HomeMy WebLinkAboutAdjustment - 2001-04-03 SIGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD APRIL 3, 2001 MEMBERS PRESENT: Messrs. P. Kruse, P. Britton, and D. Cybalski OFFICIALS PRESENT: Ms. J. Given, Principal Planner and Ms. J. Billett, Secretary-Treasurer. Mr. P. Kruse, Vice-Chair, called this meeting to order at 10:05 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation, which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, April 23, 2001, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting, if desired. NEW BUSINESS Submission No.: 1.SG 2001-003 Applicant: Petro Canada Inc. Property Location: 4592 King Street East, Kitchener Legal Description: Part of Lots 23 and 24, Beasley’s Broken Front Concession The Chair advised that the Committee was in receipt of a letter dated March 28, 2001 from Mr. S. Catalano, Pattison Outdoor Advertising, Agent for the Applicant, requesting deferral of the application to the Committee's next meeting. By general consent, it was agreed that consideration of this application would be deferred to the Committee’s next meeting scheduled to be held on Tuesday, May 1, 2001. Submission No.: 2.SG 2001-004 Applicant: Lorchrist Properties Limited Property Location: 276 King Street West Legal Description: Part Lots 149 & 150, Plan 374, designated as Part 2 on Registered Plan 58R-1936 Appearances: In Support:Ms. E. Beaumont Pride Signs Ltd. 280 Holiday Inn Drive Cambridge, ON N3C 1Z4 Contra:None Written Submissions: In Support:None Contra:None The Committee was advised that the applicant is requesting permission to locate a fascia sign with electronic display on an existing commercial building having a distance separation from the intersection of King Street West and Water Street South and existing traffic light of 20.4 m (66.93 ft.), rather than the required 23 m (75.46 ft.). COMMITTEE OF ADJUSTMENT- 7 -JANUARY 9, 2001 The Committee noted the comments of the Department of Business & Planning Services in which they advised that the Retail Core zoning on the property permits a fascia sign and an automatic changing copy sign. The proposed sign complies with all regulations in the Sign By-law except for the location from a street intersection or traffic light, which is intended to ensure there is no interference with the traffic signal. The proposed sign will be installed flat against the front of the building, and this location will not interfere with vehicular traffic or contribute to driver distraction. The proposed automatic changing copy portion of the sign is only 0.5 square metres (6.35 sq. ft.) 2 with the whole sign having an overall area of 1.8 m (19.3 sq. ft.). This sign will have no impact on neighbouring properties and is an appropriate type of sign for the location in the Downtown. The Traffic and Parking Division has no concern with the proposed sign. The Department of Business and Planning Services recommends approval of Submission SG 2001-004. The Committee noted the comments of the Director of Building in which he advised that the Building Division has no concerns or comments with respect to this application. The Committee noted the comments of the Traffic & Parking Analyst in which he advised that the Traffic & Parking Division has reviewed this application and has no comment. The Committee noted the comments of the Planning & Culture Department, Region of Waterloo, in which they advised that Regional staff have reviewed the application and have no concerns; however, any development on the subject lands is subject to the provisions of the Regional Development Charge By-law 99-038 or any successor thereof and may require the payment of Regional Development Charges for this development prior to the issuance of a building permit. The Committee noted the comments of the Grand River Conservation Authority in which they advised that they have no objection to this application. The Chair reviewed the staff comments, noting that staff are recommending approval of the application and enquired if Ms. Beaumont had anything further to add. Ms. E. Beaumont advised that she had reviewed the staff comments and was in agreement with the recommendation contained within. As there were no further questions or comments forthcoming, the Chair called for a motion. Moved by Mr. P. Britton Seconded by Mr. D. Cybalski That the application of Lorchrist Properties Limited requesting permission to locate a fascia sign with an automatic change in copy section on an existing commercial building having a distance separation from the intersection of King Street West and Water Street South and existing traffic light of 24.4 m (66.93 ft.), rather than the required 23 m (75.46 ft.), on Lots 149 and 150, Plan 374, designated as Part 2 on Reference Plan 58R-1936, 276 King Street West, BE APPROVED . It is the opinion of this Committee that: 1.The variance approved in this application is minor in nature. 2.This application is desirable for the appropriate development of the property. 3.The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Carried The Chair advised Ms. Beaumont that the decision of the Committee is a recommendation to City Council, which will be considered at the Council meeting of April 23, 2001, at 7:00 p.m. in the Council Chamber, and she may register as a delegation to appear before Council at that time.
