HomeMy WebLinkAboutAdjustment - 2006-01-10 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JANUARY 10, 2006 MEMBERS PRESENT: OFFICIALS PRESENT: Ms. D. Angel and Messrs. D. Cybalski and Z. Janecki. Mr. B. Sloan, Senior Planner, Ms. D. Gilchrist, Secretary-Treasurer, Ms. R. Brent, Assistant Secretary-Treasurer. Mr. D. Cybalski, Chair, called this meeting to order at 10:25 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, January 30, 2006, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2006-001 Applicant: Colloquim Investments Inc. Property Location: 842 Victoria Street North Legal Description: Lot 49, Registered Plan 763, being Part 1, Reference Plan 58R-4210 Appearances: In Support: Mr. C. Cluthe M r. A. Lee Mr. D. Speers Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a canopy sign to have a sign face height of 1.5 m (4.92 ft.) rather than 1 m (3.2 ft.). The Committee considered the report of the City's Planning Division, dated December 22, 2005, advising they have no objections to this application. The Committee considered the report of the Traffic & Parking Analyst, Transportation Planning, dated December 29, 2005, advising they have no concerns with the proposed sign or its location. The Committee considered the report of the City's Manager of Building, dated January 3, 2006, advising he has no objections to this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated December 23, 2005, advising they have no concerns with this application. Cluthe advised there are already canopies at this location that are 1.5 m high, and they want to be fair to all their tenants. Moved by Ms. D. Angel Seconded by Mr. Z. Janecki That the application of the Colloquim Investments Inc. requesting permission to erect a canopy sign to have a sign face height of 1.5 m (4.92 ft.) rather than the permitted 1 m (3.2 ft.) on Lot 49, Registered Plan 763, being Part 1, Reference Plan 58R-4210, 842 Victoria Street North, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject property. Carried 2. Grafstein Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a ground sign to have a maximum height of 2.825 m (9.26 ft.~ rather than 1.5 m (4.92 ft.), and a maximum sign area of 6.2 m2 (66.73 sq. ft.) rather than 4 m (43.05 sq. ft.). The Committee considered the report of the City's Planning Division, dated December 22, 2005, advising they have no objections to this application. The Committee considered the report of the Traffic & Parking Analyst, Transportation Planning, dated December 29, 2005, advising they have no concerns with the proposed sign or its location. The Committee considered the report of the City's Manager of Building, dated January 3, 2006, advising he has no objections to this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated December 23, 2005, advising they have no concerns with this application. Mr. Petricevic advised the City has constructed a new community centre at this location, which property contains other uses. The larger sign is required because the sign must also contain the street address to identify the building for emergency services. Mr. Sloan advised Planning Division staff prefer ground signs over pylon signs provided there are no visibility problems. He stated this is a large site that needs identification, and the whole sign is much more than the sign face and letters. COMMITTEE OF ADJUSTMENT 3 JANUARY 10, 2006 2. Angel That the application of the Waterloo Catholic District School Board requesting permission to erect a ground sign to have a maximum height of 2.825 m (9.26 ft.) rather than the permitted 1.5 m (4.92 ft.), and a maximum sign area of 6.2 m2 (66.73 sq. ft.) rather than the permitted 4 m2 (43.05 sq. ft.) on Block D, Registered Plan 1170, and Part Block A, Registered Plan 1152, 505 Franklin Street North, Kitchener, Ontario, BE APPROVED.
