MARCH 27, 2006 CITY OF KITCHENER
A special meeting of City Council was held at 6:17 p.m. this date, Chaired by Mayor C. Zehr and with
all members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Councillor J. Smola advised that he has given notice to introduce a motion to confirm Council's
actions with respect to Heritage Permit Application HPA 2006-IV-001 regarding the Forsyth buildings.
Councillor Smola explained that at the Council meeting of March 20, 2006 it may have been unclear
regarding Council's consideration of the Heritage Permit Application to demolish the two remaining
buildings on the Forsyth property and that his motion this date clarifies Council's action.

Seconded by Councillor B. Vrbanovic
"Whereas Council at its meeting of March 20, 2006 adopted a resolution not to retain the two
remaining buildings on the Forsyth property, being the 1937 Art Deco addition and the Smyth
residence; and,
Whereas pursuant to Section 34 of the Ontario Heritage Act, the City of Kitchener had
submitted Heritage Permit Application HPA 2006-IV-001 to demolish the said buildings.
Now therefore it is resolved that by virtue of the resolution adopted on March 20, 2006
regarding the Forsyth buildings, Council as the approval authority consented to Heritage
Permit Application HPA 2006-IV-001 in order to facilitate the demolition of the remaining
buildings located on the Forsyth property."
Carried.
Councillor B. Vrbanovic advised that at the March 20, 2006 Council meeting when the Forsyth
buildings were discussed he requested that staff investigate and report back on the feasibility of
moving the Smyth Residence from the Forsyth property to another location. He further advised that
staff have informed him that due to costs and logistics the moving of the Smyth Residence would not
be feasible. Mr. H. Gross, Director of Project Administration and Economic Investment, advised that
there are only three companies in the Province that could undertake moving the Smyth Residence
and that the estimated costs would exceed $1 M. Councillor Vrbanovic advised that based on this
information he no longer requires any further action from staff in this regard.
Mayor C. Zehr advised that Items 2 and 3 on the special Council agenda regarding the Joseph /
Gaukel Street Reconstruction and the Victoria Park Entrance were deferred by the Finance and
Corporate Services Committee this date therefore Council need not deal with those two items.
Council considered a recommendation arising from the Finance and Corporate Services Committee
this date with respect to a land transfer of the property at 521 King Street West.

"That the Mayor and Clerk be authorized to execute the necessary documentation with the
University of Waterloo for the staged transfer of the property known as 521 King Street West,
satisfactory to the City Solicitor."
Councillor J. Gazzola requested a recorded vote.

B. Vrbanovic, M. Galloway, G. Lorentz and C. Weylie.

Motion Carried.
Councillor B. Vrbanovic requested that an additional item be added to the special Council agenda
regarding his position on the Federation of Canadian Municipalities National Board of Directors.

"That pursuant to Chapter 25 (Council Procedure) of the Municipal Code, the following matter
be added to the agenda of the special meeting of Council on March 27, 2006:
• Council's support of Councillor B. Vrbanovic seeking a position on the Federation of
Canadian Municipalities (FCM) National Board of Directors and FCM Committees."
Carried Unanimously.
Moved by Councillor M. Galloway
Seconded by Councillor C. Weylie
"That Kitchener City Council supports Councillor B. Vrbanovic seeking a position on the
Federation of Canadian Municipalities (FCM) National Board of Directors and FCM
Committees and is prepared to meet the costs of attending those meetings."
Carried.
The meeting then recessed at 6:25 p.m. and reconvened at 7:38 p.m., Chaired by Mayor C. Zehr and
with all members present.
Council considered a recommendation arising from the Development and Technical Services
Committee meeting held this date regarding environmental remediation at Bramm Street Operations
Centre and the parking lot at 72 Victoria Street South.
Moved by Councillor C. Weylie
Seconded by Councillor M. Galloway
"That the Remedial Action Plan (Option 2), as outlined in Development and Technical Services
Department report DTS-06-048, be approved at an upset limit of $300,000, for the environmental
remediation of gasoline related contamination in the soil and groundwater at the Bramm Street
Operations Centre and the parking lot at 72 Victoria Street South, on a without prejudice basis;
and,
That the Mayor and Clerk be authorized to sign an Access and Indemnity Agreement with the
registered owner of 72 Victoria Street South, satisfactory to the City Solicitor, for the purpose of
conducting bio-remediation work thereon to complete the Workplan; and further,
That Frontline Environmental Management Inc. be retained to manage the environmental
remediation for this project, notwithstanding Chapter 710 (Purchasing) of the City of Kitchener
Municipal Code."
Carried.
Mayor Zehr requested that the recommendation arising from the Development & Technical Services
Committee meeting of this date with respect to a Brownfield Remediation Program Application for 1420
King Street East be added to this special meeting of Council as the property owner cannot obtain a
building permit for this seniors' housing project until a decision is made on the Application.

"That pursuant to Chapter 25 (Council Procedure) of the Municipal Code the following matter
be added to the agenda of the special meeting of Council on March 27, 2006:
• Consideration of a recommendation arising from the Development and Technical Services
Committee meeting held this date regarding Brownfield Remediation Program Application
06-01 - 1420 King Street East."

Council considered the recommendation arising from the Development and Technical Services
Committee meeting held this date regarding Brownfield Remediation Application 06-01 - 1420 King
Street East.
Moved by Councillor C. Weylie
Seconded by Councillor J. Smola
"That Brownfield Remediation Application 06-01, received from Menno Homes Inc., dated
March 20, 2006, for the property municipally known as 1420 King Street East, be approved;
and,
That in exchange for a completed and filed Record of Site Condition for 1420 King Street East,
the City of Kitchener provide a grant in the form of an annual rebate on City taxes in an amount
equal to 100% of the City Tax Increment; where the City Tax Increment is defined as the
difference between the City portion of real property taxes for the 2006 Taxation Year and the
new City portion of real property taxes levied as a result of a new assessment by the Municipal
Property Assessment Corporation (MPAC) following completion of the project; with the grant to
continue for a maximum period of 10 years or until the total Eligible Remediation Cost of
approximately $197,223.01 has been reached, whichever comes first; and further,
That the Mayor and Clerk be authorized to execute a Remediation and Redevelopment
Agreement with Menno Homes Inc., satisfactory to the City Solicitor."

"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2006-76 by the Clerk."
