SPECIAL COUNCIL MINUTES
MAY 13, 2002
CITY OF KITCHENER
A special meeting of City Council was held at 4:15 p.m. this date, Chaired by Acting Mayor J. Smola and
with all members present except Mayor C. Zehr and Councillor G. Lorentz.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Corporate Services Department report CRPS-02-109 (J. Koppeser), dated May
6, 2002, recommending that the Holy Spirit Festival, June 7-9, 2000, be declared a 'Community
Festival'.
Moved by Councillor B. Vrbanovic
Seconded by Councillor M. Galloway
"That the City of Kitchener has no objection to a liquor licence being issued to the Holy Spirit
Festival Association of Kitchener-Waterloo for an event to be held June 7,8 & 9, 2002, at 1548
Fischer-Hallman Road, Kitchener; and further,
That this event be declared a 'Community Festival' for the purpose of applying for a liquor licence,
since this is a traditional Portuguese celebration of their heritage that promotes unity and
understanding within our community."
Carried.
Council was in receipt of Corporate Services Department report CRPS-02-118 (J. Koppeser), dated May
8, 2002, recommending that the 2002 World Softball Championships be granted permission to sell food,
liquor and merchandise and be granted an exemption from Chapter 450 (Noise) of the Municipal Code.
Moved by Councillor M. Galloway
Seconded by Councillor J. Ziegler
"That the host committee for the 2002 World Softball Championships be granted permission to
sell food, liquor and merchandise on May 30 to June 2, 2002, and on August 8, 2002; and,
That the 2002 World Softball Championships be granted an exemption from Chapter 450 (Noise)
of the Municipal Code in conjunction with events to be held May 30 to June 2, 2002, and on
August 8, 2002; and further,
That the 2002 World Softball Championship Tournament, which is a major world class fastball
event, be designated as an event of Municipal Significance for the purpose of applying for a liquor
licence."
Carried.
Acting Mayor J. Smola advised that a tentative agreement had been reached between the City and
CUPE Local 32 - Outside and Fleet Employees which requires ratification by Council. Due to the fact
that the next regular meeting of Council would not be held until May 27, 2002, Council was requested to
deem this matter urgent and to consider the matter at the special meeting of Council immediately
following the in-camera session.

"That pursuant to Section 25.4.4(f) of Chapter 25 of the Municipal Code, the ratification of the
tentative collective agreements between the City of Kitchener and CUPE Local 32 and Fleet
Mechanics be deemed urgent and be considered at the special meeting of Council held this
date. "
Carried Unanimously.
Acting Mayor J. Smola advised of an additional item for in-camera discussion pertaining to a land
acquisition matter. He also informed Council of the necessity to re-convene this special meeting
following the in-camera meeting in order to deal with the CUPE Local 32 Collective Agreements.

Seconded by Councillor C. Weylie
"That Council meet in-camera this date to consider two land acquisition matters, a labour
relations matter, two matters subject to solicitor-client privilege and a litigation matter which is also
subject to solicitor-client privilege."
Carried.
The meeting then recessed at 4:18 p.m. and re-convened at 5:50 p.m.
Council was in receipt this date of Strategic Services Department reports SSD-01-009 and SSD-01-011
(L. Bansen), both dated May 13, 2002, recommending approval of the terms and conditions contained in
a Memorandum of Settlement dated April 30, 2002, in connection with the Collective Agreements with
CUPE Local 32 - Outside and Fleet Employees.

Seconded by Councillor B. Vrbanovic
"That City Council approve the terms and conditions contained in a Memorandum of Settlement
dated April 20, 2002, in connection with the 2002-2003 Collective Agreement with CUPE Local 32
- Fleet; and further,
That the Mayor and Clerk be authorized to execute any documentation arising therefrom."

"That City Council approve the terms and conditions contained in a Memorandum of Settlement
dated April 30, 2002, in connection with the 2002-2003 Collective Agreement with CUPE Local 32
- Outside/Civic Employees; and further,
That the Mayor and Clerk be authorized to execute any documentation arising therefrom."
Carried.
Council was in receipt of Tender T02-025 (L. Gordon), dated May 9, 2002, recommending the awarding
of the tender for three rotary mowers.
Councillor J. Ziegler questioned the awarding of the tender to the highest bidder and asked staff if the
recommended mowers were, in fact, better machines which would account for the higher costs.
F. Pizzuto, General Manager, Community Services Department, responded that in staff's opinion,
although a John Deere mower would be adequate, the mower from G.C. Duke Equipment was a
superior machine and justifies the higher costs.

Seconded by Councillor B. Vrbanovic
"That Tender T02-025, Two (2) Outfront Rotary Mowers complete to specification CKF-303-
2002, be awarded to G.C. Duke Equipment Ltd., Burlington, Ontario at their tendered price
of $45,472., plus one (1) additional unit approved by the Equipment Review Committee at
$22,736., plus P.S.T. and G.S.T."

Seconded by Councillor C. Weylie
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2002-95 by the Clerk."
Carried.
