SPECIAL COUNCIL MINUTES
APRIL 29, 2002
CITY OF KITCHENER
A special meeting of City Council was held at 4:36 p.m. this date, Chaired by Mayor C. Zehr and with all
members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Financial Services Department report FIN-02-019 (P. Houston/D. Quinn/L
Baillargeon), dated April 24, 2002, recommending the execution of an Assignment Agreement between
Sunoco Inc., Ontario Energy Savings Corp. and the City of Kitchener.
Mr. D. Quinn advised that Sunoco Inc., a third party natural gas retailer with agreements with the City,
has sold its business to Ontario Energy Savings Corp. In order for Ontario Energy Savings Corp. to take
assignment of the contracts that Sunoco Inc. currently has in place with the City, written consent of the
City is required. Mr. Quinn noted that the draft agreement attached to the report has been written to
ensure that the City is protected during this transition. Mr. J. Shivas advised that the draft agreement
has been revised to recognize the City's estimate of the holdback for the financial reconciliation and that
Sunoco Inc. agrees to indemnify the City.

"That the City consent to, and the Mayor and Clerk be authorized to execute, the Assignment
Agreement dated April 1 , 2002 among the City, Sunoco Inc. and Ontario Energy Savings Corp.,
subjec to the satisfaction of the City Solicitor, permitting Sunoco Inc. to assign certain agreements
with the City respecting natural gas to Ontario Energy Savings Corp."
Carried.
Mayor C. Zehr advised of an additional in-camera item involving a labour relations matter.
Moved by Councillor J. Ziegler
Seconded by Councillor J. Smola
"That Council meet in-camera this date to consider a personal matter, a labour relations matter
and three matters subject to solicitor-client privilege."
Carried.
The special Council meeting then recessed at 4:40 p.m. and re-convened at 5:54 p.m.
Council was in receipt of Corporate Services Department report CRPS-02-1 02 (J. Koppeser), dated April
25, 2002, recommending the extension of four Adult Entertainment Parlour Licences.
Moved by Councillor J. Ziegler
Seconded by Councillor J. Smola
"That the Adult Entertainment Parlour Licences issued to Cheryl Zivkovic, Brad Baumbach,
Randy Zivkovic and Malgorzata Zieman-Deptulski in January 2002 and expiring April 30, 2002,
be extended to September 30, 2002, with a review by Council to take place upon expiry."
Carried.
Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held this date regarding Corporate Services Department report CRPS-02-099, recommending
approval of a request to operate two hot dog carts during an annual community garage sale.
Moved by Councillor C. Weylie
Seconded by Councillor M. Galloway
"That the request of Les Halat to operate two hot dog carts, one at 215 Lennox Crescent and
one at 273 Stoke Drive, during the annual Community Garage Sale on May 4, 2002, be
approved, provided the necessary licence, including Health and Fire approval, is obtained. "

Seconded by Councillor G. Lorentz
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2002-86 by the Clerk."
Carried.
On motion, the meeting adjourned at 5:56 p.m.
