOW STREET - GLASGOW HEIGHTS - LOTCO LTD. - WEST-VICTORIA PARK WARD The Committee considered Development and Technical Services Department report DTS-05- 195, dated November 22, 2005, regarding Zone Change Application ZC 05/02/G/BS and Modification to Draft Approved Plan of Subdivision 30T-88015 on the lands municipally known as 1094 Glasgow Street. Mr. B. Sloan provided an overview of the situation, advising a plan of subdivision was draft approved for this property in 1996. This property has recently been sold to a new builder. The storm water management pond is no longer required, and the owner now proposes to rezone the land which had previously been designated for that use. Mr. Sloan then explained the subdivision conditions now need to be updated. There is one outstanding issue between the applicant and staff, being a noise wall along University Avenue, not required when the original plan was registered. Staff are proposing a 2 metre landscape buffer along University Avenue, whereas the applicant proposes a 1 metre buffer. The buffer will provide an area of landscaping between the noise wall and the sidewalk. Mr. Vernhout, Lotco Ltd., displayed a plan showing the two lots, being lots 18 & 19, which will be affected by the landscape buffer. He advised a 3 metre wide buffer will create problems in trying to site houses on these lots, as it creates two small a building envelope. Staff clarified for Mr. Vernhout that the required setback from the cul-de-sac is 4.5 metres and not 8 metres as shown on his plan. The 8 metre setback is only required from University Avenue. Mayor Zehr requested that prior to next Monday night's Council meeting, staff work with the applicant to determine a building envelope for each of these two lots. On motion by Mayor C. Zehr - it was resolved: "That the recommendations for the modification to plan of subdivision 30T-88015 and zone change application ZC 05/02/G/BS (1094 Glasgow Street) as contained in Appendix A to Development and Technical Services Department report DTS-05-195-PL be approved." 7. DTS-05-193 - KINGSWOOD DRIVE TRAFFIC CALMING SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT The Committee considered Development and Technical Services Department report DTS-05- 193, dated November 14, 2005, regarding the Kingswood Drive traffic calming Schedule B Class Environmental Assessment. The Committee members had previously been provided with copies of the Traffic Calming Environmental Assessment, Kingswood Drive, prepared by Paradigm Transportation Solutions Ltd., dated November 11,2005. Mr. P. Grubb, Paradigm Transportation Solutions Ltd., was in attendance and presented the environmental assessment. He advised they had good support from the residents; however, only 47% of them responded to the survey. He stated it is staff's intention to proceed with temporary installations of the traffic calming measures in January, which will be monitored, and can be changed prior to permanent installation of these measures. The cost to the City for these traffic calming measures will be $70,000. Also, he advised there are recommendations for the Region arising from this study. Councillor Gazzola questioned whether the plan with the island in the middle of the road has been reviewed with operations staff, and Mr. McBride advised it has been reviewed by Operations staff, Grand River Transit and all emergency services, all of whom advise that these traffic calming measures are manageable. DTS-05-193 - KINGSWOOD DRIVE TRAFFIC CALMING SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT (CONT'D) With respect to regional issues, Mr. McBride advised these recommendations have been discussed with the Region and they will consider installing a round-about at Kingswood and Block Line; however, the widening of Homer Watson Boulevard is a long term solution. Ms. M. Linnington, an area resident, was in attendance in opposition to the recommendations in the staff report. She had previously provided members of the Committee with a written submission outlining her concerns in this regard, and provided them with a second written submission at this meeting which she read aloud. Ms. Linnington advised that one of her main concerns is that proceeding with these recommendations does not comply with Council's Policy, which requires that a response from a minimum of 50% of the affected residents is required, and 60% of them must support the recommended plan. She pointed out that 632 surveys were delivered and only 176 responses were received, being substantially lower than 50%. Further, apartment buildings were only allowed one vote, on the premise that "apartment dwellers would be less impacted because apartment units are 'well-setback from the roadway"'. She noted that narrowing devices affect everyone driving on the road, no matter what type of dwelling unit they live in. Other concerns raised by Ms. Linnington included, problems created for buses and access by emergency vehicles, and that the installation of traffic calming measures on Kingswood Drive would only move the traffic problems to other streets such as Selkirk Drive and Geneva Crescent. She requested that the only measure taken be the installation of an all-way stop at Alpine Road and Kingswood Drive, and that consideration of the remaining recommendations be deferred until further consideration can be given to the issues she has raised. In response to comments made by Ms. Linnington, Mr. McBride stated that it had been agreed that each apartment building would have one vote based on the majority response from the tenants in that building. With respect to Ms. Linnington's comments about moving the traffic problems to other streets, Mr. McBride responded that staff do not anticipate this will be the case. Councillor Gazzola noted that temporary measures only will be installed at this time, and this will provide an opportunity to determine whether traffic problems will shift to other streets or cause a problem for any vehicles. He also directed that staff solicit comments from the neighbours as to the affects of and desireability of these temporary traffic calming measures, before any permanent measures are installed. On motion by Councillor J. Gazzola - it was resolved: "That the Recommended Plan as detailed in the Executive Summary in Development and Technical Services Department report DTS-05-193, be endorsed; and, That the Class B Environmental Assessment (EA) Project File Report for the Kingswood Drive Traffic Calming Study be filed with the City Clerk for a thirty (30) day public review commencing December 13, 2005; and, That the Recommend Plan be installed on a temporary basis to monitor the operation of winter maintenance and to be implemented on a permanent basis as funds permit; and further, That prior to any permanent traffic calming measures being installed, staff solicit input from the residents as to the effectiveness of the temporary measures and the desireability of installing these measures permanently." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES DECEMBER 5. 2005 - 122- CITY OF KITCHENER 8. DTS-05-206 - HIDDEN VALLEY SANITARY SEWAGE SERVICING STUDY SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT The Committee considered Development and Technical Services Department report DTS-05- 206, dated November 24, 2005, regarding Hidden Valley Sanitary Sewage Servicing Study Schedule B Class Environmental Assessment. On motion by Councillor G. Lorentz - it was resolved: "That the preferred design alternative (Alternative F) for Draft Plan of Subdivision 30T- 04201 (Hidden Valley), as set out in the Executive Summary in Development and Technical Services Department report DTS-05-206 be aooroved, and the Schedule 'B' Class Environmental Assessment Report for this project be filed with the City Clerk for the mandatory 30 day public review period." 9. DTS-05-205 - NEIGHBOURHOOD DESIGN INITIATIVE AND DESIGN BRIEF FOR SUBDIVISIONS The Committee considered Development and Technical Services Department report DTS-05- 205, dated November 29, 2005, regarding neighbourhood design initiative and design brief for subdivisions. Ms. C. Dixon and Messrs. R. Mounsey and B. Sloan presented the Neighbourhood Design Initiative and Design Brief for subdivisions, as outlined in the staff report. Mayor C. Zehr left the meeting during this presentation. On motion by Councillor B. Vrbanovic - it was resolved: "That Development and Technical Services Department report DTS-05-205 regarding an update to the City of Kitchener's Neighbourhood Design Initiative and Design Brief for Subdivisions be received for information; and further, That any Planning Reports submitted in support of, or containing recommendations on, new plan of subdivision applications should include a dedicated section that identifies how the proposed development addresses the current Neighbourhood Design Guidelines within the City of Kitchener Urban Design Manual." 10. DTS-05-188 - GROWTH MANAGEMENT - A "MADE IN KITCHENER" APPROACH The Committee considered Development and Technical Services Department report DTS-05- 188, dated November 28, 2005, regarding a growth management strategy for the City of Kitchener. Ms. J. Given attended the meeting and presented the staff report. On motion by Councillor J. Smola - it was resolved: "That a comprehensive community engagement process on growth management form the next phase in the development of a growth management strategy for Kitchener." 11. DTS-05-211 - TEMPORARY OCCUPANCY REQUEST - 9 PLEASANT AVENUE - ST. MARY'S GENERAL HOSPITAL - FOREST-ROCKWAY WARD The Committee agreed to add an item for consideration, being Development and Technical Services Department report DTS-05-211, recommending temporary occupancy of 9 Pleasant Avenue, by St. Mary's Hospital, pending the outcome of an Application for Minor Variance, which would permit an off-street parking agreement to allow parking for 9 Pleasant Avenue to be DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES DECEMBER 5. 2005 - 123- CITY OF KITCHENER 11. DTS-05-211 - TEMPORARY OCCUPANCY REQUEST (CONT'D) located on other lands owned by the hospital. The Application for Minor Variance will be considered by the Committee of Adjustment on January 10, 2006. Mr. Willmer reminded the Committee that they recently considered an application for a zone change for the subject property for a temporary use, to allow an office for a social service agency to occupy the building at 9 Pleasant Avenue. It has always been the intention that the required off-street parking for the office would be provided in the hospital's existing parking lot. However, the zoning by-law does not permit parking agreements for institutional zones unless the use requiring parking is also in an institutional zone. On motion by Councillor G. Lorentz - it was resolved: "That enforcement of the City's Zoning By-law be waived with respect to the requirement for an off-street parking agreement to accommodate the required parking at 9 Pleasant Avenue, and temporary occupancy be approved; subject to the office ancillary to a hospital vacating the location in the event that the entire site is not granted minor variance approval to allow 9 Pleasant Avenue to enter into an off-street parking agreement with St. Mary's Hospital; and further, That in the event of failure to vacate, the City's Municipal By-law Enforcement Officer be directed to commence notice of action to remove the illegal use, and that any work done to the premises be at the sole risk and responsibility of the owner in the event losses are incurred as a result of the final disposition of this application." 12.
