HERITAGE KITCHENER MINUTES
APRIL 2. 2002
CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Councillor M. Galloway, commencing at 4:00 p.m., with the
following members present: Ms. P. Wagner, Ms. G. Engel, and Messrs. J. Clinckett, Z. Janecki, E. Lucy,
B. Nixon, B. Scott and W. Stauch.

1. HERITAGE SHOWCASE AND MIKE WAGNER HERITAGE AWARDS
On behalf of the Committee, Ms. P. Wagner thanked Ms. Gilchrist and her assistant Ms. B. Moore
for their contributions to the Heritage Showcase display and arranging the reception for the Mike
Wagner Heritage Awards.
2. HERITAGE PERMIT APPLICATION 2002-V-08
253 QUEEN STREET SOUTH
NEW CONSTRUCTION
2ND STOREY ADDITION TO REAR GARAGE
The Committee was in receipt of Heritage Permit Application #2002-V-08, dated March 11, 2002,
requesting permission to construct a second storey addition on the detached, three bay garage
located in the rear yard, at the property municipally known as 253 Queen Street South, located in
the Victoria Park Area Heritage Conservation District. Attached to the application is a contract
proposal for the addition from Bradley A. Straus Contractors Ltd., dated March 6, 2002, and copies
of three altered photographs showing a concept of the finished addition from various angles. Mr. R.
Foti, property owner, was in attendance to answer any questions the Committee may have in this
regard.
Mr. L. Bensason showed images of the subject property, noting the owner received approval last
year for an addition on the garage attached to the main building on the property. He advised that
the detached, three bay garage was constructed approximately three years ago, and it faces
Clemens Lane. The proposed addition will be clad in vertical vinyl siding.
When questioned by the Committee, Mr. Foti advised that the roofline of the addition will be similar
to that of the house, and the construction is anticipated to be completed by the end of May.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owner (HPA
#2002-V-08) to alter the designated property municipally known as 253 Queen Street
South, located in the Victoria Park Area Heritage Conservation District, by constructing a
second storey addition on the detached three bay garage located in the rear yard, be
approved."
3. HERITAGE PERMIT APPLICATION 2002-IV-09

REVISED CANOPY DESIGN
The Committee was in receipt of Heritage Permit Application #2002-IV-09, dated March 11,
2002, proposing a revision for the canopy for the main entrance of the former Waterloo County
Gaol at 73 Queen Street North. Mr. B. Bechtel was in attendance to represent the application
and explain the change proposed from the pervious approval. Mr. L. Bensason showed images
of the location on the building where the canopy will be located.

On motion by Mr. W. Stauch -
it was resolved:
"That pursuant t 0 Section 33 of the Ontario Heritage Act, the application of the owner
(HPA #2002-IV-09) to alter the designated property municipally known as 73 Queen
Street North (Waterloo County Gaol) by erecting a canopy over the main entrance, be
approved."
4. HERITAGE PERMIT APPLICATION 2002-V-11
25 MITIERRA DRIVE
NEW CONSTRUCTION
The Committee was in receipt of Heritage Permit Application #2002-V-11, dated March 19, 2002,
for the property municipally known as 25 Mitierra Drive, located in the Upper Doon Heritage
Conservation District. The application seeks permission to construct a new single family dwelling
on this vacant lot. Attached to the application is a concept drawing showing the style of the
proposed house and a copy of the "New Building Guidelines" contained in Section 5.9.3 of the
Heritage Conservation District Plan.
Mr. B. Wilfong, the property owner, was in attendance to answer any questions the Committee
might have in this regard and provided a new concept plan for the proposed single family dwelling.
Mr. L. Bensason showed images of the property and the existing house on the adjacent property,
owned by Mr. Wilfong's parents. Upon questioning, Mr. Wilfong advised that his parents' home
has a floor area of 4,000 square feet and is a full two storeys. His proposed home will have a floor
area of 2,700 square feet and will be a two storey house.
Following a brief discussion about building materials and colours, it was agreed that a sub-
committee composed of Ms. P. Wagner and Messrs. E. Lucy, Z. Janecki and W. Stauch will meet
with the property owner prior to the Committee's May meeting, with respect to building materials
and colours, and a formal recommendation will not be forwarded to Council until the May meeting.
On motion by Mr. E. Lucy-
it was resolved:
"That the application of the owner (HPA #2002-V-11), dated March 19, 2002, to construct a
new single family dwelling on the property municipally known as 25 Mitierra Drive, be
approved in principle; subject to the owner meeting with a Heritage Kitchener sub-
committee, prior to May 7,2002, to review the building materials and colours proposed."
5. HERITAGE PERMIT APPLICATION 2002-V-10
LOT 65, BUERKLE COURT
NEW CONSTRUCTION
The Committee was in receipt of Heritage Permit Application #2002-V-10, dated March 6,
2002, seeking permission to construct a new single family dwelling on the property municipally
known as 22 Buerkle Court, Kitchener. Attached to the application were: a building location
plan, a lotting plan for Buerkle Court, a concept drawing and an elevation drawing for the
proposed single family dwelling.
Mr. R. Haalboom appeared before the Committee representing the Society for the
Preservation of Upper Doon, and provided the Committee with the following written
submissions: correspondence from himself, dated April 2, 2002, outlining his objection to the
approval of this application; a map identifying the boundary of the Upper Doon Heritage
Conservation District; and, a copy of a Ontario Municipal Board decision with respect to 181

Front Street, Oakville.
Mr. Haalboom referred to special policy area 10, in the City's Municipal Plan, which identifies
that new lots may be created in accordance with the policies and regulations of the
Upper
Doon Heritage Conservation District Plan, the Upper Doon Community Plan, as well as the
Grand River Conservation Authority and the Region of Waterloo. Mr. Haalboom advised that
his position is that approval should not be given to construct a new building on a lot which
does not comply with City's Official Plan.
Mr. L. Bensason provided some background on the current situation in this area, including the
date of approval of the Heritage Conservation District and the subdivision. He advised that
the issue before this Committee is consideration of the new development and specifically the
building design and materials, and not the size of the lot.
Mr. G. Scheels was in attendance to represent the application, displayed a photograph of the
style of house to be built on the lot, and advised that the colours for the building materials are
to be primarily brown with some green accents, and a grey/green stone on the bottom.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owner (HPA
#2002-V-10) to alter the designated property municipally known as 22 Buerkle Court,
located in the Upper Doon Heritage Conservation District, by constructing a new single
family dwelling, be approved."
6. HERITAGE PERMIT APPLICATION 2002-IV-07
209 FREDERICK STREET
DEMOLITION
The Committee was in receipt of Heritage Permit Application #2002-IV-07, dated February 21,
2002, requesting permission to demolish the dwelling municipally known as 209 Frederick
Street (Bingeman Cottage). Attached to the application is correspondence from Thunderhill
Construction Limited, dated February 20, 2002, and from Timeless Restoration, dated
February 19, 2002.
Mr. R. Solowka, representing Thunderhill Construction Limited, was in attendance to answer
any questions the Committee might have in this regard.
Mr. Bensason reminded the Committee that consideration of this application was deferred at
the last meeting to allow an opportunity to determine if someone would be willing to purchase
this building and move it from the property. To date such a buyer has not been found.
Mr. J. Clinckett put forward a motion that the application be approved, subject to the owner
providing a set of measured drawings. The Committee then discussed the cost of measured
drawings, which Mr. Clinckett advised varies in price depending on who prepares the
drawings. Mr. Bensason advised that Council can ask for a recording of the building, but not
specifically measured drawings. He also advised that Mr. Solowka has scaled drawings and
photographs of the building that he is willing to provide.
Mr. P. Wagner questioned the Property Standards Orders on this property and whether they
apply to the new owner and subsequent owners. Mr. Bensason advised that these orders do
apply to the new owner, who approached the City with his plans to redevelop the properties.
He was given a period of time to submit plans for the new development and make application
for site plan approval.

209 FREDERICK STREET
DEMOLITION (CONT'D)
On motion by Mr. J. Clinckett-
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, the application of the owner (HPA
#2002-IV-07) to demolish the designated property municipally known as 209 Frederick
Street (Bingeman Cottage) be approved; subject to the owner providing the City of
Kitchener with measured drawings of the building."
7. HERITAGE IMPACT ASSESSMENT
530-540 QUEEN STREET SOUTH
FORMATION OF SUB-COMMITTEE
Mr. Z. Janecki declared a pecuniary interest in this application as he is employed by a firm
that has an interest in the application, and did not participate in any discussion or voting with
respect to this matter.
Mr. L. Bensason declared a conflict of interest in this matter and did not discuss with or
provide any advice to the Committee on this matter.
The Committee was advised that they are being requested to form a sub-committee to prepare
the terms of reference for a Heritage Impact Assessment for the proposed development of an
apartment building, to be partially located on the property municipally known 530-540 Queen
Street South, located in the Victoria Park Area Heritage Conservation District. Copies of
Council's policy of August 27, 2001, were distributed to the members, and Councillor
Galloway pointed out the portion of this policy dealing with sub-committees of advisory
committees, which states in part, "Membership on sub-committees may be expanded, if
required, to include people who are not advisory committee members, to benefit from
individual expertise."
Mr. S. Vipond referred the Committee to Council's resolution of March 18, 2002, which limits
the scope of the terms of reference for the Heritage Impact Assessment to Section 2.2 (New
Building) of the Victoria Park Area Heritage Conservation District Plan.
Ms. G. Engel noted that at the Committee's last meeting both Councillor Galloway and Mr.
Stanley advised Heritage Kitchener that they could establish the terms of reference for the
Heritage Impact Assessment, and nothing was mentioned about limiting the scope of these
terms of reference.
Mr. Vipond responded that the Committee can accept Council's direction or ask Council to
expand the scope of the Heritage Impact Assessment. He also asked the Committee to go
forward at this meeting to establish the make-up and mandate of the sub-committee.
Three delegations appeared before the Committee, who had previously supplied members
with written copies of their presentations.
Mr. B. Berry advised the Committee that he is pleased with Council's direction that a Heritage
Impact Assessment be conducted; however, he has concerns with the June 1 ih deadline, and
the restrictions on the terms of reference to Section 2.2 of the Plan, as other sections of the
plan also deal with the Queen Street corridor. He requested that Heritage Kitchener ask
Council to reconsider the scope of the terms of reference.
Ms. M. Cadotte advised the Committee that the neighbours want a greater part in the Heritage
Impact Assessment process than the open house required by Council. She requested that the
neighbourhood be permitted representation on the sub-committee to establish the terms of
reference. She also requested that there be an independent review of the Heritage Impact
Assessment and subsequent staff report.

Ms. J. Armstrong addressed the Committee with respect to her concerns regarding the
limitation of the terms of reference.
7. HERITAGE IMPACT ASSESSMENT

The Committee then discussed appropriate membership for the sub-committee and the narrow
scope for the terms of reference. Mr. Vipond provided the Committee members with the
copies of Development and Technical Services Department Guidelines for Heritage Impact
Assessments.
On motion by Mr. J. Clinckett-
it was resolved:
"That all members of Heritage Kitchener be appointed members of the sub-committee
to determine the terms of reference for the Heritage Impact Assessment for 530-540
Queen Street South."
8. 41-45 KING STREET WEST
MAINTENANCE & REPAIR
As no Heritage Permit Application was submitted for 41-45 King Street West, this item was
withdrawn.
9. 2002 COMMITTEE WORK PROGRAM
It was generally agreed that this matter be deferred to the Committee's next meeting.
10. CALL FOR NOMINATIONS FOR 2002 WATERLOO REGIONAL HERITAGE FOUNDATION
AWARDS OF EXCELLENCA
SALLY THORSEN AWARD OF EXCELLENCE
It was generally agreed that Committee members could take it upon themselves to submit
nominations for these awards. Nomination forms can be obtained from the Committee
Administrator.
11. NEW BUSINESS - CENTRE BLOCK
Mr. B. Scott raised the issue of the pending demolition of the Lyric Theatre, referring to an
article which appeared in The Record the previous weekend. He noted that the demolition is
proposed for the middle of April. The Lyric is on the City's Heritage Inventory, and the normal
process for demolition of properties on the Inventory is to advise and consult with this
Committee. Mr. Scott then referred to a letter received from Parks Canada some years ago
which addresses the unique architecture of the Lyric. He questioned whether there are
salvageable artifacts in the building.
Ms. Wagner referred to a Heritage Inventory report noting that there are only two theatres of
this architectural style in Ontario, the Lyric and one in Hamilton.
Mr. Bensason noted that when Ms. C. Ladd appeared before this Committee with respect to
the Forsyth property she stated that Heritage Kitchener would be kept informed, and the
Committee should have been advised of this pending demolition. He suspected that with the
last renovations to the building and the current agreement of Purchase and Sale, the previous
owner was permitted to remove what they wanted from the building; consequently, there may
not be anything of interest left in the building.

On motion by Mr. B. Scott-
it was resolved:
"That Heritage Kitchener expresses its concern with the decision to demolish the Lyric
Theatre, as it is listed on the City's Heritage Inventory; and further,
That Heritage Kitchener will attempt to liase with City staff to review the site and possibly
document significant features of the building."
12. RECESS AND RECONVENE
This meeting of Heritage Kitchener recessed at 6:30 p.m. and reconvened at 6:58 p.m. with
the following members present: Councillor M. Galloway, Ms. P. Wagner, Ms. G. Engel,
Messrs. B. Nixon, B. Scott and J. Clinckett.
13. HERITAGE IMPACT ASSESSMENT - SUB-COMMITTEE RECOMMENDATIONS
On motion by Mr. J. Clinckett-
it was resolved:
"That the terms of reference for the Heritage Impact Assessment for the
proposed apartment building to be partially located on the property municipally
known as 530-540 Queen Street South be expanded beyond Section 2.2 (New
Building) of the Victoria Park Area Heritage Conservation District Plan, to
include all areas of possible heritage impact including the full Heritage
Conservation District Plan; and,
That the final terms of reference for this Heritage Impact Assessment be approved by
Council; and,
That the sub-committee to develop the terms of reference consist of all members of
Heritage Kitchener and up to 2 representatives of the residents living in the Victoria
Park Area Heritage Conservation District; and further,
That Council approve the hiring of a heritage planner, who will also be a member of the
sub-committee, to assist in developing the terms of reference for the Heritage Impact
Assessment. "
