FEBRUARY 20, 2006 CITY OF KITCHENER
A special meeting of City Council was held at 5:36 p.m. this date, Chaired by Mayor C. Zehr and with
all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Mayor C. Zehr advised that the first item of business were the appointments to various advisory
committees that currently have vacancies. Councillor B. Vrbanovic suggested and it was agreed that
due to the lateness of this meeting and the scheduled Development & Technical Services Committee
meeting to be held at 6:00 p.m., that this item be dealt with when special Council re-convenes
following the Committee meeting.
Moved by Councillor B. Vrbanovic
Seconded by Councillor G. Lorentz
"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a matter subject to solicitor-client privilege."
Carried.
The meeting then recessed and re-convened at 7:38 p.m., Chaired by Mayor C. Zehr and with all
members present.
Council considered a recommendation arising from the Development & Technical Services Committee
meeting this date regarding a requested exemption from the Council Policy concerning emergency
access to a development.
Moved by Councillor C. Weylie
Seconded by Councillor B. Vrbanovic
"That Valley View Heights (St. Jacobs) Ltd. be granted an exemption from Council Policy 1-
1035 (Emergency Access), to allow the registration and development of Plan of Subdivision
30T-00204 (Valley View) in advance of Plan of Subdivision 30T-00201 (TVL Developments),
subject to the following conditions:
1. That the City of Kitchener be granted an easement for emergency access purposes
from Fairway Crescent to Sims Estate Drive through Plan of Subdivision 30T-00201,
satisfactory to the City Solicitor.
2. That the Mayor and Clerk be authorized to enter into an agreement, satisfactory to the
City Solicitor, whereby Valley View Heights (St. Jacobs) Ltd. shall provide for
maintenance, indemnification, `knock-down' or other barriers acceptable to the City's
Chief Fire Prevention Officer and other related matters."
Carried.
Council considered the applications received from candidates to sit on various advisory committees
that currently have vacancies. In regard to the vacancies on the Arts & Culture Advisory Committee,
the following applicants were nominated: Jamie Hill, Lawrence McNaught and Joan O'Doherty. The
approved voting procedure was then utilized which resulted in Messrs. McNaught and Hill being
appointed to the Arts & Culture Advisory Committee.
Council then considered the applications received for the Downtown Advisory Committee and the
following applicants were appointed: Phong Tran representing the Downtown Restaurant sector,
Chris Reid representing the Downtown Storefront Retail sector and, in the absence of an applicant to
represent the Educational sector, Frank Wolf was appointed at large.
Council then considered the applications received for Heritage Kitchener appointing Susan Lauber to
represent the Upper Doon Heritage Conservation District. With respect to the two at-large vacancies
the following applicants were nominated: Fred Bishop, John Heij and Tim Willcox. The approved
voting procedure was then utilized which resulted in Messrs. Bishop and Willcox being appointed to
Heritage Kitchener.
Council then considered the vacancies on the Safe & Healthy Community Advisory Committee and
the following applicants were nominated: Dana Bibles, Fred Bishop, Michele Doucette and Darrin

Henry. The approved voting procedure was then utilized which resulted in Messrs. Bishop and Henry
being appointed to the Safe & Healthy Community Advisory Committee.

"That appointments to advisory committees be approved as follows:
• Arts & Culture Advisory Committee -Jamie Hill, Lawrence McNaught;
• Downtown Advisory Committee - Phong Tran, Chris Reid, Frank Wolf;
• Heritage Kitchener -Susan Lauber, Fred Bishop, Tim Willcox;
• Safe & Healthy Community Advisory Committee - Darrin Henry, Fred Bishop."

Seconded by Councillor G. Lorentz
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2006-49 by the Clerk."
Carried.
On motion, the meeting adjourned at 7:55 p.m.
