HomeMy WebLinkAboutAdjustment - 2002-04-16 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD APRIL 16. 2002 MEMBERS PRESENT: Messrs. S. Kay, P. Kruse and D. Cybalski. OFFICIALS PRESENT: Ms. J. Given, Principal Planner and Ms. J. Billett, Secretary-Treasurer. Mr. S. Kay, Chair, called this meeting to order at 10:10 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, May 6, 2002, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Reaistered Plan 365 Appearances: In Support: Mr. Russell Lane Pattison Outdoor Advertising 2285 Wyecroft Rd Oakville ON L6L 5L7 Contra: None Public Submissions: In Support: None Contra: None The Committee was advised that the applicant is requesting permission to replace an existing legal non-conforming billboard sign with a new billboard in the same location and with the same dimensions having a rear yard setback from Charles Street of 1.37 m (4.5 ft.), rather than the required 7.5 m (24.6 ft.); a separation distance from a residential zone of 34 m (111.54 ft.), rather than the required 150 m (492.12 ft.); and a separation distance from another billboard sign located at 387-397 King Street East of 166 m (544.61 ft.), rather than the required 300 m (984.25 ft.). The Committee was in receipt of the following City staff / agency comments and public submissions (if any): . The following had no concerns or comments with respect to this application: Director of Building - April 1 0, 2002 Traffic & Parking Analyst - April 13, 2002 Region of Waterloo - April 9, 2002 Grand River Conservation Authority - April 5, 2002. Mr. R. Lane, agent for the applicant, advised that he had reviewed the staff comments and was in agreement with the recommendation contained therein. Moved by Mr. P. Kruse Seconded by Mr. D. Cybalski That the application of David Gascho requesting permission to replace an existing legal non- conforming billboard sign with a new billboard in the same location and with the same dimensions having a rearyard setback from Charles Street of 1.37 m (4.5 ft.), rather than the required 7.5 m (24.6 ft.); a separation distance from a residential zone of 34 m (111.54 ft.), rather than the required 150 m (492.12 ft.); and a separation distance from another billboard sign located at 387-397 King Street East of 166 m (544.61 ft.), rather than the required 300 m (984.25 ft.), on Lot 23 and Part Lot 24, Registered Plan 365, 481 King Street East & 24 Cameron Street South, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1 . That the variances as approved in this application shall be generally in accordance with the drawings submitted with Sign Variance Application, Submission No. SG 2002-006. It is the opinion of this Committee that: 1. The variances requested in this application are minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property.
