HERITAGE KITCHENER MINUTES
MAY 7. 2002
CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Councillor M. Galloway, commencing at 4:00 p.m., with the
following members present: Ms. P. Wagner, Ms. G. Engel, Ms. C. Martindale and Messrs. R. Green, Z.
Janecki, E. Lucy, B. Nixon, B. Scott. Messrs. J. Clinkett and W. Stauch were in attendance for part of
the meeting.

1. HERITAGE PERMIT APPLICATION 2002-V-11

NEW CONSTRUCTION
The Committee was in receipt of Heritage Permit Application 2002-V-11, dated 2002-03-19,
seeking permission to construct a single family dwelling and garage on the property municipally
known as 25 Mitierra Drive. The Committee had deferred consideration of this application at its
April meeting to give the applicant an opportunity to decide on exterior colours and materials, a
sub-committee having been formed to work with the applicant in this regard.
Mr. L. Bensason reported on behalf of the sub-committee and displayed samples of the building
materials chosen by Mr. & Mrs. Wilfong. Mr. B. Wilfong was in attendance to answer any
questions the Committee might have in this regard. In response to a comment raised at the
previous meeting, Mr. Wilfong confirmed that the proposed house is 3 feet shorter than the
existing house on the adjacent property.
On motion by Ms. P. Wagner-
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Council approve the application
of the owner (HPA #2002-V-11) to alter the designated property municipally known as 25
Mitierra Drive, located in the Upper Doon Heritage Conservation District, by constructing
a new single family dwelling and garage, including the following materials:

2. HERITAGE PERMIT APPLICATION 2002-V-12
10 BUERKLE COURT
NEW CONSTRUCTION
The Committee was in receipt of Heritage Permit Application 2002-V-12, dated 2002-04-18,
seeking permission to construct a single family dwelling and garage at the property municipally
known as 10 Buerkle Court. Attached to the application is an elevation drawing of the proposed
home and a copy of an e-mail from the applicant's agent listing the colour and material names
proposed for the building. Mr. G. Scheels was in attendance to represent the application and
displayed a building location plan and samples of the bricks and siding.
Mr. Bensason displayed images of the location of this property on Buerkle Court and the style of
house chosen.
Mr. J. Clinkett and Mr. W. Stauch entered the meeting at this time.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Council approve the application
of the owner (HPA # 2002-V-12) to alter the designated property municipally known as 10

3. HERITAGE PERMIT APPLICATION 2002-IV-05

- EXTERIOR PAINTING
The Committee was in receipt of Heritage Permit Application 2002-IV-15, dated 2002-04-29, for
renovations and maintenance at the property municipally known as 234 Frederick Street (Forsyth
House). The application seeks permission to: patch stucco, repair front concrete steps, power
wash the building and repaint it in a different colour.
Mr. & Mrs. Rabley, the applicants, addressed the Committee advising that their intentions with
respect to the application have changed, due to the excessive costs involved in repairing the
stucco, and in consideration of other maintenance and repairs required for the building. They
advised that within a week they will meet with their contractor to identify exactly what repairs are
required and the most cost effective way to undertake the work. They advised of their
willingness to consider any advice the Committee could offer in this regard.
It was generally agreed a sub-committee will be formed to work with the applicants with respect
to the necessary repairs/maintenance, and consideration of their application will take place at the
June 11, 2002 Heritage Kitchener meeting.
4. HERITAGE PERMIT APPLICATION 2002-IV-14

- INSTALLATION OF NEW ROOF
The committee was in receipt of Heritage Permit Application 2002-IV-14, dated 2002-04-25, in
which the applicant seeks permission to install stone coated steel roofing over the existing
asphalt shingles. Images of the building were displayed and a sample of the roofing material
was also displayed. This roofing material has a 50 year warranty and has the appearance of
asphalt shingles.
On motion by Mr. B. Scott -
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, Council approve the application
of the owner (HPA #2002-IV-14) to alter the designated property municipally known as
307 Queen Street South (Bread & Roses Co-operative Housing) by installing stone
coated steel roofing produced by 'Decra' over the existing asphalt shingles."
5. HERITAGE PERMIT APPLICATION 2002-V-13
- 21 NORFOLK CRESCENT
- DEMOLITION OF DETACHED GARAGE
The Committee was in receipt of Heritage Permit Application 2002-V-13, dated 2002-04-22,
seeking permission to demolish the detached garage located in the rear yard of the property
municipally known as 21 Norfolk Crescent, located in the St. Mary's Heritage Conservation
District. Images of the property were displayed.

On motion by Mr. R. Green -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Council approve the application
of the owner (HPA #2002-V-13) to demolish the detached garage at the designated
property municipally known as 21 Norfolk Crescent, located in the St. Mary's Heritage
Conservation District."
6. TILT DRIVE WATERMAIN INSTALLATION
Mr. Bensason advised of the City's intention to install a watermain within the Tilt Drive right-of-
way. He reviewed the Municipal Plan provisions with respect to Scenic-Heritage Roads and the
precautionary measures being taken to ensure that the Municipal Plan provisions are complied
with, including a "Pre/Post Condition" report from Utility staff.
In this regard, Committee members were provided with copies of an e-mail from Mr. Bensason to
Kitchener Utilities, a memorandum from Kitchener Utilities dated February 22, 2002, an extract
from a map of Tilt Drive, and an extract from the Municipal Plan with respect to Scenic-Heritage
Roads.
On motion by Mr. J. Clinckett-
it was resolved:
"That Heritage Kitchener supports the request of the City's Heritage Planner for a
'Pre/Post Conditions' report from Kitchener Utilities relative to the installation of a
watermain in the Tilt Drive right-of-way, as outlined in the electronic mail from L.
Bensason to L. Jones, dated May 6, 2002."
7. PURCHASE OF SIMS ESTATE
Mr. Bensason displayed images of the property at 787 Morrison Road, known as the Sims
Estate, and advised that the property has recently been purchased and the new owner has
shown an interest in having the property designated. Mr. Bensason suggested that the property
may be of Provincial and/or National Significance based on Harvey Sims political connection.
Also, the property contains some significant tree and plant species. Mr. Bensason advised that
assistance is required to prepare a property report and in this regard contact had been made
with the Ministry; however, the Ontario Heritage Foundation would want an easement on the
property before undertaking an assessment of the property's Provincial significance.
Mr. Clinkett suggested contacting the Architectural Conservancy of Ontario to undertake an
assessment of the property, and Mr. Bensason agreed to do so.
8. HERITAGE PROPERTY TAX RELIEF
Mr. L. Bensason distributed copies of an information report titled "Heritage Tax Relief Program".
He explained that the Province has passed legislation that will permit municipalities to offer
property tax relief, under certain circumstances, for Heritage properties. It is required that the
property be designated under the Ontario Heritage Act and a Heritage Easement is registered
against the property. He advised that a working group has put together various options for
implementing such a Tax Relief Program, and the options developed, as outlined in the
information report, were explained by Mr. Bensason.

Mr. Bensason further advised that the working group has been directed to move forward with
developing the Tax Relief Program, which will involve approaching the Region of Waterloo to
request that they rebate their portion of the property taxes. He advised that if the Region does
not agree to participate in this program, only the City's and Education portions of the property
taxes will be affected by this program. It is anticipated that a report will be presented to City
Council prior to its summer break.
9. COMMITTEE CONCERNS
Ms. P. Wagner raised some concerns which members of the Committee have brought to her
attention, including;
a) the 4:00 p.m. meeting start time;
b) items previously addressed which remain incomplete; and,
c) the potential loss of heritage buildings in the downtown.
Ms. Wagner also advised that she has received a request from the Region's Heritage Planning
Advisory Committee to designate the Bridgeport Bridge.
Ms. Wagner then elaborated on concerns of Committee members at the number of Heritage
buildings being demolished in downtown Kitchener, without consultation with this Committee.
She stated the necessity for Heritage Kitchener to be pro-active with respect to the John Forsyth
Factory at 31 Young Street. She noted that the City owns this designated structure and is doing
nothing in terms of its maintenance.
Ms. Wagner proposed a motion to request City Council to set an example for other owners of
designated properties by maintaining the heritage designation on the Forsyth Factory,
undertaking repairs which would prevent further deterioration of the building, and requiring
preservation as a condition of any redevelopment.
Mr. Z. Janecki noted that Heritage Kitchener had been asked to tour this building just before
Christmas, following which, Ms. C Ladd had attended a Heritage Kitchener meeting seeking this
Committee's comments and opinions with respect to the building. He suggested that Heritage
Kitchener's opinions are not given serious consideration.
On motion by Ms. P. Wagner-
it was resolved:
"WHEREAS City Council previously indicated its willingness to preserve the
historic and architecturally significant building municipally known as 31 Young
Street (John Forsyth Factory) by designating it pursuant to the Ontario Heritage
Act, against the wishes of the owner;
THEREFORE BE IT RESOLVED that Heritage Kitchener strongly urges Council to set
an example for other owners of designated properties by maintaining the designation
under the Act, preserving the John Forsyth Factory by repairing the drainage pipes to
prevent further water damage, and requiring preservation of this building as a condition of
any redevelopment."
Ms. Wagner then requested that the Committee approve the purchase of a digital camera, from
the Committee's own funds raised through the sale of maps, for exclusive use by the City's
Heritage Planner.
On motion by Ms. P. Wagner-
it was resolved:
"That Mr. L. Bensason, Heritage Planner, purchase a digital camera for his use, to be
paid from Heritage Kitchener's map sales account."
10. 237 FREDERICK - KNELL HOUSE

Mr. Bensason advised that the owner of 237 Frederick Street intends to apply for demolition of
this property, and reminded the Committee that they had previously intended to designate the
property but were opposed by the owner. He advised that a pre-application meeting is scheduled
to take place between City staff and the owner to discuss the demolition and proposed
redevelopment of the property.
