Gilchrist, Committee Administrator DTS-06-003 - CROSSING GUARD FACILITY ELIMINATION - BELMONT AVENUE & QUEENS BLVD - FOREST-ROCKWAY WARD The Committee considered Development and Technical Services Department report DTS-06- 003, dated December 20, 2005, regarding the elimination of the Crossing Guard Facility at the intersection of Belmont Avenue and Queen's Boulevard. Mr. J. McBride advised only 4 children still use this crossing, and the school principal will be contacting the parents to advise there will no longer be a crossing guard at this location. On motion by Councillor J. Smola - itwas resolved: "That the Crossing Guard Facility at the intersection of Belmont Avenue and Queen's Boulevard be eliminated effective January 17, 2006." DTS-06-004 - ON-STREET PARKING - COLLEGE STREET BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-06- 004, dated December 28, 2005, regarding on-street parking on College Street. On motion by Councillor J. Smola - itwas resolved: "That on-street parking be permitted for one (1) hour between the hours of 8:00 a.m. to 6:00 p.m., Monday to Friday, from April 1St to December 31St, on the east side of College Street from Ahrens Street to Weber Street West; and further, That the Uniform Traffic By-law be amended accordingly." DTS-05-213 -LISTING OF NON-DESIGNATED PROPERTY OF CULTURAL HERITAGE VALUE OR INTEREST ON THE HERITAGE REGISTER CRPS-06-009 -AMENDMENT TO COUNCIL POLICY I-110 (HERITAGE KITCHENER - TERMS OF REFERENCE) -INCLUSION OF NON-DESIGNATED PROPERTIES ON THE CITY'S HERITAGE REGISTER The Committee considered Development and Technical Services Department report DTS-05- 213, dated December 16, 2005, regarding the listing of non-designated property of cultural heritage value or interest on the heritage register. The Committee also considered Corporate Services Department report CRPS-06-009, dated January 4, 2006, regarding an amendment to DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 2- CITY OF KITCHENER 3. DTS-05-213 -LISTING OF NON-DESIGNATED PROPERTY OF CULTURAL HERITAGE VALUE OR INTEREST ON THE HERITAGE REGISTER CRPS-06-009 -AMENDMENT TO COUNCIL POLICY I-110 (HERITAGE KITCHENER - TERMS OF REFERENCE) -INCLUSION OF NON-DESIGNATED PROPERTIES ON THE CITY'S HERITAGE REGISTER (CONT'D) Council Policy I-110 (Heritage Kitchener -Terms of Reference) -inclusion of non-designated properties on the City's heritage register. Mr. Bensason advised staff are in agreement with the Heritage Kitchener recommendation, and wish to change the recommendation in DTS-05-213 to that contained in CRPS-06-009. Mr. Bensason then reviewed report DTS-05-213, advising of the recent changes to the Ontario Heritage Act and the new provision to allow municipal councils to add non-designate properties to the Heritage Register in addition to properties that have been designated under the Ontario Heritage Act. Consequently, the Heritage Register would serve as a consolidation to identify all properties formally considered to be of cultural heritage value or interest. Mr. Bensason then explained the significance attributed to listed properties, through the Provincial Policy Statement issued under the authority of Section 3 of the Planning Act, effective March 1, 2005. Policy 2.6.1 of the Policy Statement states that "...significant built heritage resources and cultural heritage landscapes shall be conserved." The definition of built heritage resources, in the Provincial Policy Statement, was changed to add the following: "These resources may be identified through designation or heritage conservation easement under the Ontario Heritage Act, or listed by local, provincial or federal jurisdictions." Mr. Bensason noted that by adding this sentence to the definition of built heritage resources, the City has a responsibility when deciding on Planning Act applications affecting non-designated but listed heritage resources, that the decisions must be consistent with the Provincial Policy Statement, which states these resources shall be conserved. Mr. Bensason then reviewed the steps to be taken prior to a recommendation coming to Council from Heritage Kitchener to list non-designated properties of cultural heritage value or interest on the Heritage Register. He advised that by following this process, it is intended that the current heritage inventory will eventually become redundant. He also advised that by use of funding from the Heritage Conservation District account, Ms. S. Barber's contract will be extended to undertake the required work for this project. He stated the first properties to go through this process will be those located in Centre Block. Councillor M. Galloway moved the recommendation as put forward by Mr. Bensason at this meeting. Mayor Zehr questioned whether there is an appeal process for property owners. Mr. Bensason advised an appeal process is not included in the Ontario Heritage Act; however, non-designated properties can only be added to the Heritage Register with Council's approval. Staff believe it is important for the property owner to be informed that their property is being considered for inclusion in the register, and given an opportunity to state their position in this regard, before a recommendation comes to Council. Mayor Zehr expressed concern that the rights of property owners of non-designated properties on the register will be restricted without them having recourse to an appeal process. Also, there appears to be conflict between the Ontario Heritage Act and the Planning Act. Further, this responsibility places far more onus on Council. Councillor Galloway advised that Heritage Kitchener took a great deal of time and thought in developing this procedure to be followed before they can recommend properties to be added to the Heritage Register, and the process is substantial. Mayor Zehr put forward a recommendation to defer consideration of this matter to next Monday night's Council meeting to allow him an opportunity to get more information from staff on the impact to property owners of having their properties included on the Heritage Register. DTS-05-213 -LISTING OF NON-DESIGNATED PROPERTY OF CULTURAL HERITAGE VALUE OR INTEREST ON THE HERITAGE REGISTER CRPS-06-009 -AMENDMENT TO COUNCIL POLICY I-110 (HERITAGE KITCHENER - TERMS OF REFERENCE) -INCLUSION OF NON-DESIGNATED PROPERTIES ON THE CITY'S HERITAGE REGISTER (CONT'D) On motion by Mayor C. Zehr - itwas resolved: "That consideration of the following recommendation, contained in Corporate Services Department report CRPS-06-009 and supported by Development and Technical Services Department report DTS-05-213, be deferred and referred to the Council meeting of January 16, 2006, pending a further explanation from staff as to the affect that the Provincial Policy Statement on the Planning Act will have on non-designated properties that are listed on the City's Heritage Register: That Council Policy I-110 (Heritage Kitchener -Terms of Reference) be amended by repealing clause 4. b), and replacing it with the following: `4. b) Recommend to City Council non-designated properties of cultural heritage value or interest to be added to the Heritage Register.'; and, That Heritage Kitchener review and evaluate the properties on the City's heritage inventory, as to their cultural heritage value or interest, and recommend to Council those which aught to be listed as non-designated properties in the Heritage Register; and further, That the City's existing heritage inventory become redundant once all properties listed thereon have been reviewed and evaluated, and a decision has been made as to which of them will be added to the Heritage Register." 4. DTS-05-216 - STRANGE STREET RECONSTRUCTION -EXPANSION OF PROJECT SCOPE The Committee considered Development and Technical Services Department report DTS-05- 216, dated November 23, 2005, regarding the expansion of the scope for the Strange Street reconstruction project. Mr. Allen presented the staff report, and advised the additional cost will be $60,000. On motion by Councillor G. Lorentz - itwas resolved: "That the scope of the Strange Street reconstruction be expanded to include the reconstruction of Elm Street, the diversion of the Cherry Park storm outlet, and more detailed geotechnical investigation due to the discovery of potential contamination in the Strange Street right-of-way." 5. DTS-06-001 - EPTON PARKING LOT DEVELOPMENT BUSINESS CASE The Committee considered Development and Technical Services Department report DTS-06- 001, dated January 4, 2006, regarding the development of a surface parking lot on the Epton lands. Mr. J. McBride was in attendance to present the report, and answer any questions the Committee might have. He advised the City will be able to recover the full development costs for this parking lot, as outlined in the report. Ms. C. Ladd clarified that the City's agreement with the University of Waterloo for development of the School of Pharmacy includes a $30M capital investment plus lands of a specific dimension at the Epton site; which contribution has always been included in the business case for this project. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 4- CITY OF KITCHENER 5. DTS-06-001 - EPTON PARKING LOT DEVELOPMENT BUSINESS CASE (CONT'D) On motion by Mayor C. Zehr - itwas resolved: "That a surface parking lot be developed on the Epton lands during the 2006 construction season, as outlined in the business case attached to Development and Technical Services Department report DTS-06-001; and, That the $1.2M cost of developing this surface parking lot be paid from the Economic Development Investment Fund, with net revenues from the operation of this parking lot being used to repay the capital developments costs; and further, That once these parking spaces are occupied by future phases of the University of Waterloo Campus, any outstanding balance of the capital costs for the development of this surface parking lot shall be recovered from the University of Waterloo." 6. DTS-05-212 - REGIONAL SIGN BY-LAW The Committee considered Development and Technical Services Department report DTS-05- 212, dated December 23, 2005, regarding the Regional sign by-law. Mr. J. Willmer presented the staff report, advising staff's only concerns relate to A-signs, and they are requesting the Region discuss use of this type of sign with the Home Builders Association; and election signage on Regional roads. On motion by Councillor G. Lorentz - itwas resolved: "That the Draft Regional Sign By-law appended to Regional Report E-05-144 and attached to City of Kitchener report DTS-05-212 be received for information; and, That the Regional Municipality of Waterloo be requested to review its proposed by-law with the K-W Homebuilders Association before final approval with special regard to A- frame signs within the Regional road allowance; and further, That the City of Kitchener supports, in principle, provisions that may be put in place to control the number of election signs permitted to be displayed within a fixed geographic area." 7. DTS-05-192 - PLAN OF SUBDIVISION 30T-04205 - ZONE CHANGE APPLICATION ZC 04/25/H/BB - 591 HURON ROAD - ACTIVA HOLDINGS INC. SOUTH WARD The Committee considered Development and Technical Services Department report DTS-05- 192, dated December 20, 2005, regarding Zone Change Application ZC 04/25/H/BB to change the zoning on the subject lands located at 591 Huron Road. Mr. J. Willmer reviewed the report, and an amendment distributed to the Committee this date. In the amendment, staff recommend that condition 6.11 of the City's conditions be reworded as follows: "The SUBDIVIDER agrees that prior to the registration of the plan, or at the discretion of the Director of Engineering, the Environmental Assessment be completed to determine the design requirements for the Flood control Structure (weir) required for Block 29 (Stage 3), 30T-01201 and be constructed to the satisfaction of the CITY's Director of Engineering. Alternatively, if the SUBDIVIDER submits astudy/analysis that demonstrates that an alternative storm water management scheme is viable without the need for an Environmental Assessment and construction of the flood control facility (weir), the plan may proceed to registration upon DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 5- CITY OF KITCHENER 7. DTS-05-192 - PLAN OF SUBDIVISION 30T-04205 (CONT'D) clearance from the Director of Engineering in consultation with the Grand River Conservation Authority." Mr. P. Chauvin, MHBC Planning was in attendance on behalf of the applicant, in support of the staff recommendation. On motion by Councillor M. Galloway - itwas resolved: "That the recommendations contained in Development and Technical Services Department report DTS-05-192, dated December 20, 2005, regarding Plan of Subdivision 30T-04205 and Zone Change Application ZC 04/25/H/BB (591 Huron Road), be approved; subject to the following change in wording to City of Kitchener condition 6.11: "The SUBDIVIDER agrees that prior to the registration of the plan, or at the discretion of the Director of Engineering, the Environmental Assessment be completed to determine the design requirements for the Flood Control Structure (weir) required for Block 29 (Stage 3), 30T-01201 and be constructed to the satisfaction of the CITY's Director of Engineering. DTS-05-210 - ZONE CHANGE APPLICATION ZC 05/22/F/DR - 1201 FISCHER HALLMAN ROAD - ROBERT & BRYAN KIESWETTER - SOUTH WARD The Committee considered Development and Technical Services Department report DTS-05- 210, dated December 5, 2005, regarding Zone Change Application ZC 05/22/F/DR to change the zoning on the subject lands located at 1201 Fischer Hallman Road. Mr. J. Willmer reviewed the report confirming a Record of Site Condition for this property has been acknowledged by the Ministry and the Region. Mr. P. Britton, MHBC Planning, was in attendance on behalf of the applicant, in support of the staff recommendation. On motion by Councillor M. Galloway - itwas resolved: "That Zone Change Application ZC 05/22/F/DR (1201 Fischer Hallman Road) to change the zoning from Convenience Commercial Zone (C-1) with Special Use Provision 321 U and Holding Provision 49H to Convenience Commercial Zone (C-1) with Special Use Provision 321 U on lands legally described as Lot 3 Registrars Compiled Plan 1470, municipally known as 1201 Fischer Hallman Road, in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated December 5, 2005, attached to Development and Technical Services Department report DTS-05-210." DTS-06-002 - GREENBROOK DRIVE TRAFFIC CALMING SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT The Committee considered Development and Technical Services Department report DTS-06- 002, dated December 23, 2005, regarding the Greenbrook Drive traffic calming Schedule B Class Environmental Assessment. The Committee members had previously been provided with copies of the Traffic Calming Environmental Assessment, Greenbrook Drive, prepared by Paradigm Transportation Solutions Ltd., dated December 30, 2005. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 6- CITY OF KITCHENER 9. DTS-06-002 - GREENBROOK DRIVE TRAFFIC CALMING SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT (CONT'D) Mr. P. Grubb, Paradigm Transportation Solutions Ltd., presented the Traffic Calming Environmental Assessment for Greenbrook Drive. In conclusion he advised that figure 4.5 on page 30 of the assessment is the recommended solution. Further problems identified at the intersection of Greenbrook Drive and Westmount Road East are beyond this assessment, and the Region of Waterloo will be conducting a study on this intersection. Mr. O. Lackenbauer addressed the Committee in this regard advising he has lived at his property on Greenbrook Drive, between Westmount and Stirling, for 22 years. He commended Councillor Lorentz and staff for the excellent public consultation process with respect to this environmental assessment, and advised he supports the study, but more needs to be done. Mr. Lackenbauer noted the following problems that need to be addressed: • traffic exiting Homer Watson Boulevard using either Pleasant Avenue and Perth Road or Greenbrook Drive, require re-instatement of the plan respecting Homer Watson Boulevard being extended to Belmont Avenue; • traffic on Greenbrook Drive has increased dramatically; • this is a "recycled" neighbourhood, with younger families with young children again populating this area; • Police have clocked vehicles travelling at as much as 92 km/h r. He again advised he supports this environmental assessment. Mr. J. Hoey, a resident in the area of Blue Ridge Drive, Gatewood Road and Lakeside Drive, addressed the Committee providing the following concerns: • implementation of the solution proposed in the environmental assessment will cause an increase in traffic on other streets in his area, as traffic seeks other routes in order to avoid these traffic calming measures; • currently there is a 3-way stop at Stirling Avenue, which makes left turns very difficult, if there is a chicane between Lakeside Drive and the pumping station it will be impossible to turn left; • although Gatewood Road and Blue Ridge Drive don't abut Greenbrook Drive, he felt the residents on these streets should have had the opportunity of participating in the public consultation for this assessment, as their streets will be impacted by the measures proposed. Mr. Hoey suggested the City should consider a less expensive method of dealing with traffic calming such as 3-way and 4-way stops. Mr. Grubb advised the purpose of installing these traffic calming measures on a temporary basis, starting in February, is to allow Grand River Transit and the City's Operations staff (snowploughing) to experience what problems may occur. Further, it is not expected there will be a major diversion of traffic to other streets as a result of these proposed measures, which will only cause a 2 second increase in travel time. Upon questioning, Mr. McBride advised some of the temporary traffic calming measures will be installed in mid-February, after the required 30 day filing period. The remainder will be installed in April. These temporary measures will be in place for approximately 3 months, they will then be evaluated, including input from residents. Staff will present a report to Council in the late summer or early fall. Then permanent traffic calming measures will be installed as the funding becomes available. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 7- CITY OF KITCHENER 9. DTS-06-002 - GREENBROOK DRIVE TRAFFIC CALMING SCHEDULE B CLASS ENVIRONMENTAL ASSESSMENT (CONT'D) On motion by Councillor G. Lorentz - itwas resolved: "That the Preferred Alternative outlined in the "Traffic Calming Environmental Assessment Greenbrook Drive", dated December 30, 2005, prepared by Paradigm Transportation Solutions Ltd., be endorsed; and, That the Class B Environmental Assessment (EA) project file report for the Greenbrook Drive Traffic Calming Study be filed with the City Clerk for a thirty (30) day public review commencing January 17, 2006; and, That the Recommended Plan be installed on a temporary basis in order to monitor the operation of winter maintenance, to be implemented on a permanent basis as funding permits; and further, That prior to any permanent traffic calming measures being installed, staff solicit input from the residents as to the effectiveness of the temporary measures and the desirability of installing these measures permanently." 10. PRESENTATION -SOUTH KITCHENER TRANSPORTATION CORRIDOR STUDY Ms. P. Sawicki and Mr. D. Drackley, Regional Municipality of Waterloo, were in attendance to present the Region's "South Kitchener Transportation Corridor Study". Through their presentation they identified the major public issues which came to light through the public consultation process, being: environment/natural area impacts, roadway continuity/traffic congestion, groundwater impacts, and the impact on Stonegate Drive. The main problems identified in the study include: worsening capacity deficiencies at key intersections; Fairway Road will be at capacity by 2011; limited Highway 8 access; and, beyond 2011, planned roadway capacity improvements alone cannot accommodate further traffic growth. In terms of identifying the best solution to address traffic and transportation problems, the study takes into consideration the natural heritage, cultural landscape and archaeology in the Hidden Valley area. It was outlined in the presentation that there are forested lands abutting ESPA 27 that meet the Region's ESPA criteria, and should be designated as such. Cultural heritage highlights include 2 designated heritage properties and 1 ruin. Other highlights include this area as being a significant groundwater recharge zone with 3 Regional wells near Manitou Drive. Of the solutions put forward in the study, the public preferred Option #5, where the Grand River Conservation Authority preferred Option #4. Regional staff put forward a hybrid Alternative #4 with a partial interchange at Highway 8 and Fairway Road, requiring a new northbound ramp, which they believe is the best compromise solution. The City and the Region will have to deal with the residents of Stonegate Drive. Mr. Sawicki advised that Regional staff need comments from the City of Kitchener on this study by the end of February and its is expected that Regional Council will make its final decision in 3- 4months. Ms. D. Nicholls was in attendance to present her request that the Region do its utmost to preserve the natural heritage in this area through this process. She read aloud her written submission which was distributed to members of the Committee this date. 11. DTS-05-201 - ADDENDUM TO DTS-05-200 DTS-05-200 - STAGING OF DEVELOPMENT REPORT 2006 -POST 2007 The Committee considered Development and Technical Services Department report DTS-05- 200, and addendum report DTS-05-201, dated November 25, 2005, regarding the Staging of Development Report 2006 -Post 2007. Mr. J. Willmer reviewed the Staging of Development report noting that the subdivisions proposed DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 8- CITY OF KITCHENER 11. DTS-05-201 - ADDENDUM TO DTS-05-200 DTS-05-200 - STAGING OF DEVELOPMENT REPORT 2006 -POST 2007 (CONT'D) to be developed through this report would provide sufficient new lots fora 7 year supply. Not all of these lots can proceed immediately so it is appropriate to approve more lots than can be developed in the near future. Mr. G. Scheels, G.S.P. Group, was in attendance on behalf of his clients, Monarch Corporation and Grandview Homes, to request two parcels of land be moved forward in the Staging of Development report, to receive approval in 2007, rather than post-2007. These lands are located in the Doon South Community and are identified as parcels #97 and #101. He advised that parcel #97 is well into the planning process at this time. Further, although the Blair Bechtel Bauman Functional Study has not received final approval, it has been completed, and has met with acceptance from the industry and agencies. Mr. Scheels provided Committee members with a written submission in this regard, this date. Mr. Willmer acknowledged the drainage study has been completed, and the community plan will be undertaken in 2006. He stated that staff do not want this plan of subdivision to drive the community plan process; however, it may be appropriate for staff to circulate the subdivision plans for these properties once the community plan is substantially complete. Mr. P. Britton, MHBC Planning, was in attendance on behalf of the Max Becker Group, in support of the Staging of Development report. He was also in attendance on behalf of Hallman Construction who own parcel #91 in the Staging report which is adjacent to parcel #101, identified by Mr. Scheels as being owned by Grandview Homes. He requested that the City accept submission of a plan of subdivision for this land, to be processed once the community plan process has been substantially completed, with an eye to having the subdivision plan go forward in 2007. Ms. O. Gomes, Planning and Engineering Initiates Ltd. was in attendance on behalf of her client, the Kitchener Portuguese Club, requesting development of their land, at 1548 Fischer Hallman Road, be moved forward in the Staging of Development report. She advised they want to be able to submit their draft plan this year for approval in 2007. They propose residential development on the rear of their land, as it will be a natural extension of the adjacent Activa subdivision. Mr. Willmer advised all of this property is currently zoned Business Park. Noting the March 1, 2005, Provincial Policy Statement protecting employment lands, Mr. Willmer advised a comprehensive study is required along with a Municipal Plan Amendment, then a zone change. There will be serious concerns in the regard right through to the provincial level. The intent of the Provincial Policy Statement is to protect such employment lands as this, and Mr. Willmer could not recommend an earlier time frame for processing this plan of subdivision. Upon questioning Mr. Willmer advised the owner must go through two stages, first the owner must apply for a Municipal Plan Amendment. If the Municipal Plan Amendment is answered by Council or the Ontario Municipal Board, then this property can be brought forward in the next Staging report. On motion by Mayor C. Zehr - itwas resolved: "That the Staging of Development Report 2006-Post 2007 (DTS-05-200) be approved; and further, That at such time as the community plan is sufficiently advanced, any plans of subdivision which have been submitted for processing on the following lands will be circulated by the City: • Parcel # 97 - Monarch Corporation, • Parcel #101 - Grandview Homes, and • Parcel # 91 - Hallman Construction." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY 9, 2006 - 9- CITY OF KITCHENER 12. DTS-06-006 - TEMPORARY OCCUPANCY - 79 JOSEPH STREET - ROOF WEST-VICTORIA PARK WARD The Committee considered Development and Technical Services Department report DTS-06- 006, dated January 3, 2006, regarding temporary occupancy for ROOF (Reaching Our Outdoor Friends) at 79 Joseph Street. Mr. L. Lynch advised that construction of the Gaukel Street/Joseph Street intersection is scheduled to start the week of April 3, 2006, and access to this property will be limited part way through April. He advised he will try and provide access to the property if their occupancy of the building extends beyond that time. It was noted by Mr. J. Willmer that ROOF needs to occupy 79 Joseph Street for 4-6 months. It was generally agreed that Mr. Lynch discuss with ROOF the length of time they need to occupy the building, and report to Council at its January 16t" meeting. On motion by Mayor C. Zehr - itwas resolved: "That consideration of permitting R.O.O.F. (Reaching Our Outdoor Friends) temporary occupancy of 79 Joseph Street (former KOR Gallery) be deferred and referred to the Council meeting of January 16, 2006, pending the outcome of discussions between staff and R.O.O.F. as to their need in terms of length of occupancy." 13.
