MARCH 4, 2002CITY OF KITCHENER
The Development and Technical Services Committee met this date commencing at 7:03 p.m. under
Councillor C. Weylie, Chair, with the following members present: Councillors B. Vrbanovic, M. Galloway
and G. Lorentz. Mayor C. Zehr and Councillors J. Ziegler and J. Smola entered the meeting after its
commencement.
Officials Present: Ms. L. MacDonald and Messrs. J. Fielding, B. Stanley, D. Mansell, G. Borovilos, C.
Bluhm and L.W. Neil.
1.DTS-02-043-STRUCTURAL REHABILITATION - K-W EXPRESSWAY (HIGHWAY 7 &
86)
-MUNICIPAL CODE CHAPTER 450 (NOISE)
-REQUEST FOR EXEMPTION
The Committee considered Development and Technical Services Department report DTS-02-043
dated February 20, 2002 dealing with a request received from the Ministry of Transportation on
behalf of its contractors for exemption from Municipal Code Chapter 450 (Noise). It was requested
that an extension to a previously granted exemption be approved so as to allow for rehabilitation of
the Wellington Street structure over the K-W Expressway.
On motion by Councillor B. Vrbanovic -
it was resolved:
“That the Ministry of Transportation and its Contractor(s) be exempt from the provisions of
Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work,
during the structural rehabilitation of the K-W Expressway including the Wellington Street
underpass, for the period April 1, 2002 to September 30, 2002 between the hours of 7:00
p.m. to 7:00 a.m.”
2.DTS-02-024-BPS-77 SECOND AVENUE
-ZONE CHANGE APPLICATION ZC 01/21/S/BS

The Committee considered a zone change application submitted by Linda Liedtke with respect to
the property known municipally as 77 Second Avenue. The purpose of the zone change is to
permit a four unit apartment within an existing building as the current zoning does not allow such
multiple dwelling. In this regard, the Committee considered Development and Technical Services
Department report DTS-02-024-BPS dated January 25, 2002 and a proposed by-law dated
January 25, 2002 attached to the report.
It was pointed out that notice that the Committee would hold a public meeting this date to consider
this matter had previously been given.
Mr. B. Stanley advised that staff had nothing further to add to the application. However, he did
point out that one concern was raised from a neighbouring property owner who was of the view
that the proposed zoning was incompatible with the existing zoning and single detached dwellings
in the area. He pointed out that while a portion of the neighbourhood was zoned R-4 and
developed with single detached dwellings, the surrounding area contained a mixture of residential
zones encompassing a full range of housing types.
No delegations were registered respecting this matter.
On motion by Councillor B. Vrbanovic -
it was resolved:
“That Zone Change Application ZC 01/21/S/BS (Linda Liedtke) requesting a change in
zoning from Residential Four Zone (R-4) to Residential Six Zone (R-6), on lands legally
described as Part Block B, Registered Plan 254 and municipally known as 77 Second

Avenue, be approved, in the form shown in the “Proposed By-law” dated January 25, 2002
without conditions.

It is the opinion of this Committee that approval of this application is proper planning for the
City and is in conformity with the City’s Municipal Plan.”
3.DTS-02-033-BPS-593 CHARLES STREET EAST
-ZONE CHANGE APPLICATION ZC 01/19/C/ET

The Committee was advised that an application has been received from Sandra J. Lascelles to
change the zoning of lands known municipally as 593 Charles Street East. The purpose of the
zoning change is to amend the current zoning by adding a Special Use Provision that would
legalize the existing home business use for Canine and Feline Grooming and allow one parking
space for the dwelling to be a minimum of 0 metres from the street line. In this regard, the
Committee considered Development and Technical Services Department report DTS-02-033-BPS
dated January 31, 2002 and a proposed by-law dated January 31, 2002 attached to the report.
It was pointed out that notice that the Committee would hold a public meeting this date to consider
this matter had previously been given.
Mr. B. Stanley summarized the purpose of the application and advised that the business was to
operate out of the basement of the property as noted in the staff report.
No delegations were registered respecting this matter.
On motion by Councillor G. Lorentz -
it was resolved:
“That Zone Change Application ZC 01/19/C/ET (Sandra J. Lascelles) requesting a change
in zoning from Commercial-Residential Two Zone (CR-2) to Commercial Residential Two
Zone (CR-2) with a Special Use Provision 306U, on lands legally described as Part 1 Plan
of Lot 35, Registered Plan 262, municipally known as 593 Charles Street East, be
approved, in the form shown in the “Proposed By-law”, dated January 31, 2002, without
conditions.
It is the opinion of this Committee that approval of this application is proper planning for the
City and is in conformity with the City’s Municipal Plan.”
4.DTS-02-040-BPS-39 & 45 CEDAR STREET SOUTH
-DEMOLITION CONTROL APPLICATION DC 02/01/C/GR
-KITCHENER HOUSING INC.
-WEST-VICTORIA PARK WARD
The Committee considered Development and Technical Services Department report DTS-02-040-
BPS dated February 19, 2002 dealing with a demolition control application submitted by Kitchener
Housing Inc. with respect to the properties known municipally as 39 & 45 Cedar Street South. It
was noted in the report that the applicant proposes to demolish one 3-unit apartment dwelling and
one 13-unit lodging house known as 39 & 45 Cedar Street South respectively. The purpose of the
demolition is in order to allow for the development of a 42-unit apartment building of affordable
housing units.
The Committee was advised that staff had nothing further to add to the report.

On motion by Councillor G. Lorentz -
it was resolved:
“That Demolition Control Application DC 02/01/C/GR (Kitchener Housing Inc.) requesting
approval for the demolition of one 3-unit apartment dwelling and one 13-unit lodging house
located at 39 and 45 Cedar Street South, respectively, and legally described as Part of Lot
1, Plan 365, Part 1 on Reference Plan 58R-4938, and Part of Lot 1, Plan 365, be approved.
It is the opinion of this Committee that approval of this application is proper planning for the
City.”
5.DTS-02-044-WASHBURN DRIVE - HURON BUSINESS PARK
-OFFER TO PURCHASE - SITES 140 & 141
-MICHAEL ULMER IN TRUST

The Committee was in receipt of Development and Technical Services Department report DTS-02-
044 dated February 20, 2002 providing details concerning an offer to purchase Sites 140 & 141
consisting of three acres on Washburn Drive in the Huron Business Park.
The Committee was advised that staff had nothing further to add to the report.
On motion by Councillor B. Vrbanovic -
it was resolved:
“That the conditional Offer to Purchase from Michael Ulmer In Trust be accepted for Parts 7
and 8 on Reference Plan 58R-7426 on Washburn Drive in the Huron Business Park having
an area of approximately 3.0 acres at an offering price of $80,000 per acre, for a total
purchase price of $240,000; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation required
by the City Solicitor.”
Councillor J. Ziegler entered the meeting at this point.
6.DTS-02-047-WASHBURN DRIVE - HURON BUSINESS PARK
-OFFER TO PURCHASE - SITE 148
-MARK KARLSON IN TRUST
-SOUTH WARD
The Committee considered Development and Technical Services Department report DTS-02-047
dated February 25, 2002 dealing with an offer that has been received to purchase Site 148 on
Washburn Drive in the Huron Business Park.
Mr. G. Borovilos briefly summarized the report and advised that staff had nothing further to add.
Councillor M. Galloway noted that in the past there have been problems with certain uses within
the business park on sites located near Bleams Road and have affected the residential area on
the northerly side of Bleams Road. Mr. Borovilos noted that the purchaser was a company that
was currently carrying on business on McIntyre Drive in the business park and advised that staff
have had no complaints with respect to their operation which consists of manufacturing high end
machinery.

On motion by Councillor G. Lorentz -
it was resolved:
“That the Offer to Purchase from Mark Karlson In Trust be accepted for Parts 17 and 28 on
Reference Plan 58R-7426 having an approximate area of 1.7 acres (.69 hectares) at an
offering price of $113,500.00; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation required
by the City Solicitor.”
7.DTS-02-042-DOWNTOWN ADVISORY COMMITTEE RECOMMENDATIONS
-CONCERNS REGARDING THE OVER CONCENTRATION OF SOCIAL
SERVICES IN INNER CITY AND DOWNTOWN
The Committee was in receipt of Development and Technical Services Department report DTS-02-
042 dated February 18, 2002 dealing with recommendations of the Downtown Advisory Committee
with respect to its concerns regarding the over concentration of social services in the Inner City
and in the Downtown.
It was pointed out in the report that the Committee recommendation resulted from its February 14,
2002 discussion over the number of existing and proposed social agencies providing services in
and around the downtown. In particular, reference was made to the Region of Waterloo and other
agencies announcing initiatives to increase housing and social services in the Region and the
Committee was of the view that policies should be put in place to prevent a geographic imbalance
of these uses in the Downtown.
Mayor C. Zehr and Councillor J. Smola entered the meeting at this point.
Mr. B. Stanley noted that two approaches could be taken to address the concerns. Firstly, he
noted that staff were currently looking at the issue of lodging houses and suggested that planning
initiatives such as increased enforcement and rezonings could address concerns. Secondly, he
noted that new large residential care facilities have been prohibited in the Cedar Hill
Neighbourhood and suggested investigation could be undertaken to apply similar restrictions
outside the Cedar Hill area that would tie-in with discussions with various agencies at the local and
regional level.
On motion by Councillor J. Ziegler -
it was resolved:
“That City staff be directed to deal with the issue of the over concentration of social services
in the Inner City and Downtown both immediately, and through a long term planning
solution; and further,
That City staff be directed to work with the Region of Waterloo to provide possible
alternative housing options for other areas of the Region.”
